Review on the Effects of New Firm Formation on Employment

Innovation and start-up has become the impulse of transition and upgrade of China’s industrial structure. The emergence of many start-ups will change the situation and the existing enterprises create new employment. In this way, the relation between start-ups and job creation could affect employment in the long run when industrial structures are adjusted. Empirical researches have proven that the effects of new firm formation on employment last for a long time. Serious competition has emerged between new firms and between new firms and old firms. Only highly innovative firms survive. The employment rate increases. This study reviews the theoretical and empirical researches on new firm formation and employment from home and abroad. And this study provides suggestions for policy-making on the issue of new-firm formation accelerating employment increase.     

乡村振兴中少数民族主体地位的实现路径——基于社会创业的视角

社会因素与经济因素相互作用共同影响着少数民族农牧民的经济活动安排,重视经济理性而忽视经济行为背后的社会结构就会产生农牧民主体地位缺失问题。社会创业强调经济与社会的融合关系,尤其是重视社会在经济活动安排中的功能发挥,为民族地区乡村振兴提供了新视角。课题组对内蒙古通辽市3个苏木12个嘎查进行调查,发现了少数民族农牧民主体地位缺失的原因,并以扎鲁特旗玛拉沁艾力养牛合作社为例,阐释本土化社会创业是实现少数民族农牧民主体地位的根本路径。     

法律规范的逻辑结构新论

准确界定法律规范的概念,是进行逻辑结构分析的前提。根据语义分析哲学对概念的功能论理解,法律规范作为一个被建构起来的概念,应当强调它是能够相对独立地发挥法律调整功能的最小单元。由于法律规范的“最小单元”性质未能引起足够的重视,以往诸种法律规范的逻辑结构理论各有利弊得失,却存在一个共同的缺陷:把“法律规范间的逻辑结构”(或“规范性法律文件的逻辑结构”)误为“法律规范的逻辑结构”。这一误区导致法律规范逻辑结构理论的解释力和应用性受到影响,不仅难以解释刑事法律规范的结构,而且很少在部门法中被实际运用。法律规范的逻辑结构应当采用新的“三要素说”:法律事实 规范模态词 法律效果。     

Recent Publications on Baltic History

This article explores different geographies of tourism, femininities and livelihood in post-socialist rural Latvia, with a focus on women's entrepreneurship within rural tourism. Based on a case study in the Cēsis district, its aim is to analyze women's livelihood strategies, including both economic and lifestyle-oriented motives behind entrepreneurship within tourism. The study illustrates women's day-to-day livelihood practices and how they organize their lives in time and space. The article reveals how women negotiate their ‘livelihood action space’, which includes a number of paradoxes between the quest for independence while facing both economic and social restrictions.

Cultural Prototypes of the Successful Entrepreneur: Comparison of Estonia and the United States

This study compares and contrasts perceptions of entrepreneurship success factors in Estonia and the USA. The 115-item E-World survey is used to highlight differences of implicit beliefs about behaviors and characteristics of successful entrepreneurs between the USA, a country with a long history of entrepreneurial development, and Estonia, a small economy where entrepreneurship has played an important role in the transition from a command to a market economy. Cultural differences and the institutional context emerge as key models in interpreting the social obligations of entrepreneurs, thus linking future orientation and communication, and entrepreneurs’ perceptions of entrepreneurial risks and challenges.

刑事证明中法律推理的客观性不仅应体现在事实领域内,也应体现在价值领域内。它对于练就司法人员的理性思维、培养尊重程序意识、实现法治等有重要作用。刑事证明中法律推理的客观性的建构依赖于刑事证明法律推理自身的客观性、遵循逻辑基本规律及推理主体正确的价值观。而“天然逻辑学”对我国刑事诉讼中法律推理的客观性具有指导及释明作用,可为其科学建构提供逻辑理论基础。     

On the Public Interest of the Market——Externality Doesn’t Means Market Failure

Based on the Market Process and the Individualism Methodology of the Austrian School of Economics,the article tries to introduce the concept of Market Public Interest and compares it with the Invisible Hand principle of Adam·Smith. The article points out that the concept of Externality should be re－understood against the background of Market Public Interest.In fact,the market is an ocean of externalities.In the free market,consumers and entrepreneurs will reflect to the externalities, so the market public interest increased during this process.Therefore,the Externality itself is not a problem and doesn’t mean Market Failure, and actually, the blocking of people’s reflection to the externalities by themselves is the real problem.The Property Right is a concept of status, and adjusting continuously with the individual action.Compared with the concept of Market Public Interest,the article argues that Ronald Coase’s concept of Aggregate Social Product is a static concept and lacks practical methodology foundation.
