夯实新世纪中国共产党执政的合法性基础——“三个代表”重要思想的一种解读

中国共产党在50余年的执政历史中,孜孜探寻、拓展和提升自己执政的合法性资源,化解执政风险,避免执政危机,根据社会生态环境的变化,不断探寻执政的合法性资源。2000年2月,江泽民同志提出的“三个代表”重要思想,标志着我们党在更大的空间上和更深的层次上探寻到了执政的合法性资源,这对于夯实新世纪党执政的合法性基础具有十分重大的意义。     

创新:21世纪初期的中国军事法学

中国军事法学在进入２１世纪时, 已经构建了学科体系, 初步确立了中国军事法的体系框架, 对军事法制建设和依法治军的研究取得了丰硕的成果, 但军事理论法学还没有真正建立起来,研究的范围也还局限在传统的领域。２１ 世纪初期 （２０２０ 年前）, 我国经济体制的转变和世界性的新军事革命, 将使军队 “三化”建设进入更高的层次, 准备应对高技术局部战争将更加紧迫。这些都要求军事法学为其提供及时、有效的服务。因此, 中国军事法学在２１ 世纪初期的创新, 应着力于建设军事理论法学、深化依法治军研究和高技术局部战争法律问题的研究, 拿出切实管用的成果。在全局上, 要继续以邓小平新时期军事法制建设理论为指导; 在具体工作中, 坚持有限目标和局部优势、学科平衡和重点发展、开放性研究等原则, 并采取一系列相应的措施。     

论21世纪的国际新秩序的构建

建立国际新秩序是一个具有重大战略意义的大问题,解决这一问题的基本点有三,一是构建国际新秩序是一场尖锐而又复杂的斗争,二是构建国际新秩序是一个渐进的过程,三是中国在建立国际新秩序中应该有所作为.     

The Development of EU-Russian Relations

The EU＇s strategy for Russia since the end of the cold war has to a large extent failed, and the direct consequences are the currently deadlocked EU-Russia relationship. There are three reasons for this： the EU and Russia＇s respective strength and status relative to each other have been changing since the beginning of this century; the EU＇s strategy towards Russia has been more fragmenting in recently years; and the American factor. The EU-Russia relations could continue to be in poor shape in the years to come, and it is very likely sometimes even further worsening. But the two sides would refrain from extreme measures and prevent their relations from sliding into real cold war.     

清末民初浙江监狱改良与日本

本文为中国近代转型时期以日本为媒介移植西方法律制度的个案事例研究。着重关注的是清末官绅对日考察,不同于已有较多成果的清末留日研究。据《申报》记载,包括浙江在内的十省于1906年联合派遣正佐官员五十名赴日考察监狱。该史料已为相关研究者所关注,但这些调查日本监狱员在日考察的实际状况和回国后的活动至今不为人知。在梳理浙江省派员名单,挖掘其在日活动史料基础上,进一步追踪其中三人回国后在浙江省监狱改良中作出的贡献。     

The Variation and Mutual Infiltration of Literary Field in the New Century

After entering into the new century, Chinese contemporary literature is subjected to the double pressure of the electronic media and the market economy. the independent “Elite literature” field which is dominated by the literature publishing is experiencing the variation under the influence of many factors such as politics, economy, science and technology, thought and mentality. the variation includes four secondary literature field, they are elite literature, youth literature, network literature and popular literature respectively. The field of Chinese literature is composed by the four secondary literature field since the new century, they coexist and compete mutually.This competitive situation is unavoidable for the time being, that is to say, the mutual relationship among elite literature, youth literature, network literature and popular literary is both competitive and cooperative, the image of the competition and connection with each other is the current situation of contemporary Chinese literature.     

Intergenerational offending in Liverpool and the north-west of England, 1850–1914

Using contemporary sources from the north-west of England in the Victorian period, the authors examine the putative connections made by contemporaries which linked together ‘bad’ parenting and the transmission of criminal traits. Poor parenting practices were a prevalent explanation for juvenile (leading onto sustained) delinquency, especially in the mid to late nineteenth century. Popular narratives by Charles Dickens and media opinion-formers were very influential in depicting neglectful mothers who did not socialise their children into law-abiding, useful members of society, and criminal fathers who inducted their children into their own criminal affairs and organisations. This article examines the reality of intergenerational offending (using prison- and court-generated data) to show that there is very little convincing research that proves direct intergenerational transmission of offending practices (i.e. parent-to-child-offending transmission). The authors then examine other possible routes of intergenerational offending using case studies and archival research, and the article concludes that environmental/socio-economic conditions and wider familial/neighbourhood relationships were, in fact, the main trigger for onset of offending, and the maintenance of criminal careers, rather than direct familial transmission. The article is therefore an important marker in understanding the processes which inhibit/generate criminality in a significant number of juvenile offenders in this period.
