试论行政法律原则在检验检疫行政处罚中的适用

法律原则是法的精髓,它以其特有的恒久性、抽象性和普遍适用性等特点对成文法的滞后性等弊端予以弥补与调整。但其在检验检疫行政处罚等具体执法工作中的适用只能在成文法规则缺失、法条含义模糊、适用法律规则显失公正、法律规则冲突无明确解决方法等时机出现时才能充当其替补角色,而且具体运用时还应遵循相关的限制条件。     

证券即时行情信息权属之探析

我国现有理论多以含义不清的“新型知识产权”指代证券即时行情信息权利,并试图从“数据库”或“知识产权”等角度对证券即时行情信息的权属进行论证。但现有的研究成果并未触及证券即时行情信息的权利本源,因此无法就商业实践中已经发生的信息权属争议起到“定分止争”的作用。应根据基本信息与衍生信息的不同类别而分别以“公共产品”和“准公共产品”的方式确定证券即时行情信息的权属并划分权利界限。     

Delimitation of the time of death by immunohistochemical detection of thyroglobulin

To improve the possibilities to delimit the time of death after longer laytime it was examined if this is possible by immunohistochemical detection of thyroglobulin. The results show that in our examination material the colloid and the follicular cells of the thyroid glands of up to 5-day-old corpses produce a positive immunoreaction towards thyroglobulin in all cases whereas none of the corpses older than 13 days show such a reaction. This means that in case of a negative immunoreaction the time of death can be assumed to lie more than 6 days before the autopsy. The fact that a negative immunoreaction occurrs consistently after 13 days leads to the conclusion that when thyroglobulin has been stained in a specimen, the death of the respective person must lie a maximum of 12 days earlier, whereby these time-limits may change in considerably different surrounding conditions.     

Transcellular and extracellular impedances of the intact abdomen in putrefying rat cadavers

Total (Zt) and extracellular (Ze) abdominal impedances of putrefying rat cadavers, stored at 18.0±0.7°C, were measured at 50 kHz and at 1 kHz, respectively, during the first 7 days of death. Transcellular impedance was calculated from the measured values of Zt and Ze. Total impedance and Ze increased during the first day, and then decreased with increasing postmortem interval, while Zi remained unchanged during the first 3 days before increasing more than 4-fold between 3 and 7 days postmortem. These changes are consistent with net gain of electrolyte by the extracellular fluids and with degeneration of cell membranes which occur postmortem. It is concluded that, during putrefaction, Ze is a potentially more useful index of postmortem interval than Zt or Zi, and that measurement of total abdominal impedance at 50 kHz, rather than at 10 kHz, markedly improves the precision and accuracy of impedance measurement.     

尸体肝细胞AgNOR不同时间形态改变与死亡时间的关系

采用显微图像分析方法，在动物实验的基础上，观察和分析人体死后不同时间肝细胞Ag－NOR的形态变化，探讨它与死亡时间两者间的关系。经图像分析灰度值测量，结果表明：AgNOR的死后变化与死亡时间有密切的关系，随着死后经过时间的延长，AgNOR颗粒形态越来越不清楚。灰度变化的量化指标提示，图像分析AgNOR的灰度改变，与形态改变一致，可以作为推断死亡时间的一个有参考价值的指标。     

基于拉曼光谱的血液遗留时间研究与模型预测

目的针对犯罪现场血液遗留时间的判断问题,实验以不同遗留时间的血液为研究对象,建立基于拉曼光谱的血液遗留时间的辨别方法。方法采集遗留时间为0.5h~240h的指尖血液样本,获取其拉曼光谱数据,经校正和平滑处理后,对数据进行归一化。利用RSD值评价光谱的稳定性,选取前10个主成分和6个重要波段分别建立模型,利用预测集测试模型效果。结果相同遗留时间血液的拉曼光谱具有较好的稳定(RSD<0.2),不同遗留时间血液的拉曼光谱在680cm^-1等6个波段有明显的强度变化。前10个主成分建立的PLSR模型,其r²=0.9927。6个重要波段建立的PLSR模型,预测集效果r²=0.8797。结论利用拉曼光谱结合建模分析是一种无损快速的评估血液遗留时间的方法。

‘Papa don't preach’: Fatherhood in a South African Christian men's magazine

Abstract

The first international men's lifestyle magazine to enter South Africa was Men's Health in 1997, followed by FHM and GQ. Not unlike their international counterparts, these magazines have been extolled in the publishing sector for their commercial success and disparaged in academia for their potentially negative influence on the sensitive gender politics of the new South Africa. In 2001, a new breed of men's lifestyle magazine emerged in South Africa: one that catered to a particular cultural or racial niche market that presumably was not satisfied by the generalising tone of the mainstream men's lifestyle magazines. The Afrikaans Christian magazine MaksiMan is the subject of this analysis, as much for what it signifies in terms of the presence of vernacular masculinities in post-apartheid South Africa as for the texture that it brings to the genre of men's lifestyle magazines. Mainstream men's magazines typically refuse to include reference to the role of father that certain of their readers might occupy. MaksiMan breaks this trend through articles and features centred on fatherhood. This article comprises an analysis of the representation of fatherhood within this niche men's lifestyle magazine.
