大陆、台湾刑法中保安处分制度比较研究

我国 1997年新刑法的颁布 ,标志着我国的刑事实体法又上了一个新的台阶。保安处分制度是现代西方刑法理论和刑法制度的重要组成部分。在刑法修改以前 ,是否应该将该制度引入我国的刑事立法体系 ,引起了我国学者的广泛讨论。本文通过对台湾刑法中的保安处分制度和大陆法律中类似于保安处分制度的保安性措施进行比较分析 ,旨在论证将保安处分制度引入我国大陆刑法的可行性。     

韩国1998-2001行政改革的基本经验

此次韩国行政改革在政府机构、管理制度、行政文化等相关层面施行了平衡到位相互协调的改革举措 ;改革的切入点是以职能转变为中心的政府机构重组、开放型人事制度的推开、高级公务员年薪制的试行、责任运营制度的建立、绩效管理制度的试验 ,顾客宪章制度的引进 ,以及部分公共管理事务外部委托制的探索 ;其基本经验是 ,机构改革的效度有赖于行政系统内相关要素的全面优化 ,行政改革的效度则有赖于整体改革环境的优化 ,民间专家参与是促进政府改革的重要资源 ,政府间行政架构模式决定了地方机构改革的成效。     

大学图书馆电子化及其在互动教学中的作用

本文从当前高校传统图书馆建设的弊端分析入手,从高校网络建设的利弊分析和扬长避短、趋利避害着眼,论述了如何经济可行地在信息化社会将高校图书馆与高校网络建设有机地结合起来,适应信息社会潮流,开展互动式教学,提高办学层次,在市场经济和教育产业化条件下,创造规模效益式的办学优势。

马克思主义法律思想中国化研究论纲——写在《现代法学》首任主编黎国智教授80寿辰之际

推动马克思主义的中国化,把握社会主义法治理念,弘扬法治精神,应当认真研究马克思主义法律思想的中国化。在国外,马克思主义法律思想研究已经上升到了一个新台阶;在中国,通过多年马克思主义法律思想研究的铺垫,已经具备了更进一步研究的坚实基础。但是,马克思主义法律思想中国化研究必须有独特的思路、完善的内容设计,并应该考虑到新世纪新阶段马克思主义法律思想中国化面临的新机遇和新挑战。     

Managing commercial risks in open source software licensing

Legal context: The article reviews the commercial risk allocation clauses intypical open source licence terms and discusses their enforceabilityand implications. Key points: The enforceability of warranty disclaimers and limitation ofliability clauses in common open source licence terms is questionable,particularly in a cross-border context, and commercial licensorsshould take additional steps to protect themselves from down-streamrisks. Practical significance: Open source software presents a number of unusual commercialissues, because it is available free of charge and the providerstry to disclaim warranties and liabilities. End users and resellershave to adjust their own in- and out-licensing models to accommodatethis situation.     

鸡肾型传染性支气管炎病毒的分离鉴定

从陕西省榆林市某蛋用种鸡场疑似肾型传染性支气管炎病鸡中分离到了1 株肾型IBV(定名为YL 04),并对分离病毒进行了血凝性、血凝抑制性、致病性、鸡胚矮小化、电镜特征等生物学特性鉴定及S1基因5′端的RT PCR鉴定。结果表明,该分离株经10 g/L胰酶处理后的各代病毒尿囊收集液均可凝集鸡红细胞;标准阳性血清可特异性地抑制其凝集性;可复制出与自然发病相同的病例;病毒传代物有明显的致鸡胚矮小化作用;透射电镜下可见有近似球形、直径100 nm左右的冠状病毒粒子;用RT PCR方法扩增到1 条373 bp的目的片段,其核苷酸序列与IBV CQ/01/2004株序列的同源性达98%。     

Bushwhacking the Democratic Peace

The invasion of Iraq has been justified, ex post , as for the purpose of promoting the democratic peace. It does not, however, appear to have been a principal goal ex ante . Most democratic peace theorists, moreover, do not endorse democratic regime change by great-power external military intervention. Success is difficult to achieve (usually at high cost), and the conditions in Iraq were not promising even had the occupation been carried out more competently. Greater success in democratization has been achieved by UN peacekeeping operations, and by various regional international organizations using a variety of peaceful measures to ensure free elections, constrain authoritarian leaders, and empower democratic forces. International organizations, notably those whose membership is largely composed of democracies, are especially likely to succeed in promoting democracy.

Failed States After 9/11: What Did We Know and What Have We Learned?

This paper addresses the relationship between accumulated knowledge and U.S. policy dealing with failed states and terrorism. The central thesis is threefold: (1) that more was known about the possible linkages between failing states and terrorism than appears in pre-9/11 U.S. policies; (2) that since 9/11 some important realignment of knowledge and practice has occurred, but it remains partial and incomplete; and (3) that new knowledge, especially about the policies to sustain and promote legitimate governance, needs to be generated in order to support an effective grand strategy for addressing the threats and challenges of the twenty-first century. The paper recommends such a grand strategy and, in addition to the required new knowledge, a significant reorganization of the U.S. national security policy-making apparatus. International studies curricula appear well suited for contributing to that new knowledge and the practitioners we require.
