浅议记名提单下承运人的交货义务及相关法律问题

记名提单是一种不可流转的海运单证,也就不具备可流转海运提单的物权凭证效力。同时,作为海上运输合同的证明,记名提单对于承运人在目的港的交货对象于运输合同缔结之初就已经确定,因此承运人在记名提单下的交货义务并不以收货人持有正本提单为必要,承运人只要是向记名收货人交付货物就已经构成了运输合同下的适当交付,承运人也不应对此承担无单放货的民事责任。     

原发性蛛网膜下腔出血的讨论——附7例尸检报告

本文报告7例法医病理解剖材料,其中脑血管动静脉畸形引起的5例,动脉瘤与巨细胞性动脉炎引起的各1例。因死亡都是发生在头部外伤之后,故引起申诉。肉眼检查时,7例中有6例未查明病因,诊断系依靠病理组织学检查。本文结合文献复习,重点讨论了检验鉴定的方法和注意事项。文中4个重新鉴定的案例,原结论均未发现本病的病因,甚至有的误认是损伤性蛛网膜下腔出血,此点应引以为戒。     

ABO位点限制性扩增片段长度多态性的研究

建立了PCR扩增、限制性酶切、8％（T）、5％（C）聚丙烯酸胺凝胶垂直电泳和银染检测ABO位点的限制性片段长度多态性的方法体系。应用Amp-RFLP技术对185名中国人（哈尔滨）ABO位点的基因频率和基因型分布进行了调查和统计分析。ABO位点特异片段长度为140～200bp，基因频率为0．2000～0．5568。6种基因型频率为0．973～0．3135，杂合度0．5838，Dp值0．7146。经H－W平衡吻合度检测，完全符合群体遗传多态分布。通过对11个家庭33名相关个体的分析，证明完全符合孟德尔遗传定律。ABO基因型检验适用于法庭科学的个体识别和亲权鉴定。     

ABC法检测血小板颗粒膜蛋白鉴别生前伤与死后伤

甲抗人血小板α-颗粒膜蛋白140（GMP－140）单克隆抗体，ABC免疫组化方法鉴别生前伤与死后伤．生前皮肤切创和刺创标本创缘上见条状褐色反应带，死后皮肤切创标本创线上未见上述反应带。该法可用于检测短时期发生的生前伤与死后伤。     

Government and Democracy in Mexico's Federal District, 1997–2001: Cárdenas, the PRD and the Curate's Egg

This paper analyses the challenges facing the Partido de la Revolución Democrática (PRD) administration when it became the first elected government of the Federal District in 1997. Through a daily review of press coverage between December 1997–December 2000, complemented by intensive interviewing during summer 1999, five areas of policy-making activity are analysed and evaluated. The policies entrained and their outcomes show significant advances in decentralization, devolution, and intergovernmental liaison, as well as modest improvements in environmental contamination and reduced crime, although they did not meet the high expectations generated during the Cárdenas campaign for election. However, the fresh image and invigorated confidence that his replacement Rosario Robles brought to the PRD was key in the PRD's success in the July 2nd 2000 DF elections won by López Obrador. The new administration will have to confront a more plural government structure, including five of the sixteen delegaciones and an evenly divided Legislative Assembly. López Obrador has a full six years in which to prove that a left-of-centre political party is capable of developing a 'Third Way' of governance in the DF.     

论欧盟实施TBT的现状及我国纺织业的对策

近年来，随着关税的降低和非关税壁垒的不断减少，技术贸易壁垒逐渐成为影响我国出口贸易的重要因索。欧盟对进入欧盟各国的纺织品采取了更严的技术要求和标准，这对我国纺织品的出口带来不利影响。作者在文中分析了欧盟实施技术贸易壁垒的现状，以探求我国纺织业的对策。     

传染性腔上囊炎疫苗免疫鸡TLR7基因表达的动态变化

给11日龄雏鸡分别口服接种鸡传染性腔上囊炎(IBD)弱毒疫苗(法贝灵,IBD-Blen)1和3头份后,于不同时间采集脾和腔上囊组织,分离纯化淋巴细胞,常规方法抽提总RNA,以鸡β-actin基因为内参,采用半定量RT-PCR法检测两种组织中鸡Toll样受体7(ChTLR7)基因的表达动态。结果显示,接种IBD弱毒疫苗前,试验鸡脾和腔上囊组织中均有ChTLR7的微量表达,疫苗接种后第7 h,脾中ChTLR7 mRNA的表达开始显著上调,至接种后第12 h达峰值,此后迅速下降,至第130 h时降至疫苗接种前的水平;而腔上囊组织中ChTLR7 mRNA的表达自接种后第12 h开始增加,第24 h时达峰值,随后迅速下降,约72 h后恢复至疫苗接种前水平。表明ChTLR7可能参与了IBDV感染早期的天然免疫反应过程。     

Intangible heritage: traditional medicine and knowledge governance

Legal context: Although traditional medicine constitutes a component part ofthe identity of the cultural communities concerned, this formof intangible cultural heritage is vulnerable in a globalizingworld where little place is left for the protection of beliefsystems. Key points: While much has been written on traditional knowledge and IPrights, less scholarly attention has focused on the culturaldimension of traditional medicine. Further, no solution hasbeen reached on the best way to ensure its protection. Thiscontribution attempts to establish a linkage between differentsectors of international law, addressing the complex interplaybetween traditional medicine, intended as a special form ofintangible cultural heritage, and international knowledge governance. While the TRIPS Agreement adopts only proprietary approachesto knowledge governance, it has been questioned whether, inthe case of pharmaceuticals, other non-proprietary approacheswould be preferable. Different approaches will be put forwardand the Draft Treaty on Medical Research and Development willbe considered. This would provide a better framework for safeguardingand diffusing traditional medicine. Practical significance: Protecting and promoting traditional medicine may help curingdiseases spread all over the world. Thus, beyond its culturalaspects, the practical importance of traditional medicine liesin its capacity to promote the right to health and human dignity.     

做市商制度与我国证券市场的完善

本文从美国纳斯达克市场采用的做市商交易制度着手,对做市商的报价、监管等基本制度进行了分析,进而对我国设立高科技板证券市场引入做市商制度的必要性和对策进行了探讨,并提出了相应的构想。     

浙江畲族人群9个STR基因座的遗传多态性

目的调查浙江畲族人群STR基因座的遗传多态性,为群体遗传学和法医学个人识别、亲子鉴定提供基础数据。方法采用AmpFlSTRProfilerPlus试剂盒(ABI公司),ABI310基因自动分析仪对浙江畲族120名无关个体血样的D3S1358、VWA、FGA、D8S1179、D21S11、D18S51、D5S818、D13S317和D7S820等9个STR基因座进行等位基因频率和基因型频率调查。结果获得浙江畲族人群9个STR基因座的基因频率分布资料,所有基因座基因型频率分布均符合Hardy—Weinberg平衡,计算得杂合度(H)0.655～0.960,个人识别率(DP)0.878～0.960,非父排除率(PE)0.363～0.677,多态信息总量(PIC)0.68～0.86。结论该9个STR基因座在浙江畲族人群中呈高度多态性,在法医学及人类遗传学研究中具有重要意义。
