论公司的社会责任——以公司分立为视角

公司的社会责任是学术界和企业界历来争议较多的问题。即使新《公司法》进行了具体规定,人们对其在深层次上的讨论仍未减少。因此,有必要结合社会现状及相关理论作进一步的分析,来界定社会责任的倡导性规范,明确公司的根本利益所在,将公司的社会责任分为强制性与提倡性两个方面,进而归结为四个层次,从而在公司分立的情况下,更好地维护公司的利益和确保公司社会责任的承担。     

第三部门促进大学生就业的可行性分析

伴随着近30年的改革开放，第三部门在中国获得了迅猛发展，并在诸多方面发挥着日益重要的作用。同时，第三部门的发展也受到缺乏高素质员工的根本性制约。在就业形势严峻的当下，发展第三部门，使之成为吸收大学生就业的第三支力量，是一个对双方都有利的可行方向。不过在这方面，尚需国家及社会各方创造更多条件。

构建和谐社会,弱势群体和社会公正问题成为热点和关键,保护社会弱势群体的利益是实现社会公正的重要途径,实现社会公正内在要求关注社会弱势群体,只有将两者结合起来,才能构建社会主义的和谐社会。     

社会变革与刑事诉讼转型——新《俄罗斯联邦刑事诉讼法典》评介

随着社会政治经济的变革 ,俄罗斯的法律制度完成了根本转型。在刑事诉讼领域 ,经过前后 1 5年的修改和补充 ,颁布了新的《俄罗斯联邦刑事诉讼法典》。转型后的新法典 ,在刑事诉讼目的、结构、价值等基本理念方面发生了重大变化 ,除了将某些重要的宪法原则刑事诉讼法典化以外 ,进一步确立并完善了诸如证据规则、平反程序、和解法官审理程序和刑事诉讼国际合作程序等能够适应变化了的国内和国际形势的刑事诉讼制度。     

Measuring community social organization: Sense of community as a mediator in social disorganization theory

The current study utilized an updated systemic model of social disorganization to investigate neighborhood effects on both positive and negative youth outcomes. Although empirical support for updated social disorganization models has increased in recent years, the field continues to rely too heavily on behavioral indicators of community social organization. Unfortunately, these measures do not assess the truly important social processes and dynamics that result in cohesive and supportive neighborhoods. It was proposed that sense of community (SOC) was a more valid, comprehensive, and applicable measure for the mediating variables in social disorganization theory. Results supported the hypothesis that SOC mediates the effect of neighborhood disadvantage on youth outcomes and implications for the field are discussed.

人的问题是公共政策的核心问题,而人的问题的解决必须依靠人的自由全面发展。然而,人类政策活动的结果却是离人越来越远。今天我们在公共政策的价值导向上强调“以人为本”,就是要正确处理发展与人的关系,最终实现人的终级关怀。     

高校被诉引起的行政法思考

传统的社会组织划分方法已不能涵盖高校在当前的独特作用和行为性质。文章从现状的不尽如人意处着手,引入“第三部门”、“公务法人”等概念分析了高校独特的法律性质、地位,并建议建立教育行政救济制度,填补教育行政领域行政法治的空白。     

E-Mail Communication and Group Cooperation in Mixed Motive Contexts

Two empirical studies are presented that explore how and why e-mail communication (versus face-to-face communication) influences cooperation in mixed motive group contexts. Results indicate that, relative to those engaging in face-to-face interaction, those who interacted via e-mail were (1) less cooperative and (2) felt more justified in being noncooperative. Feelings of justification mediated the relationship between communication media and the decision to cooperate or not.

Capacity builders for governance: community-driven reconstruction in the eastern Democratic Republic of Congo

Community-driven reconstruction (CDR) has become a new paradigm in post-conflict development. It combines infrastructure restoration with introducing good governance at the local level. Recent evaluations show that governance objectives are not easily met and significant change cannot be demonstrated. This paper adds to this argument on the basis of ethnographic research on a CDR programme in eastern DRC. It seeks to find explanations for the lack of demonstrable governance impact in the content and implementation of training. It identifies room for improvement by better adjusting capacity building to locally prevailing accountability mechanisms and by coordinating capacity building with other development programmes.
