缺乏对抗的“被告人说话式”审判——对我国“控辩式”刑事审判的实证考察

我国立法机关于1996年在吸收了对抗式刑事审判合理因素的基础上,创设了"控辩式审判"方式,以解决庭审走过场的弊端和实现控辩审职能的分化。从司法实践来看,改革者的目标并没有得到实现。我国的刑事审判在实际运作上是一种缺乏对抗的"被告人说话式"审判,具体表现在:庭审上趋于消极但不中立的法官,公诉人对审判的单方面主导,被告人是法庭上的"主角","说话权"受限的量刑辩护人,法庭调查的书面化等。由此导致我国刑事审判制度的双高现象:高效率和高定罪率。     

行政责任过程说——一种对行政责任性质的新认识

行政责任是行政法学研究的重要内容,国家赔偿仅仅是行政责任的一种表现形式,而不是行政责任的全部。从系统功能的角度来看,行政责任不是"义务"、"结果"或是"制裁",而是伴随行政行为的发展不断变幻形式、逐步明确的过程。并且不同的责任形式并非是线性发展的,而是前后关联,内外互动。从总体上说,行政责任本身也不是行政过程的终结,而是循环重复发生的行政过程中的一个中继环节。     

Asymmetric cointegration relationship among Asian exchange rates

This study investigates the asymmetric cointegration relationship among the Japanese yen, the Korean won, and the Singapore dollar using an instrumental variable threshold cointegration test which allows asymmetric adjustment and avoids test statistics depending on nuisance parameters. This threshold cointegration approach clearly provides evidence for a cointegration relationship characterized by asymmetric adjustment toward the long-term equilibrium level. This finding indicates that the long-term equilibrium relationship among the Japanese yen, the Korean won and the Singapore dollar remains stable with asymmetric adjustment. The finding also shows there is a temporal delay in the reaction of the Korean won and the Singapore dollar to the Japanese yen change. Therefore, we conclude that, in the short-term, Korean won and Singapore dollar shocks are important to determine the response of the Japanese yen; the Singapore dollar shock is also important to determine the response of the Korean won; however, the Japanese yen shock is unimportant to determine the responses of the Singapore dollar and Korean won.

Analyzing Territorial and Sectorial Dimensions of Public–Private Partnerships in Science,Technology, and Innovation policies

The performance of innovation systems depends, to a great extent, on the degree of public–private collaboration they involve. Thus, innovation policies often aim to enhance this collaboration through public–private partnerships. These partnerships are a multidimensional phenomenon whose success depends on factors related to each of their dimensions. This paper proposes the use of an analytical model that reflects the multidimensional nature of public–private partnerships and analyses to what extent they are applied in a specific innovation system in order to identify the territorial and sectorial factors that act as barriers or drivers to use them. This model aims to help policy makers design appropriate public–private partnerships in each context. The case under review is the Spanish innovation system, given that this system has been suffering from a structural lack of collaboration for several decades, despite the implementation of policies aimed to foster this. Thus, if the model works, it should be able to identify key factors that influence greater or more restricted use of the different PPP formulas.     

行政过程信息的可公开性问题研究

针对行政过程信息是否公开这一立法和实践均未有定论的问题,以最高人民法院发布的《关于审理政府信息公开行政案件若干问题的规定(征求意见稿)》关于免于公开范围为讨论出发点,从政府信息概念出发对行政过程信息的公开性以及公开与否的判断标准进行讨论,以期对行政过程信息的公开问题有更深的认识.     

DNA in the Criminal Justice System: The DNA Success Story in Perspective,

Current figures on the efficiency of DNA as an investigative tool in criminal investigations only tell part of the story. To get the DNA success story in the right perspective, we examined all forensic reports from serious (N = 116) and high‐volume crime cases (N = 2791) over the year 2011 from one police region in the Netherlands. These data show that 38% of analyzed serious crime traces (N = 384) and 17% of analyzed high‐volume crime traces (N = 386) did not result in a DNA profile. Turnaround times (from crime scene to DNA report) were 66 days for traces from serious crimes and 44 days for traces from high‐volume crimes. Suspects were truly identified through a match with the Offender DNA database of the Netherlands in 3% of the serious crime cases and in 1% of the high‐volume crime cases. These data are important for both the forensic laboratory and the professionals in the criminal justice system to further optimize forensic DNA testing as an investigative tool.     

正交试验法优选血康胶囊提取工艺

目的：研究血康胶囊提取工艺。方法：采用正交试验法进行优选，以TLCS法测定人参皂苷Rg1的含量。结果：提取交数、乙醇浓度对人参皂苷Rg1提取率及干膏率有显性影响。结论：最佳提取工艺为500ml／L乙醇回汉提取2次，溶剂用量依次为6，5倍，提取时间为1．5，1．5h。     

一次手印鉴定引发的思考

近期,我们受理了一起特殊的手印鉴定。此前该手印已有肯定与否定两种截然相反的鉴定结论,鉴定委托人又不能提供检材和样本原件,只将相关的照片送检。在检验过程中,我们经过观察分析、实验验证、计算机图像处理等过程,弄清了手印的本质,做出了科学、客观的结论。
