论实事求是方法和群众路线方法的内在一致性——基于马克思主义哲学实践视野的解读

从马克思主义哲学的实践思维方式和实践逻辑上来解读实事求是方法和群众路线的方法,二者具有内在的一致性,皆是中国共产党领导中国人民进行革命、建设和改革社会实践活动中不可或缺的科学方法论。     

非法行医罪与医疗事故罪辨析及立法思考

非法行医罪和医疗事故罪在主体、客体、主观方面,客观方面各犯罪构成要件上都有区别,罪数形态上亦有区分执业医师擅自脱离执业地点和不按执业类别、执业范围执业的行为应以非法行医论处,有证医疗机构的无证“医务人员”从事诊疗、护理等活动造成损害的应以非法行医论,无证人员无偿提供医疗服务的仍属非法行医行为,刑法立法上应当对此作出相应规定以资完善.     

Securitization,history, and identity: some conceptual clarifications and examples from politics of Finnish war history

This article shows how we can use the securitization framework to study extreme history politics. Securitization refers to a speech act or discursive process in which an actor makes a claim that some referent object, deemed worthy of survival, is existentially threatened. If successful, securitization justifies the use of extraordinary measures to counter the threat. After introducing the concept of securitization in detail, the article presents three ways in which history and securitization can be connected: history can serve as a facilitating condition of securitization; history can be explicitly used to strengthen a securitizing move; or history, or a particular interpretation of it, can be the referent object of securitization. The second half of the article is devoted to a discussion on the role of history in the securitization of national identities. Historical myths are the standard building blocks of national identities; challenging these myths can be presented as threats to the survival of the nation. The article also discusses potential forms of resistance against securitization of history/national identities. Illustrative examples from the political use of WWII history in Finland will be used to show the practical consequences of various conceptual choices.

Cloud point extraction coupled with back extraction: a green methodology in analytical chemistry

Recently, cloud point extraction (CPE) coupled with back extraction (BE) has been suggested as a promising alternative to liquid-liquid extraction. In CPE, non-ionic surfactants in aqueous solutions form micelles and the solution becomes turbid when heated to the cloud point temperature. Microwave- or ultrasonic-assisted BE can be performed after CPE and before injection of the sample for instrumental analysis by ultraviolet-visible spectroscopy, high-performance liquid chromatography, gas chromatography, gas chromatography-mass spectrometry, or liquid chromatography-mass spectrometry. This article reviews selected published scientific research on the application of CPE-BE to the determination of alkaloids, drugs and organophosphorus compounds from several complex matrices. This method could be scaled-up for use in forensic science.     

我国矫正教育制度的反思与重构

矫正教育是监狱权的行使方式之一,是利用道德的“软力量”对罪犯进行教化,从而达到罪犯再社会化的目的。深化的复归理论、教育刑理论、刑罚人道化思想从不同的角度和侧面共同作用、合力支持着矫正教育的理论。我国的矫正教育制度基本上符合矫正教育的理念和世界各国普遍的作法,但由于受立法时各种条件的局限,在立法理念、立法技术和制度保障方面还存在着一定的缺陷,对此在以后的矫正教育制度设计中应给予必要的关注。     

论网络“人肉搜索”在侦查工作中的运用

网络人肉搜索是在现代信息科技手段的辅助下,人工参与并提纯信息的一种新兴信息获取方式。实践证明,人肉搜索强大的搜索能力有助于侦查部门查明犯罪嫌疑人身份、锁定犯罪嫌疑人位置、扩大破案线索、查明尸源。人肉搜索在侦查中的运用,是网络时代侦查破案的新途径,是侦查工作群众路线的新形式。在侦查工作中,人肉搜索的运用应当作为一种最后手段,在运用的范围、条件和程序上进行严格控制,在运用方法上要科学合理,兴其利而除其弊,合法地为侦查破案服务。     

问题教学法的实践与思考

运用问题教学法需要技巧并坚持一定的原则,只有这样才能取得良好的教学效果,学生才能从中受益。     

An analysis of budget compliance measurement in South African local government best‐practice financial management technical assistance programs, 2001—2003

South Africa's local government financial management best‐practice technical assistance program (known as MFMTAP) was to reform municipal financial management; achieve credible, realistic budgets and prevent financial failure. We consider whether a budget compliance procedure, developed by National Treasury (NT) to measure funding requirements compliance with the Municipal Finance Management Act (MFMA) focusing on ‘realistic’ revenue budgeting, improves our understanding of technical assistance effectiveness. We assess a metropolitan municipality's compliance before, during and after advisory assistance. The compliance procedure was robust. Potential exists for wider application to assess best‐practice technical assistance (BPTA) program financial reform effectiveness. The findings from this single, important sample suggest that MFMA funding requirements are not being sustained 4 years after MFMTAP commencement, attributable to either BPTA performance or termination effects. We conclude that MFMA financial performance can be assessed by the procedure, from analysis of the metropolitan municipality performance assisted by a BPTA advisor for approximately 3 years. The analysis raises questions about BPTA program reform sustainability, but we add the caveat that conclusions cannot be drawn from a single sample metropolitan municipality, but a larger sample need be used for further methodology development to confirm its efficacy.
