政府间组织应该成为国际法院诉讼当事方

《国际法院规约》不认可政府间组织是国际法院的诉讼当事方,并且众多修改建议也未能实现。给予政府间组织诉讼当事方地位,具有现实意义,如有效解决涉及国际组织的争端和扩大国际法院职能等;当然也关系到修改法院规约等一系列复杂问题。

贿赂外国公职人员或者国际公共组织官员罪若干问题研究

我国刑法中的贿赂外国公职人员或者国际公共组织官员罪,其渊源在于《联合国反腐败公约》。但是,在我国将国际公约内化为国内刑法的过程中,本罪的若干方面仍与公约存在脱节之处。笔者认为,应将本罪构成要件中的＂不正当商业利益＂修正为＂不正当利益＂;重新界定＂外国公职人员和国际公共组织官员＂的内涵;扩大＂贿赂＂的范畴;最后提出在我国刑法中应增设外国公职人员、国际公共组织官员受贿罪。

Understanding the Political Preferences of Seniors’ Organizations. The Swiss Case.

Abstract: According to numerous politicians, reforming the welfare state in aging societies has become increasingly necessary in spite of the growing influence of advocacy groups that have made reforms more difficult to realize. Studying the preferences of seniors’ organizations is therefore crucial to comprehending future welfare state policies. In this paper, I will examine recurrent variables that researchers working on seniors’ organizations study in order to explain the type of framing or political discourse that these organizations use. Using FARES/VASOS, the largest seniors’ organization in Switzerland, as a case study, I will show how common explanations (especially the ones that refer to the importance of the context or of the political opportunities structure), if they work, can also be seen as too incomplete or limited. We will see that focusing on how leaders are selected, their activism, and their reasons for involvement provides interesting data to help us understand the goals and political battles of this organization.     

学习型党组织建设的特点和着力点

学习型党组织建设是马克思主义学习型政党建设的基础工程,是推进党的建设的一项长期而重大的战略举措。加强学习型党组织建设必须突出基层党组织和党员学习的主体地位、培养理论联系实际的马克思主义学风、完善学习型党组织建设长效机制、形成浓厚而科学的党建文化、坚持领导带头示范,努力做到学活、学实、学新。     

社会组织建设中的政府作用探析——以吉林省为视角

社会组织建设是党的十七大提出的一项重要任务。社会组织的建设与发展离不开政府在多方面发挥作用。本文以吉林省为视角,从社会组织建设过程中发挥政府作用的紧迫性及现实性入手,论述了现阶段社会组织建设中的政府作用应该体现在哪些方面及如何体现的问题,以期为吉林省社会组织的建设与发展提供借鉴与参考。     

The Determinants of Collective Coproduction: The Case of Secondary Schools in Russia

ABSTRACT

This research focuses on parents’ participation in their children’s education via self-organizing through non-profit organizations (NPOs). The aim of this article is to uncover the factors which have an impact on Russian parenting organizations participating in collective coproduction in schooling. Quantitative analysis revealed three groups of explanatory variables: a) the “economic” variables, namely GRP per capita and poverty rate; b) a “high status” of a school; and c) variables capturing the “federal district effect” on the probability of collective coproduction. Results of the quantitative analysis highlight the significant discrepancies in regional conditions for emerging NPOs in coproduction in schooling.     

Civil society organizations,Africa’s Great Lakes Region conflict,and attempts at regional peacebuilding

This article advances the conceptualization of ‘regional peacebuilding’ and suggests six essentials for effective regional peacebuilding that when put together present a structured analytical approach. The article rationalizes the need for civil society organizations’ (CSOs) regional peacebuilding in Africa’s Great Lakes Region based on the existing conflicts that are of a regional nature. CSOs’ attempts at regionalizing responses are discussed in the context of their constraints and impediments, including inadequate analysis of regional dimensions of conflict and fragmented action. A comparative analysis of two intergovernmental organizations reveals that CSOs’ responses are further handicapped by regional organizations’ narrow conceptualization of peace and security coupled with the limited space for their participation in shaping the organizations’ agenda. Efforts to address these constraints should be coupled with CSOs’ efforts to innovatively develop invented spaces to collaborate on regional peacebuilding.
