劳动争议诉讼三题

受我国传统诉讼文化的影响,我国劳动争议适用法律及法律程序设计等方面,都没有能够充分体现出程序正义和程序效益,法律对弱者所给予的救助和支持存在不同程度的弱化。建立社会主义市场经济体制和加入WTO,呼唤尽快完善我国的劳动法制,劳动争议诉讼制度必须从诉讼时效、诉讼证据和诉讼程序方面进行探讨和改革,以更好地维护劳动者的合法权益。     

同一认定理论及其逻辑分析

长期以来,我国司法鉴定理论和实务界对同一认定的新技术方法进行了广泛的研究,但对同一认定理论缺乏足够的关注。应该说,我国的同一认定理论还不够完善,甚至因此影响到鉴定结论的正确性。因此,有必要对同一认定的基本理论问题,特别是同一认定的基础和条件、范围和对象、过程和标准以及同一认定结论的科学性、证据价值等进行深入的论证和分析。     

Reform process in Bulgaria： Challenges and perspectives after joining EU

The paper＇s objective is to analyze and outline the key challenges and perspectives in achieving a modern type of governance and a well functioning and transparent administrative system, capable to apply the best European practices and policies. The study summarizes the main results, achievements and shortcomings of the reform process and reveals that the progress has been slower and more limited than expected despite all efforts of the government. The conclusion made is that Bulgaria needs to not only substantially enhance its administrative and judicial capacity, but also drastically intensify its reforms to improve the management of EU funds and achieve concrete results in the fight against corruption. All this requires strong political will and determination.     

论私人在行政许可法律关系中的地位及权利保障

受到行政许可行为影响的私人主要包括两类 :行政许可相对人与行政许可相关人。行政许可相对人与相关人都是行政许可法律关系的参与主体 ,都既享有权利又承担义务。行政许可相对人享有的权利主要有 :申请权、知情权、无瑕疵许可裁量请求权、程序抗辩权、受平等对待的权利、许可信赖权、申请救济权等 ;行政许可相关人享有的权利主要有 :程序抗辩权、排除违法行政请求权、行政介入请求权、申请救济权等。对行政许可相对人与相关人享有权利的保障是行政许可法律制度的重要内容。     

利益诉求的表达与消解 ：一项关于“外卖小哥”劳动过程的调查研究

从事送餐服务业的“外卖小哥”已成为当前城市劳动者中不容忽视的重要社会群体,基于一项对“外 卖小哥”的调查研究,探讨了其劳动过程状况及利益诉求表达行为的特征。研究表明：“外卖小哥”的劳动强 度较大且劳动保障并不完善,在绩效工资制度下,他们会“自愿”增加劳动强度以实现更多的劳动获得;在与 雇主或顾客发生冲突时,他们更多是选择“隐忍”方式以消解冲突;劳动保障、劳动强度、劳动报酬及劳动认 知等劳动过程因素都会对其利益诉求表达产生影响,生活稳定、劳动报酬及劳动保障较好、劳动认知积极的“外 卖小哥”会弱化或消解利益诉求的表达。在互联网经济下,“外卖小哥”在雇主与顾客之间,已由“服务 - 消费” 链条紧密的捆绑在一起,他们的劳动过程状况与其劳动心态及行为特征紧密关联在一起。因此,不仅需要重视“外 卖小哥”的劳动权益保障,更需要关注其劳动过程中的劳动心态。     

An Examination of the Effects of Different Victimization Types on Psychological and Behavioral Health Outcomes and the Mediating Role of Stress

Although a considerable amount of research has highlighted the link between interpersonal victimization and adverse psychological and behavioral health, a paucity of research has examined and compared the effects of multiple forms of victimization in the same study. There is also a limited understanding of the underlying individual factors (e.g., emotional processes) that might link experiences of victimization to psychological and behavioral health adversities. To address these gaps, the author used a nationally representative sample of 19,422 Canadians aged 15 years old or older to examine the effects of different types of victimization on psychological and behavioral health outcomes, and to determine whether these associations are mediated by perceived stress. Results revealed that some victimization types (i.e., personal, household/property, cyberbully, ex-partner physical/sexual and emotional abuse) had statistically significant adverse effects on psychological and behavioral health outcomes (i.e., self-report mental health, life satisfaction, satisfaction with safety from crime, and alcohol/drug abuse). Results also revealed that perceived stress mediated the association between some victimization types and psychological, but not behavioral, health outcomes. Discussion points toward the utility of examining multiple victimization types, as well as other converging individual factors or adversities, in explaining psychological and behavioral health outcomes.     

Factors Explaining Public Participation in the Central Government Budget Process

This paper attempts to examine which factors explain public participation in the budget process in an international comparative approach. In particular, we investigate which socioeconomic, institutional, and political factors promote public engagement in the central government budget process. Using a sample of 93 countries, our results indicate that Internet penetration, population diversity, governmental financial situation, and budget transparency determine opportunities for public engagement in the central government budget process. In addition, we show that not only budget transparency promotes public participation but also public participation is necessary to enhance budget transparency.     

The Effect of Political Science Education on Political Trust and Interest: Results from a 5-year Panel Study

Citizenship education has evolved substantially in recent decades, with a rapid proliferation of education forms and approaches. The currently available evaluation studies, however, do not allow us to determine what kind of approach can be considered as a best practice for schools and education systems. In this article, we rely on the results of a 5-year panel study to investigate the long-term effects of various forms of citizenship education. Using the Belgian Political Panel Survey (n = 3,025), a three-wave longitudinal panel survey of 16-, 18- and 21-year-old Belgian late adolescents and young adults, we determine which citizenship education effort (i.e., classroom instruction, being a member of a school council, and an open-classroom climate) has a long-term effect on political trust and political interest. The results suggest that classroom instruction, the presence of an open-classroom climate, and being a member of a school board are positively related to political trust. We also find that classroom instruction and being a member of a school board are significantly associated with higher levels of political interest. We close with some observations on what these findings imply for citizenship education policies.
