侵权之诉双重原则的现代发展及其在我国的适用——《中华人民共和国民法（草案）》第九编第八十二条之评析

20 0 2年 1 2月九届全国人大常委会 31次会议讨论的《中华人民共和国民法 (草案 )》第九编是关于“涉外民事关系的法律适用法”。教育部人文社会科学重点研究基地武汉大学国际法研究生所组织了该所的教师和研究生对第九编进行了专门的讨论 ,中国国际私法学会也在 2 0 0 3年 9月召开的年会上把这个问题作为主要的议题 .本专题编发的几篇文章主要就侵权领域和夫妻财产制的法律适用规则进行研究 ,对我国《民法典 (草案 )》中的相关条文的修改提出了具体意见。     

Undemocratic Democracy: Venezuela and the Distorting of History

President Hugo Chávez has been the subject of much frenzied comment, as much at academic conferences as in the press. Criticism has been to a great degree personalised against his very visible public profile. The crisis of democracy in Venezuela has been widely ascribed to faults committed by the traditional parties since the early 1980s and reflected in the coterminous rise in crime and violence. Support for Chávez, or even objective comment, has been at a premium. This article looks at the crisis of democracy across a wider timescale and sees the ‘most stable democracy in Latin America’ to have been deeply flawed from the outset. It reflects an earlier propaganda campaign, similarly short on meaningful analysis, aimed at undermining the popularity of a previous unconventional leader of Venezuela, Marcos Pérez Jiménez. It is claimed that Venezuelans want to preserve democracy but are also ready to support military coups to oust corrupt or inefficient politicians. Is Chávez merely representative of transient anti‐party feeling or could the history of Venezuelan democracy have caused a more fundamental change in relationships between the mass of the people and their leader?

Die Haftung des Veräußerers für öffentliche Äußerungen Dritter – insbesondere durch Werbung – nach § 922 Abs 2 ABGB

Mit der Umsetzung der Verbrauchsgüterkauf-Richtlinie durch das Gew?hrleistungsrechts-?nderungsgesetz wurde im ?sterr Recht das Einstehenmüssen des übergebers nicht nur für eigene ?ffentliche ?u?erungen, sondern auch für jene Dritter ausdrücklich festgeschrieben. Der vorliegende Beitrag untersucht die einschl?gige Regelung des § 922 ABGB sowohl unter dem Gesichtspunkt gemeinschaftsrechtlicher Vorgaben als auch im Lichte des (nationalen) Privatrechtssystems und stellt dabei in Frage, dass ein Einstehenmüssen für ?ffentliche ?u?erungen jedenfalls deren Einbeziehung in die Parteienvereinbarung voraussetzt.     

猪瘟病毒E2重组蛋白纯化和复性条件的研究

对猪瘟病毒(CSFV) C株、LT株E2基因主要抗原区在pGEX系列表达载体中原核表达的融合蛋白进行了变性、复性和纯化回收试验。用建立的变性、复性和纯化方法,获得了可溶性的纯化蛋白E2,其纯度达70%,回收率为10%。对复性纯化的E2蛋白进行了免疫活性检测,结果表明,其比未纯化蛋白的免疫活性高20倍左右。

论服务行政条件下的行政私法行为

行政私法行为是行政机关于服务行政条件下所采取的一种行为方式,它属于国库行政的一种特殊形式。就行政私法行为的性质而言,它既不绝对地是一种公法行为,也不绝对地是一种私法行为,而是新形势下出现的一种兼具公法、私法双重属性的行为。对行政私法行为的法律调整,应该坚持公法优先、兼顾私法的准则。     

口蹄疫病毒3B基因的高效表达及其表达产物的反应活性

通过PCR技术获得口蹄疫病毒非结构蛋白3B基因,将其克隆至质粒pET-32a( )和高效可溶性表达质粒pEM中,经PCR筛选,获得阳性重组子pET-3B和pEM-3B,将它们转化大肠杆菌BL21中进行诱导表达,SDS-PAGE及Western-blot检测结果证明,表达的3B融合蛋白能与FMDV感染动物血清发生特异性反应。蛋白可溶性分析表明,EM-3B融合蛋白绝大部分以可溶形式表达。以此可溶性融合蛋白EM-3B为抗原建立了可区分FMD免疫动物和感染动物的EM-3B-DIVA-ELISA方法,经检测,其特异性为95.0%,敏感性为97.5%,与2个国产试剂盒的符合率分别为96.25%和98.75%。     

“I WANT MY MOMMIES”: THE CRY FOR MINI‐DOMAS TO RECOGNIZE THE BEST INTERESTS OF THE CHILDREN OF SAME‐SEX COUPLES*

In child custody cases, courts will look to the best interests of a child to maintain visitation/custody rights only with the child's biological parent, not third parties. However, with a same‐sex couple, it is inevitable that one parent will not be the biological parent. Thus, when that parent is in a mini‐DOMA state, where same‐sex couples from non‐mini‐DOMA states do not have to be recognized, that parent will be viewed as a third party and lose all visitation/custody rights if the couple separates. This note advocates that mini‐DOMAs allow both the biological and nonbiological parents of a same‐sex couple to have visitation/custody rights of their children if it would be in the best interest of the children to do so.
