浅谈当代中国检察机关宪法地位的合理性

对检察机关宪法地位合理性的探讨是近期法学理论研究的热点问题,关系到检察机关的长远发展.通过研究我国检察制度的沿革和现代检察制度的起源,并对当前一些主要观点进行分析,认为当代中国检察机关的宪法地位是有着其合理性和必要性的,唯有在坚持的基础上不断加以完善,才能真正实现司法公正之目的.     

Political culture and the persistence of inequality

A definition of political culture is posited in which the values that regulate reciprocal altruism constitute a normative system that sustains social solidarity and stabilizes inequalities. These values dampen resentment over unequal rewards by justifying status differences and the exclusion of racial, ethnic, and religious groups, among others, from full participation in social life. Inequality is bolstered by conventional modes of moral reasoning that legitimize explanations for inequality that are embedded in law or emanate from authority.     

From Status Politics to Technocratic Pluralism: Toleration of Religious Minorities in Canada

This paper examines patterns of public regulation as they may emerge throughout the West from controversies constructed around new and minority religions. Following Beckford's and Richardson's insights about the sociological exemplarity of these issues, we argue that evidence for some of these trends as well as clues for interpretation can be found in contemporary Canadian constitutional development that parallels and at times precedes that of Europe. Close examination of notions of society and religion found in more than 35 religion cases brought before the Canadian Supreme Court from 1951 to 1997 lead to the conclusion that beside governmental and parliamentary intervention, legal management of religious pluralism is assuming a decisively normative turn. Notions such as status politics, civic ethos, and technocratic pluralism are offered as an explanation of this trend.     

The Critic’s Love of The Law: Intimate Observations on an Insular Jurisdiction

This article, which should not in any sense be taken to reflect the views of the Editorial Board of Law and Critique, argues that the political project of critical legal studies in England remains overwhelmingly in the future. Lacking academic identity, political purpose and ethical conviction, critical legal scholarship in England has been too insecure in its institutional place and too unconscious of its individual and collective desires to resist absorption into the institution. Critical legal studies – as distinct from feminist legal studies, gay and lesbian studies or critical race theory –has tended to teach and so reproduce the core curriculum in a passive and negative mode. Resistant, ostensibly for historical and political reasons, to self-criticism and indeed to self-reflection upon their institutional practices, critical scholars have ended up repeating the law that they came to critique and overcome. 选拔大学生到村和社区工作,是党中央对社会主义新农村建设做出的又一重大战略决策,对三农问题的解决和基层党政干部的培养都具有重要的现实意义和深远的战略意义。我们通过对建德市大学生村官在农村现状的调查发现,大学生村官在农村各项工作中发挥了积极的作用,但在日常管理、培训培养、成长成才等方面存在的问题,值得组织部门引起高度重视,采取有效途径和手段加以改善、解决。     

改革开放以来党内民主问题研究述评

国内学术界对改革开放以来党内民主问题的研究主要从概念的界定、不同的研究视角、发展的路径、存在的障碍以及应处理好的几个关系五个方面展开,目的在于推进党内民主建设,最终对建立国家政治生活的民主化产生积极影响。这一研究为政治学的理论与实践发展做出了应有的贡献,但同时也存在一些不足,今后应注重多方面、多角度、多领域的交叉研究。在研究方法上注重实地调研与学理思考相结合,并注重从体制机制的实践性上深入思考,以便为党内民主在基层的推进提供可操作的理论支撑,深化对党内民主问题的研究。

论身份犯的间接正犯

随着我国刑法理论对身份犯、间接正犯等问题研究的深入,学界已开始对身份犯的间接正犯问题有所关注。但是,关于身份犯的间接正犯能否成立的问题上,大陆法系和国内学者均有不同的观点。身份犯的间接正犯问题对于司法实践具有现实的指导意义。因此,对于相关理论有加以比较、评析的必要。文章将在回顾大陆法系相关观点的基础上,结合具体案例对身份犯的间接正犯成立问题进行阐述。
