随着党的十八届三中全会对全面深化改革的强力推动,以及个体经济组织的快速发展和经营规模的日益扩大,其雇用人员利用工作之便的侵占行为日益严重,仅靠自诉途径难以解决相关问题,不仅明显有失法律的公平正义,违背罪刑相当原则,也无法发挥刑法应有的遏制和震慑作用。因此,从平等保护公有经济和非公有经济的各类市场主体的角度出发,确有必要加强对个体经济组织的刑事保护。在现行法律框架和体系下,采取完善刑事立法、扩大司法解释、明确例外情形等方式,以公诉途径解决此类司法难题。  相似文献

Terrorist groups are often relatively conservative in their choice of strategy, tactics, and targets, and it is worth asking what characteristics are associated with unconventional behavior. In this article we explore the question of why terrorist organizations move to one type of unconventional attack that has been a focus of concern of policymakers in recent years, namely attacks on maritime targets. Through an investigation of the organizational capacity and ideology of terrorist groups that committed maritime attacks between 1998 and 2005, we argue that this kind of violent behavior is driven by capability. Certain organizational characteristics of terrorist groups—territorial control, involvement in the drug trade, organizational size, and connections with other groups—provide groups with the capabilities that make maritime attacks both realistic and desirable. Terrorist groups' ideology—what they believe, and what their goals are—does not have the same impact, with the possible exception of groups affiliated with al-Qaeda. Our findings have implications for future research.  相似文献

Abstract

This paper explores the links between migration and development emphasized by international organizations. This discourse, which encourages migrants to work at their level, toward the development of their country has become consensual. But if one looks closely, these natural links seem fragile, both in international migration policies and social experiments of migration. By studying the case of the Togolese migration, this article shows that the institutionalization of this new paradigm is weak and that the recent implementation of migration policies in Togo just seems to be an answer to the requirements of international partners. More than a real programmatic issue, the role of the diaspora in development becomes an obligatory resource in negotiations with sponsors. Then, if the discourse on development began to emerge among migrants themselves, it is not necessarily synonymous with the growth of a strong culture of transnational or diasporic commitment. Few associative structures are actually created and migration trajectories and histories are first and foremost thought of in an individual or familial frame, far from social imperatives of community development. Finally, if we analyze the more general logic of these migrations in Togo, while they seem to foster identity transformations they may primarily function as a driving force behind reproduction of social inequalities in the country of origin.  相似文献

This article is the fifth and final in a Nationalities Papers series providing an overview of the development of Romani political group representation and administration, from the arrival of Roma to Europe up to 1971, the landmark year of modern transnational Romani politics. The article concentrates on the period between the Second World War and 1970 and the emergence of the following phenomena which distinguish this period from those covered in the previous articles: some limited Romani participation in non-Romani mainstream political or administrative structures, an international Romani evangelical movement, reconciliation between Romani political representation and the Catholic Church, national institutions created by various governments to aid the administration of policies on Roma and rapid growth of non-governmental organizations addressing Romani issues.  相似文献

In 1993 President Clinton signed into law the National and Community Service Trust Act, the centerpiece of which was a new national service initiative—AmeriCorps. The overall purpose of AmeriCorps was to promote community building through volunteer service. AmeriCorps was one high-profile program established in part to highlight government-nonprofit partnerships and their capacity to improve communities and service delivery to the most vulnerable in communities—poor children, frail elderly, and teenagers who are at risk of dropping out of school or getting into serious juvenile delinquency problems. AmeriCorps' programs nationally work to achieve three goals—Getting Things Done, Member Development, and Strengthening Communities. Few of the studies on AmeriCorps have explicitly studied their impact on community strengthening. This article reports on a two-year study of twenty two AmeriCorps programs in Florida from 1997–2000, emphasizing their objectives and success in community strengthening. Program results are limited. The programs increased the number of volunteers delivering their services and developed one or more community partner organizations at each site. Nearly all of the program staff and community partners believed that the AmeriCorps programs positively influenced the community's self-help capacity to some extent. However, data indicating broader community strengthening impacts were hard to find and difficult to track. Reasons for this relatively modest impact on broader community strengthening goals are articulated based on surveys, interviews, and site visits.  相似文献

Several theoretical perspectives posit a negative association between the extent of a neighborhood's organizational infrastructure and crime; yet, empirical support for this proposition has been limited in that researchers generally examine only a few types of organizations or combine them into one aggregate measure. Studies with few measures may omit organizations that are effective at reducing crime, whereas those using aggregate measures obscure differences across organizations in their ability to control crime. Using data from 74 block groups in the South Bronx, NY, this research seeks to specify more clearly the relationship between organizations and crime in a disadvantaged urban environment. We examine the relationship among nine different types of organizations and violent and property crime controlling for prior crime, land use, and area sociodemographic characteristics. Consistent with theories that highlight the importance of organizations for establishing ties outside the neighborhood, we find that block groups with more organizations that bridge to the larger community experience a decrease in crime. Property crime also is reduced in block groups with more organizations that promote the well‐being of families and children. We find that schools are associated with an increase in property crime, whereas the effects of other organizations are context specific and vary based on neighborhood racial composition, commercial land use, and disadvantage.  相似文献

Mainstream arts management and stakeholder research highlights the relationships between nonprofit organizations and community, yet empirical research on how those interactions result in outcomes is limited. This article looks at the stakeholder attribute “urgency” and the impact on and by the stakeholder group “community.” Building on a comparative case study of five cultural organizations and their capital intensive facility projects, our research finds that both new and existing organizations embrace a community-wide process whereby internal and external stakeholders are identified, relationships nurtured, social and emotional bonds strengthened, and shared urgency between community and organization is created towards specific outcomes.  相似文献

The paper argues for the possibility of reworking the concept of ideology in such a way as to depend neither on a problematic of truth and error, nor on a division of the world into two parts one of which is more real than the other, nor on an expressive relation of subjects to meaning. The political force of the concept can be retained if ideology is thought as a provisional state of discourse (a function of its appropriation and use) rather than as a content or an inherent structure. Any discursive system produces a particular configuration of subject-positions which are the conditions of entry of individuals into discourse; but these acquire political significance only through the (historically variable) codification of discourse in terms of a play of relations of power, and the positions available can be refused or undermined. Some implications of this argument for models of the social and for discourse theory are discussed  相似文献
