南非反艾滋歧视的立法及司法实践

南非是世界上艾滋病疫情最为严重的国家之一。从1992年开始南非对艾滋病采取一系列包括反艾滋病歧视在内的积极的防治措施。反艾滋歧视的典型判例是南非宪法法院在2000年就豪夫曼诉南非航空公司案所做的判决。该判决认定南非航空公司拒绝雇佣艾滋感染者豪夫曼的行为构成对艾滋感染者的不合理歧视．侵犯了其宪法赋予的平等权。     

韩国的环境纠纷调停制度

在环境问题日益严峻的今天，多国政府开始关注相关的立法和制度实践。但是我国环境问题的特殊性以及现行司法制度的现状却难以有效解决当今环境问题。而韩国的环境纠纷调停制度作为诉讼外解决环境纠纷的一种制度实践，将对我国相关制度的建立提供有益的借鉴模式。

中国山东与韩国京畿道经济园区作为区域发展的重要增长极,在各省道经济发展中占有极其重要的地位。两省道经济园区在投入产出、管理模式、园区环境等方面既存在共性,也存在差异。为了加强双方经济园区的交流与合作、继续担当区域经济的增长极,必须建立园区合作的政策机制和人才机制,打造园区合作的信息平台及创新模式,优势互补,在新的起点上实现经济园区整体健康发展。     

Democracy,social capital and school governing bodies in South Africa

Critics of school governing bodies (SGBs) – both on the left and on the right – tend to rely upon arguments that ignore significant portions of the act that created SGBs – the South African Schools Act (SASA) – the exact nature of the changes to SGBs wrought by amendments to the act and the manner in which the courts, in interpreting the act, have both reinforced the autonomy of SGBs at the same time as they have set limits on those powers. The authors’ reading takes seriously all of the provisions of SASA, its amendments and various court constructions of SASA's provisions. This close reading of the South African Constitution, SASA, SASA's amendments and the case law reveals the lineaments of a fourth level of democratic government. Even with their uneven success as a fourth tier of democratic government, SGBs reflect, in many respects, the most important interactions that citizens have with the state. The authors contend that SGBs provide a vehicle for popular political participation that is quite real, and that participation is made no less real by the strictures imposed upon them by South Africa's constitutional and regulatory order. Despite concerns about their lack of capacity, SGBs enjoy popular acceptance and participation across class and language divides. The legal status of SGBs does not merely enhance various forms of local democracy, SGBs also maintain and create effective social networks that generate new stores of social capital. The ability to provide new forms of democratic participation and to create new stores of social capital suggests that SGBs have the makings of a great, new and rather unique ‘South African’ political institution.     

冷战后东南亚国家南海政策的发展动向与中国的对策思考

本文主要从南海争端方国家、非南海争端方国家、东盟3个层次分析了冷战后东南亚国家南海政策的发展动向。对于南海争端方国家，重点分析了越南、菲律宾、马来西亚、印度尼西亚的南海政策；对非南海争端方国家重点分析了新加坡和泰国的南海政策；对于东盟的南海政策，本文指出协调成员国在南海问题上的立场，发表联合声明表达对南海问题的立场，直接就南海问题与中国进行对话，通过东盟地区论坛讨论南海问题构成了东盟对南海问题施加影响的主要方式。在对策思考方面，本文指出中国未来的南海政策应该侧重以下几点：继续将“搁置争议，共同开发”作为解决南海问题的基本原则；坚持“双边协商”的具体策略，力避南海问题的国际化；保持与东盟在南海问题上的沟通，确保东盟不致形成在南海问题上对中国不利的一致立场；在南海区域安全机制的构建和海洋安全维护方面发挥更大的作用。     

`The Capabilities Approach', `The Imaginary Domain', and `Asymmetrical Reciprocity': Feminist Perspectives on Equality and Justice

In this article the author revisits the question of how feminist theory/theories could address questions regarding universalism, sameness, difference, and the quest for justice. She reconsiders the quest for justice and equality for women and the (im) possibilities of a feminist perspective on justice and a feminist `community'. The three feminist theorists that she discusses are Martha Nussbaum, Drucilla Cornell, and Iris Marion Young. Nussbaum is closer to a liberal defense of universal values – Cornell and Young stand critical of liberalism and focus on sublimity, dignity, and asymmetrical reciprocity. The author supports the perspective of the latter two theorists and applies these perspectives to aspects of South African equality jurisprudence. She also considers critically the extent to which the Draft Protocol to the African Charter on Human and People's Rights on the Rights of Women in Africa breaks with liberal universalism and sameness. To the end she supports a notion of` slowing down' in order to protect women's freedom and dignity, to approach each other with wonder and respect. The human organisation: challenges in NGOs and development programmes

It is frequently contended that NGOs and the wider context of development are intrinsically different from other organisational settings within which Human Resource Development (HRD) is believed to play an important role. The author outlines the basic concepts underpinning human development within organisations, and organisational development, and sets out the arguments for greater investment in people. While this can raise ethical and practical issues in organisations that depend on external funds rather than generating their own income, the failure to develop the staff on whom a development organisation ultimately depends carries far greater risks. Management and specifically HRD are not desk-bound activities that can be pursued through the application of protocols and sanctions, but require vision, leadership, and hands-on engagement.     

略论《南海各方行为宣言》的困境与应对

中国对南中国海四大群岛之主权,实有充分理据。《南海各方行为宣言》是历史上第一个关于南海问题的多边政治文件,在各国围绕南中国海问题之解决所进行的努力中具有里程碑式的意义。但不容乐观的是该宣言亦存许多不足之处,其实施已面临困境。中国应坚持以维护中国对该地区固有主权为基本原则,高度重视南海问题与台湾问题的相关性,在注意探讨与区内个别国家率先达成实质性双边谅解的可能的基础上,积极倡导并努力实现有关各方共同签署更具法律拘束力的南海问题多边条约。     

韩国银行业市场竞争度的实证分析

韩国金融开放的初始条件与我国有一定的相似性。通过对1996—2005年韩国的银行业市场竞争程度进行度量,我们发现:1.东南亚金融危机对韩国的银行业市场造成了巨大的冲击;2.危机后经过重建的韩国银行业竞争程度明显下降,趋于垄断。韩国已经经历了金融自由化和国际化的阶段,其经验和教训值得正在开放的中国银行业认真借鉴。
