个人品德语境下的社会主义道德建设探析

从社会主义道德的基本着力点出发,以新思维来重新解读社会公德、职业道德、家庭美德建设及要求,探析个人品德建设对“三德”的促进作用及从个体道德修养层面提高个人品德的途径,可以为社会主义道德建设这条主干道找寻到一条能让其更加顺畅的分支渠道。     

我国民事简易程序的反思与发展进路

我国法院目前适用简易程序审理的案件,实际上已经包含了国外第一审程序所有的三种类型案件,即普通程序、简易程序和小额诉讼程序。三种诉讼标的数额差别很大的案件适用同一种程序,与国际上公认的按照案件的类型设置民事纷争的处理程序的原理发生了明显的冲突。笔者认为,此次《民事诉讼法》修改,首先应将目前按照简易程序审理的案件按照一定的数额标准一分为三;其次,在基层法院要专门设立简易诉讼法庭、小额诉讼法庭,以防止不同类型案件审理上的混同;最后,简易、小额诉讼程序的设置要有助于人们接近司法,有助于法治社会的形成。     

No exceptions: authoritarian statism. Agamben,Poulantzas and homeland security

This article outlines and compares two different ways of making sense of counterterrorism and the configuration of political power in its context. Against the backdrop of US homeland security, it first outlines Agamben’s thesis on the permanent state of exception. Despite its resonance with key aspects of homeland security, this thesis is found to be analytically limited and theoretically brittle. To overcome its shortcomings and provide a better understanding of contemporary organisation of political power, a strategic-relational approach is suggested, derived from Poulantzas’s state theory.     

Community Wise: Paving the way for empowerment in community reentry

Theoretical approaches traditionally applied in mental health and criminal justice interventions fail to address the historical and structural context that partially explains health disparities. Community Wise was developed to address this gap. It is a 12 week group intervention informed by Critical Consciousness Theory and designed to prevent substance abuse, related health risk behaviors, psychological distress, and reoffending among individuals with a history of incarceration and substance abuse. This paper reports findings from the first implementation and pilot evaluation of Community Wise in two community-based organizations. This pre–posttest evaluation pilot-tested Community Wise and used findings to improve the intervention. Twenty-six participants completed a phone and clinical screening, baseline, 6- and 12-week follow-ups, and a focus group at the end of the intervention. Measures assessed participants' demographic information, psychological distress, substance use, criminal offending, HIV risk behaviors, community cohesion, community support, civic engagement, critical consciousness, ethnic identification, group cohesion, client satisfaction, and acquired treatment skills. Research methods were found to be feasible and useful in assessing the intervention. Results indicated that while Community Wise is a promising intervention, several changes need to be made in order to enhance the intervention. Community Wise is a new approach where oppressed individuals join in critical dialogue, tap into existing community resources, and devise, implement and evaluate their own community solutions to structural barriers.     

The use of 3D visualization for sustainable tourism planning

This paper describes the results of using 3D visualization (3DV) in sustainable tourism planning (STP) during the Comcot project in Estonia. Organizers were interviewed on the characteristics of 3DV for STP and on how participants were involved in discourse using 3DV. The study describes experiences from the Setu, Maidla, and Võrtsjärv lake regions of Estonia. The content analysis of the interviews suggested that the precise selection of visualization objects, detalization levels, and user interface characteristics may significantly influence the quality of STP sessions and help to optimize time, financial, and human resources allocated for a project. The coherent design of the 3DV tool and the neutral moderator positively affect the level of participant involvement in STP and support a trusted platform for community decision making.     

政府环境治理工作的公众评价：央地差距与结构性制约

近年来,随着环境问题日益受到社会各界的重视,政府在环境治理工作中的表现正成为公众关注的重点。但是,我们对于目前我国政府环境治理工作公众评价的基本情况和影响因素还知之甚少。基于对中国综合社会调查2013年（CGSS2013）数据的分析,我们发现,我国公众对于中央政府环境治理工作的评价显著高于地方政府,包括受教育程度、收入水平、社会经济地位感知、政治身份、城乡差距和地区差距在内的结构性因素制约着公众对于政府环境治理工作的评价。在对研究发现进行深入讨论的基础上,进一步提炼了研究发现在政策意义上的启示。     

Realising the Right to Health for Young People in South Africa—Some Reflections

Abstract

The right to health is enshrined in the South African Constitution as well as a range of international and regional human rights treaties which South Africa accepts. Yet empirical data reveals some of the challenges faced by South African youth—childhood diseases, HIV/AIDS and such like. There are evidently challenges realising the right to health in practice. Nevertheless, South African courts have led the international field in recognising the justiciability of economic and social rights such as the right to health. Having reviewed the applicable laws and jurisprudence, the paper will conclude that a more holistic human rights-based approach offers perhaps the best way forward.     

Changing South Korean Water Policy after Political and Economic Liberalisation

This study explores the way in which South Korean water policy has been dynamically (re-)constructed by continuing political contestations among diverse social forces acting in and through the state in the face of political and economic liberalisation. The path-dependency of the state-driven water resource policy under the former authoritarian regime did not disappear even after the democratisation. It was difficult to transform the old authoritarian and hierarchical water governance to the newly democratic and environmentally friendly one because the Ministry of Construction, as a main actor in driving water policy under the authoritarian regimes, did not give up its interest in a dam-based policy orientation, although it did partially accept institutional tools for democratic policy making, such as public hearings and the participation of civil society in the process of establishing the water policy plan. It also showed democratic and environment-friendly gestures using the rhetoric of environmentalism and localisation. Overall, this article emphasises the importance of the path-dependency of the past authoritarian regimes under democratised society to better understand the current democratic regime’s policy orientation.

Mutual efforts for mutual trust: Impacts of citizens' knowledge and governmental communication channels on trust in participatory budgeting

Since participatory budgeting (PB) has been advocated by both theorists and practitioners of public administration, its adoption has become a global phenomenon. As of 2017, all local governments in South Korea are legally mandated to operate a PB system as a policy for inviting citizen participation in local budget decision-making. Using an impact assessment tool completed by PB managers in local governments, this research tested two sets of independent variables—citizens' participatory capacity and the diversification of communication in the PB process—that could be associated with the dependent variables “citizens' trust in government (CTG)” and “government officials' trust in citizens (GTC).” The paper presents the three major findings on the common drivers behind CTG and GTC: (1) citizen participants' knowledge on budget and budgeting process; (2) local government's efforts in gathering citizens' inputs for PB; and (3) the mutual efforts to understand the needs and limitations of both citizens and the local government. The paper concludes by exploring the implications for the design and delivery of effective PB implementation.
