民国时期集体劳动合同立法述论 —— 以 1930 年《团体协约法》为中心

民国时期,通常将个别劳动合同称为劳动契约,而将集体劳动合同称为团体协约。中国劳工立 法较迟,团体协约立法则更晚。国民政府有关团体协约的立法最早可以追溯至 1929 年《劳动法典草案》的编纂, 其后在《工会法》起草过程中也有团体契约权的规定。延至 1930 年,国民政府正式颁行《团体协约法》,这是 中国历史上第一部有关集体劳动合同的专门法律。《团体协约法》的出台因应了当时中国工业化过程中劳资冲 突的实际需求,但也不可避免地存在历史局限。     

Regendering modernism: the woman artist in Irish women’s fiction

The period between 1922 and 1960 is often characterized as one of social and cultural stagnation in Ireland. Irish fiction was dominated by an avant-garde writing in exile and the local dominance of the short story. Attention to the non-canonical fiction of women during the period, however, reveals a literature that exceeds this paradigm. Meaney focuses on two novels, The Troubled House by Rosamond Jacob and As Music and Splendour by Kate O’Brien, which both feature women as artists. This figure provides in both cases a mode of combining a commitment to narrative realism with a self-reflexive exploration of the role of art, thus evading the fictional polarities of the period. The woman artist as fictional character also offers an opportunity to explore the relationship between gender, sexuality, politics and art. The linkage between sexual dissidence and aesthetic freedom is a persistent trope of modernism in the Irish context, even if it is often critically submerged under the figure of exile. Both The Troubled House and As Music and Splendour might be considered to be supplements to Irish modernism in the Derridean sense, ‘an originary necessity and an essential accident’. Through the figure of the woman artist, both of these marginal novels transgress the configurations of gender at the heart of that modernism’s aesthetic project. Both link transgressive sexuality with artistic production. In doing so they posit a very different relationship between sexuality, aesthetics and politics.     

新冠肺炎疫情期间公安法医应当加强尸体甄别和个体防护

因鉴定体制特点,公安法医除参与尸体有关的现场勘查工作外,还需进行尸体检验工作。在此过程中,可能面对很多风险,受伤和中毒等事件时有发生。然而,国内公安法医对新冠肺炎等传染病流行期间死亡的尸体如何甄别进行尸体检验鉴定,对现场勘查及尸体检验工作的防护只有少量规定,且内容不够详尽。本文对法医在现场勘查中遇到的尸体及尸体检验中实验室建设、职业现状、风险评估及防范措施等进行了论述。最后,建议出台相关的制度规定等具体约束规范措施,以保障公安法医现场勘查及尸体检验工作的顺利进行,以解除基层鉴定机构和鉴定人的后顾之忧。     

Regime type versus patronal politics: a comparison of “ardent democrats” in Kazakhstan and Kyrgyzstan

Kazakhstan is home to the longest serving ruler in post-Soviet Eurasia while Kyrgyzstan is among the region’s most competitive polities. Do these regime differences correspond to divergence in political attitudes, as an extensive body of literature posits? Are Kyrgyzstanis more likely to strongly support democratic ideals? Are Kazakhstanis less likely? Contrary to expectations, data reveal the two populations to be attitudinally indistinguishable when it comes to strong support for practices associated with democracy. Whatever country differences we find are minor or statistically insignificant. We explain this convergence by shifting focus away from the political features that distinguish the two nascent democracy versus consolidated authoritarianism to those that they hold in common. Notwithstanding major constitutional reform in Kyrgyzstan in 2010, politics there, as in Kazakhstan, remains fundamentally patronal, or patronage- based. Mass attitudes, we argue, align in many ways with the countries’ shared patronal politics, rather than with their contrasting regime types.     

马立克病病毒致瘤相关基因的研究进展

从meq基因、pp38复合体、HSV ICP4的同源体、L开放阅读框(L ORF)、位于BamHⅠ-H片段的基因和病毒类白细胞介素-8(vIL-8)等几个方面论述了马立克病病毒感染期间参与肿瘤形成的相关基因的生物学活性。     

猪生殖与呼吸综合征病毒CH-1a株GP5蛋白基因的表达及其单克隆抗体的制备

将猪生殖与呼吸综合征病毒(PRRSV)CH-1a株GP5蛋白基因信号肽部分删除后克隆于pGEX-6p-1载体上,并在大肠埃希氏菌中进行表达。经SDS-PAGE电泳分析发现,融合表达的rtGP5蛋白约42 ku,将融合蛋白rtGP5用PRRSV阳性血清进行Western-blotting分析,证实所表达的融合蛋白能被其特异性识别。收获融合表达产物rtGP5,按50μg/只的剂量与等量弗氏佐剂乳化,经腹腔免疫BALB/c小鼠3次后,取脾细胞与SP2/0骨髓瘤细胞进行融合,分别以融合蛋白rtGP5和GST蛋白为抗原,通过间接ELISA方法对融合细胞的上清液进行检测,筛选阳性克隆,结果得到了15株能稳定分泌抗rtGP5蛋白抗体的阳性细胞克隆株。经间接免疫荧光检测发现,获得的15株单克隆抗体都能与PRRSV感染细胞产生特异性荧光。15株单克隆抗体亚型鉴定结果显示均为IgG1型,且轻链均为κ链。

我国现行的《医疗事故技术鉴定暂行办法》规定了医疗事故中医疗过失行为的责任程度分为：完全责任、主要责任、次要责任、轻微责任。该办法用这四种责任程度来判定医疗过失行为的责任程度存在明显的缺陷,缺少了一个同等责任程度的规定。为了今后便于司法实践的操作,公平合理地维护医患双方的权益,应该增加同等责任程度的规定,来完善我国医疗事故技术鉴定相关立法。
