It is widely accepted that informed consent is a requirement of ethical biomedical research. It is less clear why this is so. As an argumentative strategy the article asks whether it would be legitimate for the state to require people to participate in research. This article argues that the consent requirement cannot be defended by appeal to any simple principle, such as not treating people merely as a means, bodily integrity, and autonomy. ABSTRACTMalaysia’s 14th General Election in 2018 toppled the Barisan Nasional government after six decades in power. Barisan Nasional’s longevity was due to its performance legitimacy and a capacity to manipulate electoral mechanisms. However, it was the use of money in eliciting consent that led to a political change. This article traces how sustaining the dominance of the Barisan Nasional under Najib Razak used a strategy which we term the monetisation of consent. However, when monetising consent loses its efficacy, political dominance is challenged. We discuss why and how manufacturing consent through the use of money has its limits when regime legitimacy is challenged. Intense political competition on the electoral terrain from 2008 and the multiplication of Malay-Muslim political parties induced Najib’s greater personal grip on state funds to gain political support. This resulted in the Najib regime’s kleptocratic turn. Beyond the disbursement of largesse to political power brokers and business elites, his government monetised consent as a populist strategy. The reduced efficacy of electoral manipulation made the monetisation of consent imperative for regime survival but the use of money and unpopular fiscal policies, which deprived citizens of disposable income, led to a legitimacy crisis and the Barisan Nasional’s defeat. 相似文献

In Wye Valley NHS Trust v Mr B the Court of Protection decided that it was not in the best interests of Mr B to receive amputation surgery against his will, notwithstanding that he would die without the treatment. The judge met with Mr B in person and his best interests decision placed significant weight on Mr B's wishes and feelings. This case note considers this influential case in the context of ongoing debate about the place of wishes and feelings in best interests decisions under the Mental Capacity Act 2005. It considers the history of the best interests principle, its interpretation by the Supreme Court in Aintree University Hospitals NHS Foundation Trust v James, ongoing debates about its compatibility with Article 12 of the United Nations Convention on the Rights of Persons with Disabilities, and recent proposals by the Law Commission for statutory amendments to the Mental Capacity Act. 相似文献

Forced marriage in the United States is a hidden issue for a growing number of children and young people. Being trapped in a marriage severely impacts a person's well-being, with long-term psychological and physical ramifications. Forced marriage increases the likelihood of domestic violence and sexual abuse, depriving victims of autonomy. To lessen the number of forced marriages, this Note proposes emulating a United Kingdom statute. The statute provides a comprehensive approach with tailored programs and services to serve the needs of victims of forced marriages. A deregulation of medicines is currently underway in the U.K. and France. Emergency contraception has become available over
the counter in pharmacies in both countries. This might constitute a further step in the liberalisation of contraception,
something which has always received support from women’s organisations and from women themselves. It also forms part of a
current revolution in patient behaviour. This article examines the law governing the deregulation of emergency contraception
in the U.K. and France and assesses how far this might serve to empower women to take control of their own reproductive health
care provision. It considers some of the British feminist critiques of the limit to patient’s autonomy put forward by Sheldon(1998),
Foster (1998), and Murphy (1998).
