意思自治精神与法官的角色

意思自治精神一般要求法官在民事纠纷审判过程中原则上只是在双方意见不一致而提出请求裁定申请时才进行介入。但在我国民事审判中,当事人意思自治精神却被限制在十分狭小的领域,法庭投入了较大的热情,积极调查取证、询问证人,去发现案件事实,甚至不惜违背作为现代审判基础的不告不理原则。笔者针对最高人民法院的《若干规定》,建议在我国民事审判中明确规定“积极否认事实的自白”以及“权利自白”的法律效力。     

Liberal internationalism meets third worldism: the politics of international election observation in the DRC’s post-war elections

In this article, we draw on the contradictions in, and the geopolitics of, international election observation in the Democratic Republic of the Congo’s 2006 and 2011 elections to identify and analyse the emergence of a neo-third world behaviour among African states intended to counter the excesses of Western liberal democracy promotion on the continent. We argue that the decision by African states to quickly endorse the 2011 elections and close ranks around Joseph Kabila’s government, amidst mounting international criticisms of the electoral process, should be understood in the context of a new form of third worldism that is emerging in the global South in response to the unrestrained exercise of US power.

Globalized economies or globalized bodies？ The economical and cultural factors of obesity in China

This paper is a review of the literature that examines obesity in China. Multiple factors that contribute to this phenomenon are investigated, such as globalization, urbanization and cultural changes. Most of the researches reviewed in this paper concern urban, coastal populations of China. Obesity is defined differently for Asian populations; thus, diagnosis has been underestimated in the past. As China＇s economy develops, the country may now be gaining western problems, such as obesity. Obesity is related to economical causes as China participates in international business and trade. Furthermore, the role of the globalized food industry is reviewed. More western food companies and restaurants have infiltrated Chinese cities, causing mass changes in the traditional Chinese diet. Likewise, employment is a significant factor examined since more occupations in Chinese cities have transitioned to the service sector. Cultural attitudes differ from those of the West in which the Chinese view heavier bodies as healthier than thinner figures. Interventions that have been attempted are reviewed.     

社会工作教育者在社会福利社会化过程中的多元化角色定位

由于时代的变迁、社会的发展和福利国家福利模式的种种弊端,使得社会福利社会化的福利模式被世界许多国家选择和实施,我国也不例外。社会福利社会化要求社会各方共担责任,并扮演相应的角色。社会工作教育者“身在处境中,责无旁贷”,故要扮演相应的多元化的角色,即教育者、研究者、政策影响者和实务者等。而要扮演好多元化的角色,需要一定的角色意识和角色能力作为前提条件。在社会福利社会化的过程中,社会工作者多元化角色的扮演具有一定的意义和功能。     

和谐社会视域中共青团的媒介作用

共青团在建设和谐社会中发挥作用的一个重要途径,是充当青年与其他社会要素之间形成和谐关系的媒介,主要包括执政党与青年之间的媒介、青年人群互相之间的媒介、青年与社会之间的媒介、以及青年与和谐社会合格主体之间角色转换的媒介。

民间组织在政府和社会、政府和企业之间搭建了一个交流、对话与合作的平台,为经济、教育、文化、社会福利、环境保护事业的发展,以及促进再就业起到了政府和企业所不及的作用。本文阐明了民间组织的基本特征,分析了促进民间组织发展的必要性、民间组织的现状和存在的问题,提出了促进民间组织发展的对策思考。     

Regional public goods and international organizations

This article focuses on the provision prognosis for regional public goods (RPGs) and the role of international organizations in fostering supply in developing countries. All three properties of publicness—i.e., nonrivalry of benefits, nonexcludability of nonpayers, and the aggregation technology—play a role in this prognosis. The paper highlights many provision impediments, not faced by national or global public goods. When intervention is necessary, the analysis distinguishes the role of global, regional, and other institutional arrangements (e.g., networks and public-private partnerships). Major Power Diplomacy with Chinese Characteristics Is Moving forward Steadily

The year of 2016 witnessed the balance of internal and external situations,calm and steady actions and proper planning in major power diplomacy with Chinese characteristics.Those were reflected in the success of the G20 summit,the vigorous promotion of the One Belt,One Road (B&R) Initiative and the active promotion of international cooperation on development,which acquired positive response and general agreement from the international community and made special contributions to building a more just and reasonable international order.Those were also reflected in the active management of major power relations and sound responses to the changing situation in the surrounding area to create good external environment for domestic development.In addition,further expansion and defending of overseas interests set higher standards for Chinese diplomacy.Having been pushed by the era to the forefront,China is performing its responsibility as a major power in a peculiar way and will certainly make greater contributions to world peace and development.
