实质的犯罪概念比较研究

在刑法学、犯罪学等刑事法学理论体系中,研究犯罪概念具有十分重要的意义。对犯罪概念可以划分为两种类型:一种是实质的犯罪概念,另一种是规范的犯罪概念。在此基础上,文章对英美法系、大陆法系实质的犯罪概念进行了比较研究,指出从历史发展的角度来看,实质意义上的犯罪概念先于规范的犯罪概念,实质的犯罪概念的界定与统治阶级的犯罪观是密切联系在一起的,即有什么样的犯罪观便有与其相应的实质的犯罪概念。     

建构主义视域中的风险及其动态治理——以面粉增白剂的存废为例

风险是未来损失的可能性,具有社会建构的特征,"面粉增白剂"之争验证了建构主义风险理论。在建构主义视域中,风险治理不仅要使风险最小化,还要实现其他的政治和道德目标,并对影响风险的诸多因素进行反思。风险的动态治理,是实现制度动态效率的必然选择。它的有效性以结果为导向,合理性以未来为导向,进而需要不断学习,吸收新思想新观念,并逐步形成一种新的治理文化。     

Institutional Change Through Policy Learning: The Case of the European Commission and Research Policy

Research initiatives to enhance knowledge‐based societies demand regionally coordinated policy approaches. By analyzing the case of the European Commission, Directorate‐General Research and Innovation, this study focuses on examining the cognitive mechanisms that form the foundation for institutional transformations and result in leadership positions in regional governance. Drawing on policy learning theories, the study emphasizes specific mechanisms of institutional change that are often less noticeable but can gradually lead to mobilizing diverse groups of stakeholders. Through historical and empirical data, this study shows the importance of policy learning through communication processes, Open Method of Coordination initiatives, and issue framing in creating a stronger foundation for policy coordination in European research policy since the 2000s.

“学术失范”是指学术界的某些方面存在着缺乏规范,或有规不依或规范本身不合理,从而贻害学术事业的现象。一定程度上的学术失范引发了部分学术期刊的“失范”。对于高校学报而言,“学术性”“特色性”是其生命力、竞争力所在。     

论公共行政范式的转换与公平效率观的演进

公共行政学自产生以来,经历了传统公共行政范式、新公共行政范式与新公共管理范式相互分立、新公共行政范式与新公共管理范式相互融合三个阶段,呈现出“合——分——合”的态势。而公平效率观也相应地从单纯的效率至上,分裂为新公共行政学派的从公平角度出发寻求公平效率的统一和新公共管理的从效率角度出发寻求公平效率的统一,而最终两种分裂的公平效率观又在新的实践和理论上相互借鉴和整合,走向融合和统一。     

The pedagogy of legal reasoning: democracy,discourse and community

Learning legal reasoning is a central part of any undergraduate law degree and remains a threshold concept: one which is vital for any law student to grasp, but which is often difficult to explain. It is a form of reasoning which is very distinctive to the discipline. This article explores the applicability of learning theories typically used to ground pedagogy in higher education to the specific task of teaching legal reasoning. Constructivist or experiential theories of learning are widely used in higher education, but they need to be used with a clear focus on the specific nature of legal reasoning, which does not fit neatly within the assumptions about learning which underpin many constructivist approaches. Situated learning theories, which place emphasis on the role of the community in constructing knowledge, can also be of value. However, steps need to be taken to avoid replicating the hierarchy of the legal community within educational communities. Overall, the pedagogy of legal reasoning needs to pay attention to the specific nature of legal reasoning, to enable students to access the discourse of the legal community to use as a model, and to take students seriously as members of that community.

宪法适用就是国家机关依照法定职权和程序,应用宪法规范处理具体案件或纠纷的专门活动。中国全国人大及其常委会制定或者修改法律的活动,国务院规定行政措施、制定行政法规,发布决定和命令的活动,都不属于宪法适用。不论从权力来源方面看,还是从人民法院审理案件的实体法依据来看,中国宪法第126条中的“法律”都是包括宪法在内的广义的法律,中国多元多级的立法体制,为人民法院对从属性造法机关所制定的规范性文件进行违宪审查,留下一定的空间。

＂三鹿＂奶粉事件凸显在企业大规模侵权下在破产程序中赋予侵权债权普通债权人的地位具有不合理性。赋予侵权之债债权以普通债权的地位是对私法概念的曲解,违背了民商法公平正义的价值理念,不符合商法追求社会效益的价值诉求。基于此,应当赋予侵权之债在破产分配中以优先地位。
