高校自制规章存在的问题及对策研究

随着我国依法治校工作的不断深入,高校越来越重视自制规章在依法治校中的重要作用,但是在高校自制规章建设中仍存在一些问题,使师生员工的权益不同程度受到侵害.我国高校自制规章存在的问题主要表现在制定和执行两个方面,因此,现阶段我国加强高校自制规章建设的重点是对高校自制规章制定和实施中存在的问题加以研究,剖析其产生的原因,并提出加强和完善高校自制规章建设的对策.     

我国第三方物流企业服务质量问题研究

第三方物流企业提供的是服务，服务质量是企业竞争的关键。目前我国第三方物流企业服务质量存在一些问题，主要有：物流企业的技术装备水平落后，信息化程度较低，服务效率不高；服务功能单一，服务质量较差；缺乏高素质的物流服务人才和先进的服务理念。深入分析我国物流服务质量存在的问题，以便完善第三方物流企业服务质量，构建完整的配套物流服务体系，这对我国第三方物流企业今后的发展具有重要的现实意义。     

公安院校大学生专业承诺现状调查研究

从某公安部属院校随机抽取了206名大学生进行调查,目的在于了解公安院校大学生的专业承诺状况。结果表明,公安院校大学生的专业承诺处于中等偏上的水平;不同性别学生专业承诺的差异不显著;不同籍贯学生专业承诺的差异不显著;刑侦类专业的学生在继续承诺上得分显著高于刑技类专业的学生;学业自我评价良好的学生在专业承诺及其所有附属维度上得分显著高于学业自我评价较差的学生;理想型入学动机的学生在情感承诺上得分显著高于就业型入学动机的学生。     

The nature of economic perceptions in mass publics

Voters who believe that the nation's economy has been worsening are more inclined to vote against the incumbent president than are those who believe it has not been getting worse. This relationship could be present because voters condition their support for the incumbents upon their perceptions of the economy, or, alternatively, because they condition their perceptions of the economy upon their underlying, partisan-based support of the incumbents.     

The Relationship between Human Needs and Criminogenic Needs

Abstract

Precipitators are personal attributes enhancing a person's likelihood of becoming criminally victimized. The present experiment focuses on walking style synchrony as a nonverbal determinant of differential perceptions. Findings suggest that walking styles associated with a lack of interactional synchrony - a lack of organized movement, a lack of ‘wholeness’, a lack of flowing motion - result in higher ratings of robbery potential and in lower ratings of perceived self-confidence of a target relative to more synchronous walking styles. Analyses also suggest that high criminal involvement is associated with more easily construing situations as ‘opportunistic’. Some implications for assertiveness and self-defense training programs are discussed.     

刑事案件精神病鉴定实施情况调研报告

本文以法律职业群体和司法精神病学鉴定专家为调研对象,就刑事程序中的精神病鉴定及相关问题进行了调研,通过运用访谈、问卷、阅卷、调取司法统计数据等实证研究方法对目前我国刑事程序中精神病鉴定的现状、问题及成因展开了研究。研究的主要问题包括司法精神病鉴定主体与鉴定管理体制,鉴定程序的启动,公安司法人员对鉴定意见的审查、判断,对精神病人的强制医疗等问题。     

论司法承诺规则在侦查讯问中的应用

司法承诺规则在侦查讯问中发挥着重要作用。侦查讯问有很强的对抗特征,较量的双方必然要采取一定的手段,这种思维的对抗具有博弈性。司法承诺规则能够保证犯罪嫌疑人得到某种利益,使犯罪嫌疑人自愿同司法机关协作,从而有效地降低侦查成本,提高侦查效率。文章在对司法承诺规则作详细介绍的基础上,从实体法和程序法两方面对其进行了构建,以实现侦查讯问中司法承诺的法治化,从而更好地指导实践工作。     

农村土地权属管理中存在的问题及解决对策

农村土地权属管理是明确农村土地所有权、使用权归属,化解农村土地权属争议的一项重要管理工作。目前,我国农村土地权属管理中还存在着土地权属争议复杂、处理难度大,立法模糊、适用法律不统一,以及基层土地权属管理制度不够完善等一系列问题。为此,必须进一步完善土地立法,明确土地确权原则,加强依法行政,加大对土地权属争议的调处力度,重视有关土地政策法律的宣传工作,同时注重借鉴其他国家和地区的土地管理经验,从而扎实推进农村土地权属管理工作的有效开展。     

The Role of the Scholar-Practitioner in International Conflict Resolution

Can unofficial, academically based, third-party approaches contribute to the prevention and resolution of international and intercommunal conflicts? The article focuses on one such approach, interactive problem solving, which the author has applied primarily in the Israeli-Palestinian conflict. After describing the central tool of the approach, the problem-solving workshop, the article goes on to address the role of interactive problem solving and related approaches to the larger process of conflict resolution. In this context, it discusses the relationship of the microprocess of problem-solving workshops to the macroprocess of international conflict resolution; the relationship between official and unofficial diplomacy; the relationship between practice and scholarship in conflict resolution; the role of the university in the process; and the possibilities for institutionalizing this model of conflict resolution.     

论刑事情报资料的管理及完善

本文简要地论述了两百年来刑事情报资料的发展情况,其中重点论述了美、英、日、德等国的发展水平。进而论述了刑事情报资料在现代侦查中的四大作用：（１）传统作用;（２）使各领域侦查方式全面改观;（３）对付当前各种犯罪的作用;（４）促进侦查民主、科学和公正化的发展。最后,谈及当前我国刑事情报资料管理的问题：（１）自动化程度不高;（２）种类不全;（３）管理分散落后效用低下;（４）有关法律有待完善;并根据这些问题提出了相应的四条完善建议：（１）全面实现刑事情报资料管理计算机网络化;（２）统一标准扩大刑事情报资料收集存储种类;（３）建立健全与刑事情报资料相关的法律;（４）提高刑事情报资料管理和使用人员的素质。
