罪犯的婚姻权一直是法律从未明文剥夺的权利，但在行刑过程中，罪犯又长期享受不到这项权利。2004年5月，民政部在相关《意见》中确认了罪犯的婚姻权。对此，监狱工作者应当慎重对待、正确把握《意见》要求与罪犯婚姻权的实际，切实保障罪犯应当享有的婚姻权。

清末“礼法之争”是中国与世界法制接轨的发端。礼教派提出的变法应立足本国国情，因俗治宜，保持各自的特色，有其合理性和一定的科学性，是符合我国现阶段的立法精神的。而法理派的主张由缺少中国特色。以史为鉴，我们要在拿来和守望中学会有所选择，有所摒弃，这也是今天法治建设的题中之义。     

Escalation and Mindfulness

Escalation of conflict, the use of progressively more contentious tactics, is not always intended. It may occur when parties become preoccupied with ideas or feelings that impair their ability to comprehend the situation and focus on the conflict issues. Action springing from such preoccupation can initiate a set of feedback loops that are self-amplifying. In this article, I suggest that by raising their present moment awareness through formal meditation and informal day-to-day mindfulness practice, parties may reduce preoccupation and thereby amplification. Drawing on Friedrich Glasl's stages of escalation and Magorah Maruyama's work on change-amplifying feedback loops, this article examines how mindfulness might contribute to a greater awareness of psychological and systemic factors that predispose disputants to escalation of their conflict.     

论当代物权冲突法之趋同化走势

当代物权冲突法在不动产物权、物为动产或不动产的识别、交通运输工具、物权变动、运输中物品的物权、因时效届满而取得物权、有价证券等物权法律适用方面均呈现出趋同化走势,当代物权冲突法的趋同化走势有着深刻的政治、经济及法律等各种原因,中国涉外物权法律适用规则应适应当代物权冲突法的趋同化走势,与国际社会的立法实践保持一致。     

The politics of ethnicity and post-conflict reconstruction: The case of Northern Ghana

Taking into account the complexity of contemporary ethnic conflicts, this article examines the construction and politicisation of ethnicity to understand a recent case of post-conflict reconstruction. More specifically, the article considers theories of post-conflict reconstruction, particularly the conflict transformation school that claims to respond to the hybrid nature of recent ethnic conflicts. By adopting a constructivist perspective, this article argues that post-conflict reconstruction in ethnically-fragmented areas is largely about the problem of de-politicising essentialist discourses of historically constructed ethnic identities. In order to explore this key theoretical issue, the article analyses the 1994-95 case of conflict and reconstruction in the Northern Region of Ghana. This analysis draws on archival research and 21 interviews with individuals representing nongovernmental organisations (NGOs), traditional authorities, religious leaders, opinion leaders, and the state conducted from August to October 2006 in Accra, the capital of Ghana, as well as Tamale, the capital of the Northern Region. Because very little research is available on post-conflict reconstruction in Northern Ghana, this analysis fills a major gap in the contemporary literature on ethnic conflict and post-conflict reconstruction in West Africa. At a broader level, the article suggests that contemporary theories of post-conflict reconstruction would gain from taking a more systematic look at the social and political construction of such identities.

本文从公司角度阐述了表见代表制度的成因及其意义 ,分析了该制度的适用范围 ,并运用经济分析的方法 ,重点分析了公司章程公示力的规定同公司董事表见代表制度之间的冲突问题 ,认为后者应优于前者适用 ,同时认为公司章程不应就公司的经营范围作出规定。最后 ,分析指明了公司董事表见代表的构成要件。     

The Role of Play and Humor in Creative Conflict Management

In this article, I draw on the theories of three scholars whose works have not typically been part of the negotiation and conflict resolution canon (Arthur Koestler, Edward T. Hall, and Gregory Bateson) to develop the beginnings of a new model for creative and constructive conflict transformation that features playfulness and humor as its key components. I explore the connections between Koestler's theory of bisociation in the act of creation, Hall's ideas about the cultural construction of emotional responses, and Bateson's theories about the role of play and humor in human communication. All three authors focused particularly on body language and on the cognitive impact of emotions. Drawing on their theories and the connections between them, I suggest the theoretical underpinnings of a model for approaching conflict in which displacements and surprises, playfulness, humor, and "punch lines" can serve to reframe issues and open up new avenues for consensus building and resolution.
