针对联合国货物运输法草案诞生后海运条约冲突存在的必然性,分析草案制定历程中先后公布的6份文本所呈现出的三种海运条约冲突解决模式:回避模式、优先模式和退约模式。认为回避模式太消极,应首先予以排除;优先模式和退约模式,均只能解决部分条约冲突,同时没有虑及未来新的条约。提出改进之途在于应一并考虑后法优于前法原则、善意履约原则、条约相对效力原则,同时适当运用条约优先地位条款。 相似文献

Abstract As the United Nations Convention on the Law of the Sea (UNCLOS) establishes itself as one of the premier regimes in international law, member states are increasingly availing themselves of the significant dispute settlement provisions found in Part XV. The International Tribunal for the Law of the Sea (ITLOS) is beginning to take its place in the pantheon of major international tribunals. Although its jurisprudence thus far has largely consisted of applications for prompt release of vessels, these cases have arisen from disagreements over fishery practices and the enforcement of fishery laws by coastal states. The ITLOS is developing into a transparent, consistent and speedy forum to adjudicate marine disputes arising from UNCLOS. While the overall scope and reach of Part XV may be uncertain at the present time, especially vis‐à‐vis other dispute settlement institutions, the early activity under Part XV is promising. Those concerned with marine wildlife issues should be encouraged by the potential of Part XV, the ITLOS in particular, to serve as an effective regime in the realm of marine wildlife dispute settlement. 相似文献

Literary criticism is generally considered too abstract for scholars dedicated to empirical research. Yet a deconstructionist analysis of Harry Potter reveals its strong relevance to political scientists and policy makers. This article focuses on how the stories of Harry Potter form a clear representation of the grand narrative of liberal values and multiculturalism. I show how this narrative is based on a masked, but nevertheless fundamental, contradiction that answers to the need of “absolute” identity, and that this generates discriminatory policies in both fiction and reality. The Harry Potter novels reflect how current racist, illiberal, discriminatory policies, such as the Arizona Immigration Law (SB1070), are not an aberrant contradiction of the liberal narrative. Rather, they are a direct product of it and therefore a result of its foundations identified in the exclusion of the other in the search for a sense of identity. Sin embargo, un análisis deconstructivo de Harry Potter revela la importancia de estas novelas para politólogos y hacedores de política pública. Este artículo demuestra como Harry Potter es una clara representación de la gran narrativa de valores liberales y de multiculturalismo. Argumento que esta gran narrativa está basada en una contradicción escondida que responde a la necesidad de identidad absoluta y que, debido a esto, la gran narrativa tiende a generar políticas públicas discriminatorias tanto en las novelas como en el mundo real. El análisis de Harry Potter demostrará como políticas racistas y discriminatorias, como la Ley de Inmigración del estado de Arizona (SB1070) la cual fue diseñada en un país liberal, no son una contradicción aberrante de la narrativa liberal. The Child and Adult Protection Authorities (KESB) have been the subject of controversial discussion since their establishment in 2013. The reform of the Guardianship Law provided for an institutional shift away from local guardianship authorities to regional specialist authorities. This article uses the Narrative Policy Framework (NPF) to examine the history of today’s controversy, simultaneously proposing an analytic strengthening of said framework. Previous NPF studies summarize policy actors into opponents and proponents. As a result, we do not know whether different actors use different narratives. We therefore separate the expert from the MP discourse. The analysis shows that the experts' arguments for a new institutional arrangement and a person‐oriented narrative dominated, which put the fundamental rights of the persons affected by guardianship measures up front. The study contributes to the understanding of the current controversy, in which a person‐oriented narrative seems to be dominant again, directed against the new authorities. 相似文献
