诗意栖居的本真性——论海德格尔在现代性进程中的“返乡之途”

海德格尔对现代性理论的特殊贡献在于他对西方现代形而上学的彻底颠覆和对"存在"问题的追根溯源.通过对黑格尔、尼采的形而上学观的剖析及超越,海德格尔提出以"诗意的栖居"来克服现代技术的危险并回归人类本真存在的"反现代性"思路.在整个现代性发展和现代性批判的历史中,海德格尔的"返乡之途"具有彻底性、悖论性和审美性等特点.     

论欧盟金融服务法中的母国控制原则

在欧盟金融服务法中,母国控制原则是指跨境金融服务应主要遵循母国的监管规则,相应的监管责任也主要由母国监管当局承担。母国控制原则不能适用于未经金融服务指令协调的领域。相互承认原则是母国控制原则的前提和基础,母国控制原则又是实施相互承认原则的必然要求和具体体现。这一原则的形成与欧盟金融服务市场一体化方法的转变有着密切联系,其发展也是这种新的一体化模式广泛推行的必然结果。立法和司法实践表明,母国控制原则的适用范围尚不明确,其价值没有得到充分的体现。为了消除跨境金融服务的法律壁垒,推动金融服务市场的一体化进程,欧盟金融服务立法应向协调行为规则、进一步明确划分监管责任并扩大母国控制范围的方向发展。     

Stability of Palatal Rugae as a Forensic Marker in Orthodontically Treated Cases

The palatal rugae have been used as a reference landmark and identification marker by orthodontists and forensic analysts. However, the reliability of palatal rugae as a forensic marker remains questionable once an individual is subjected to orthodontic treatment. This study aimed at evaluating the changes in the rugae pattern after nonextraction, extraction, and maxillary expansion orthodontic treatment. The lengths and shapes of palatal rugae were evaluated on the pretreatment and post‐treatment dental casts of 168 subjects using the Thomas and Kotze classification. Extraction treatment significantly reduced the second and third rugae lengths (p < 0.05), whereas the third rugae length was significantly increased after palatal expansion (p < 0.05). The shape of rugae remained consistent in all the study groups which may be used as a reliable forensic marker in subjects undergoing orthodontic treatment. However, the use of the lengths of palatal rugae in forensic odontology must be made with caution.     

Age‐Related Vulnerability to Lethal Craniocerebral Crush Injuries from Electrical Beds/Tables

Vulnerability to accidents characterizes the extremes of life for reasons that may be similar in each age group. Two cases are reported to demonstrate increased risks of entrapment and crushing injury involving the use of electrically controlled beds/tables. Case 1: A frail 98‐year‐old woman with a history of dementia suffered a lethal crush injury to her head when she fell out of bed and accidentally activated its lowering mechanism. Case 2: An 18‐month‐old girl suffered a lethal crush injury to her head when she became trapped under a lowered electric massage table. Common devices may be dangerous if individuals do not have the mental or physical capabilities to deal with them. The forensic assessment of such deaths involves an evaluation of the neurocognitive level and physical strength of the decedent as documented in previous clinical assessments, in addition to a careful examination of the structure and function of the bed/table.     

Barriers Experienced by Kinship and Non-Relative Caregivers During the Foster and Adoptive Parent Licensure and Home Study Process

The shortage of foster/adoptive parents being licensed to care for children in the public welfare system prompted an evaluation of the Licensure and Home Study Process (LHSP). Ecological systems theory framed the barriers-to-resources interplay among kinship and non-relative caregivers who withdrew or completed the LHSP. This mixed-methods study examined differences in applicant characteristics and types of barriers experienced. Results indicated that applicants responsible for other children in the home paired with welfare system barriers served as a tipping point for withdrawal. Relatives encountered the most barriers and all grandparents withdrew from the LHSP prior to licensure.

扫描电镜/X射线能谱仪检验电流斑规范化方法探讨

目的探讨电流斑皮肤金属化的机理、检材提取处理和扫描电镜/能谱仪检验规范化方法,对检验结果进行分析和价值判断。方法用扫描电镜/能谱检验,采用低倍大窗口覆盖损伤区域采集平均元素能谱图,并在可能的金属元素富集区域寻找球形金属颗粒。结果扫描电镜下可观察到散在的孔穴、细胞碎屑、龟裂、裂隙等特征,有些电流斑可检出金属元素,其中部分电流斑可发现球形金属颗粒。结论采用规范化的检材提取、处理和检验方法可消除随意性方法造成错检的可能。电流斑皮肤上异常含量的金属附着可支持病理检验符合电流斑表现的结论,同时也为电击导体的推断和金属元素成分比对提供依据。球形金属颗粒的发现揭示存在电弧高温的可能性极大,可强力支持病理检验符合电流斑表现的结论。     

Striking Home: Ideal-Type of Terrorism

ABSTRACT

This essay presents some preliminary notes in an anthropological perspective on terrorism. The following aims to be a questioning review of issues that haunt informed students of terrorism, and yet also an introductory text to the study of terrorism. It is revisionist but didactic. The essay is based on extended research of Palestinian and Israeli terrorism cases, and on critical integration of the literature on terrorism. It offers an alternative approach to the problem of the definition and distinct character of terrorism, expands on overlooked aspects of terrorism, like its relationship to the concept of “home,” emphasizes under-theorized subjects, like the randomness of the targets, and discusses hitherto untouched topics, like the “bad death” of terrorism’s victims. Terrorism is examined in terms of liminality and hybridity, and consequently as more subversive than coercive, threatening our ontological security no less than our physical security.     

The effects of marital breakdown on offending: results from a prospective longitudinal survey of males

Abstract

We examined the factors that predicted marital separation in the Cambridge Study in Delinquent Development, which is a prospective longitudinal survey of 411 London males. We found that dishonesty, having a wife with a conviction(s), convictions, a poor relationship with parents, no exams passed, unprotected sex and having a shotgun marriage predicted marital breakdown. Males from broken homes due to marital conflict had a moderate risk of suffering marital breakdown themselves but the effect was mediated by having conviction(s). An analysis in which separated men were matched with controls on age at marriage, prior convictions and a propensity score predicting the likelihood of separation showed that a man's convictions increased after becoming separated. However, if a man formed a new intimate relationship, the increase in convictions after separation was reduced.     

The absence of a home curriculum in post-apartheid education in South Africa

Abstract

While it is important that education be relevant to the context of students, education systems struggle to introduce curricula that relate to the context of students. In South Africa the national curriculum, which is outcomes based, attempts to address the local context of students by introducing critical outcomes restricted to learning areas, and guide classroom methodology, the selection of content and the motivations for teaching and learning. In this article I argue that due to centralisation and bureaucratisation, the national curriculum does not sufficiently address the context of students. In the analysis, I discuss critical aspects of the curriculum development process, and argue that in order to address the local context, the home curriculum must be introduced in schools. In this way the education system will be striving for the Africanisation of education.
