使用假币罪的实行行为方式解读

“使用伪造的货币”是我国现行刑法规定的使用假币罪的实行行为方式,学界对其基本含义存在“狭义说”与“广义说”之争,这种争议实质上是基于规范用语与普通用语的不同角度来理解“使用”概念而产生的。根据我国使用假币罪的立法变动情况和普通用语规范化的目的论解释方法,“使用伪造的货币”的基本含义应当解读为：以伪造的货币冒充真币,并以真币的通常用法加以利用的行为,但是应当排除私人储藏、出售伪造的货币以及银行工作人员以伪造的货币换取真币等三种情形。     

讯问笔录中特殊语言的记写规范探讨

写作是一门实践性极强的学科,因此在公安院校的写作教学中,除了写作理论的讲授外,重要的是训练学生掌握实际操作的能力。讯问笔录作为诉讼证据之一,或作为记载固定违法犯罪证据的手段之一,具有不可替代的作用。办案实践中,不少讯问笔录不符合写作和法律规范,存在这样那样的问题或质量不高。侦查人员要作好讯问笔录,事先应熟悉案情,作好讯问计划,同时应掌握一些特殊语言的记写方法。     

高职院校大学语文学科定位及教学方法的思考

大学语文"遭遇尴尬"已是高职语文教育中的一个不争的事实,其成因有很多方面。为了改变这种尴尬状况,长期以来,全国各高校都在进行探索。然而,众多的探索多是从普通高校视角进行的,不尽符合高等职业院校的实际,高等职业院校的大学语文课要想彻底摆脱尴尬境遇,必须从自己的教育层次、培养目标及教育对象的实际出发确定其学科定位。

巡警作为警方生产街面公共秩序的主力军,提高巡警街面见警率是一种基本趋势。正如理性公民在行为选择时要考虑其行为的成本和收益,巡警及其组织在生产公共安全产品的过程中也要考虑其行为的成本和收益。因此,建立科学合理的警察绩效制度,构建一个多元化的警察绩效评估体系,是提高巡警见警率和巡警生产效用的根本保证。     

Three models of integration and the Estonian/Russian reality

Abstract

This paper provides a framework for evaluation of Estonia's integration program that the government approved in 2000. It differentiates three “integration” processes that the literature has identified: (1) integration in which Russians and Estonians meld into a common new culture, though predominantly Estonian; (2) assimilation of Russians into Estonian culture; and (3) integration into a common external framework as part of an expanded EU. Relying upon a review of the Estonian and Russian-language press since 2000 and a new survey of 9th year students and their parents conducted in 2002, the paper offers a fourth model of integration in which two integration processes — Russians integrating into Estonian society and both Russians and Estonians integrating into an English-speaking Europe — are taking place simultaneously. Furthermore, the data show that the Estonian government program is reinforcing rather than altering these integration processes.     

论英语教学中学生语感的培养

英语语感是人们对英语的语音感受、语义感受、语言情感色彩的感受等,良好的语感对于学生提升英语学习效果具有重要意义。学生英语语感的获得主要受学习动机、学习习惯和学习环境的影响。加强对学生学习动机、良好学习习惯、英语思维能力的培养和英语学习环境的改良,是培养学生英语语感的有效措施。     

法律语言是法律的精髓

文章从三个方面展示:法律语言是承载法律最有效的工具,"准确"是法律语言的核心价值,重视法律语言研究应该成为一种法律时尚。文章阐明两个重要观点:一是法的世界肇始于语言,立法者与司法者基于法律文本的沟通,法律语境的判断,只能借助法律语言的分析;二是法律语言不但对立法文本,而且对司法解释文本都具有特殊重要的作用。结论 :运用法律语言的准确性是检验立法者和司法者能力的重要标志。     

The Paradox of National Language Acquisition: Russian Speakers’ Labor Market Positions in Estonia

This paper analyzes the changes in the labor market positions of Soviet-era Russian-speaking immigrants and their descendants in Estonia in 1992–2008. More specifically, it explains how the knowledge of Estonian connects with evaluations of changes of market positions. The Estonian case shows that the language policy intervention undertaken in the context of a fundamental transformation of the market structure in the 1990s paradoxically yielded results contrary to the objectives pursued by the language policy. As it turns out, a segregation strategy is successful in terms of market position maintenance or improvement, whereas acculturation strategy (learning Estonian) worsens rather than improves job opportunities.     

Radical-right narratives in Slovakia and Hungary: historical legacies,mythic overlaying and contemporary politics

ABSTRACT

In the last several years, radical-right rhetoric has gained further ground in the political discourse of Slovakia and Hungary. This increasingly overt spiral of tension has been fuelled not only by radical-right actors, such as the Slovenská národná strana (SNS, Slovak National Party) and Jobbik (Movement for a Better Hungary), but also by mainstream parties such as SMER in Slovakia and Fidesz in Hungary. The legitimizing radical-right frames have mostly been founded on politicized historical narratives related to the intertwined processes of nation- and state-building in both countries. Pytlas seeks to describe and analyse this phenomenon, focusing on historical legacies, their mythologized reinterpretations as well as their application to contemporary politics. The debates on the Slovak language law of 2009 and the Hungarian citizenship law of 2010 shall be used as empirical examples of this ‘mythic overlaying’ mechanism.     

Visible Muslimness in Scotland: between discrimination and integration

ABSTRACT

Bonino's article casts light on the realities and perceptions of ethno-religious discrimination among Muslims in Scotland, with particular reference to those living in Edinburgh, during both everyday social interaction with the indigenous Scottish community, and contact with police and security officers. Discrimination against ethnic minorities in Scotland can be traced back in history; however, it is its post-9/11 multifaceted form that has particularly targeted Muslims qua Muslims in a global climate of distrust and stigmatization. While publicly available statistics show a decrease in racist incidents in Scotland, findings from other studies illustrate a more complex situation in which prejudice and discrimination intermingle in ways that make it hard to quantify the precise extent of anti-Muslim sentiment. Qualitative data collected specifically in Edinburgh suggest that Muslims’ hyper-visibility has triggered ethno-religious discrimination by some members of the non-Muslim majority. However, the daily experiences of life in Scotland, and the social relations with non-Muslims, are more heterogeneous and nuanced; they include overall positive views of, and a certain engagement with, many non-Muslims in a context of relative harmony. Contact with police and security officers at airports constitutes the main area of concern for Scottish Muslims, whose confidence, sense of equality and feelings of belonging to society are severely undermined by the securitization of their ethno-religious difference. The path towards a pluralistic Scottishness rests on sociopolitical and institutional efforts to reduce the discrimination against visible diversity, especially at loci of security, and to include the symbolic and physical distinctiveness of Muslimness within the porous Scottish cultural boundaries.
