“国际路线”影响下的中国革命道路——以毛泽东、方志敏的探索为中心

自土地革命以来，以毛泽东、方志敏等为代表的中国共产党人就对中国革命道路进行了思考和探索。通过中央与地方的良性互动，他们的探索得到总结、提炼。但受六届四中全会后“国际路线”全面贯彻的影响，不仅打破了中央与地方的良性互动，也冲击了中国革命道路的探索进程。在这一背景下，毛泽东、方志敏等共产党人在对“国际路线”给予不同程度抵制的同时，也对中国革命道路进行了坚持与反思。他们的努力特别是之后通过正反两方面的比较，逐渐确立了对中国特色革命道路的正确选择。     

未来的国际法实施:从强制执行到遵守管理

20世纪以前,国际法以强制执行为主要实施方式。因缺乏强制执行手段,国际法的法律属性因而受到广泛质疑。20世纪后半期以来,国际法在规范结构和实施机制上有了较大发展。在某些领域,国际法规范开始由消极性规定转向积极性规定,而国际法的实施机制也由传统的自愿遵守和强制执行转向报告监督、帮助激励等遵守机制建设上。国际立法正在经历由权利体系的立法到救济管理的立法转变的过程。     

论外国商事仲裁裁决司法审查的适度性

关于法院对外国裁决的司法审查,国内学者提出了程序审查论和全面审查论,但都有其局限。仅审查程序不能保证外国仲裁裁决的公正,全面审查又扩大了司法审查的范围,应建立适度性司法审查原则。法院应对外国裁决的程序和实体内容进行审查,但对实体内容的审查应限定在一定范围内,反对法院对实体内容过度干预。对裁决的实体审查仅限于两种情况:一是当事人协议约定审查裁决的实体内容;二是裁决确有明显实体错误,法院可依职权审查。

跨国公司来华投资新趋向及我国应对政策与法律原则探析

进入九十年代以来,跨国公司来华投资较前发生了重大变化,并表现出鲜明的特点。跨国公司作为推动经济全球化的重要力量,对我国引进外资和社会经济发展的作用越来越大,本文从跨国公司来华投资的新趋向入手,在分析我国应对跨国公司的政策及法律原则的理论与现实基础上,进一步提出从积极引进、加强引导、合理限制与严密监督四个方面构建我国对待跨国公司来华投资的政策及法律原则。     

老挝的矿业开发及其国际合作

老挝有丰富的金、银、铜、铁、锡、铝、铅、锌、锰、煤、盐和宝石等矿藏。进入21世纪后，老挝政府将矿藏的全面开发利用列入10年发展规划和20年发展战略的主要开发和发展领域，并制定了一系列的地矿勘测、矿藏开发和矿业发展计划及招商项目。在矿业开发方面，老挝寄希望于国际社会的支持和合作，积极鼓励外国企业参与和投资。     

索马里海盗引发的若干国际法问题

肆虐的索马里海盗和武装劫船行为已经对当代国际法多个分支产生了挑战和冲击，带来了若干亟需解决的法律问题。国际社会必须在预防、制止和惩治方面完善对付海盗和武装劫船行为的国际法体系，包括推动武装劫船行为概念的普遍化、更多依赖1988年《制止危及海上航行安全非法行为公约》及其2005年议定书、澄清适用于武力打击海盗和武装劫船行为的国际人权和人道法的类型和内容、以及探索对海盗行为进行公正有效制裁的刑事审判模式。     

拓宽干部教育培训的国际化视野——法国国立行政学院公务员培训的借鉴与思考

拓宽干部教育培训国际化视野，借鉴和吸收世界先进的培训理念和经验，是提高干部教育科学化、现代化水平的一个重要途径。本文结合作者在法国国立行政学院访问学习的体会和认识，结合法国国立行政学院公务员培训的实践和经验，就拓展我国干部教育培训的国际化视野，从“培训”的视角进行了借鉴、分析和比较思考。     

Women and (in)security: The case of the Philippines

Abstract

This paper takes as its starting point the need to address a gender void and northern‐centrism in the new/critical security agenda. Basing the paper on the security priorities of women in the Philippines, presented in the form of a ‘Security Pillar’, the paper examines how far new/critical security, and feminist security literature incorporates the concerns of women in Southeast Asia in the reconceptualization of security, and considers the ways in which security can be reformulated to address the security needs of women in Southeast Asia.     

Institutionalization of a Human Community with a Shared Future and Principles of International Law

The doctrine of building “a human community with a shared future” (HCSF) is a Chinese diplomatic strategy in the new era moving closer to the center of global affairs. It includes enriched ideas about international law and the essential elements of institutionalization. The emergence and development of modern international law have revealed the critical importance of the ideas about international law as guidance for institutions. It is necessary and possible to institutionalize the HCSF by setting its ideas as principles of international law. The principles of international law for the HCSF are those of durable peace, universal security, common prosperity, coexistence of different civilizations, and sustainable development. The new five principles of the HCSF are integrated with the existing general principles of international law and Chinese proposals for the new era, which is not only the development of Chinese-initiated Five Principles of Peaceful Coexistence but also a new contribution to the contemporary international law. It will be the new guidance to advance the profound changes of international relations unseen in a century for the common interest of mankind.
