系统法学视域下的金融消费者法律保护——以结构要素分析中美制度

在全球金融危机的影响犹在之时,对金融消费者充分保护的重要性愈来愈突显出来。本文以系统法学的视域下结构要素为切入点,审视对金融消费者的法律保护,通过讨论美国在金融消费者保护领域的制度安排及改革,反思中国当前对于金融消费者保护的不足之处,探寻保护金融消费者的有效途径。     

管控与疏导：群体性事件化解中的视角互换

如何应对群体性事件业已成为理论界关注的热点、焦点和政府工作的一个重点、难点,地方政府在长期的群体性事件处置过程中,已经建立了以维护社会稳定为导向,注重对群体性事件管控的工作模式,其重心在于＂堵＂与＂控＂。此种工作模式在处置群体性事件,维护社会稳定方面取得了一定的成效,但也存在实施成本很高、缺乏可持续性的弊病。由此,各级政府对于群体性事件的处置,既要看到其影响地区稳定等消极面,又要将群体性事件所隐含的积极因素挖掘出来,树立以管控与疏导适时互换为导向的工作理念,通过建立健全一系列相互关联的社会矛盾化解机制,将其转化为促进社会发展的要素,从而实现社会可持续发展。     

解读《庄子与惠子游于濠梁之上》的哲学内涵

《庄子》被誉为"天下第一奇书,"《秋水》篇又被人们公认为《庄子》中第一等文字,作为《秋水》篇中一则著名故事,《庄子与惠子游于濠梁之上》自然也属于极妙之作。庄子与惠施两位辩论高手,同游于濠梁之上,俯看儵鱼出游从容,因而引发联想,开展了一场人能否知鱼快乐的辩论。对这一话题,现有些学者发表论说,认为庄子与惠施的濠梁之辩反映了庄子与惠施的思想。但笔者认为,庄子与惠施的濠梁之辩涉及到了几个十分严肃的哲学问题,具有很强的启发性,并对此文的哲学内涵作了一些探索。     

法律视域下农村基本公共服务有效供给探究

供需不均衡、财力投入不足、供给模式单一、效率低下是困扰农村基本公共服务有效供给的主要原因。依法治国方略确立了法律在国民生产和社会生活中的基本规范和根本性的指导作用。透过法律视角,分析基本公共服务供给中产生非均衡和低效这一现象的原因,可以为推进我国农村基本公共服务供给提供一条可行的路径,为此,我们必须从确立城乡一体化、完善相关法律制度、健全实体与程序的法律三方面着手。     

Performance Evaluation in the Arts and Cultural Sector: A Story of Accounting at Its Margins

In this article, I present a review of financial and management accounting literature on the arts and cultural sector. My objective is to understand to what extent this literature is able to offer a critical perspective on the study of performance evaluation practices in arts and cultural organizations, as it is currently missing in the arts management literature. Adopting a critical perspective means shifting the focus of research from the technicalities of evaluation rules and procedures to their embodiment by the different organizational and societal actors of the arts and cultural sector.     

性别·叙事性·语言学视角:露斯·佩奇的女性主义叙事理论评析

20世纪90年代以降,以北美为主导的女性主义叙事学得到了长足的发展,无论是在叙事理论建构还是在叙事批评实践上均取得了引人瞩目的成果.本文主要从性别、叙事性、研究方法以及研究课题等层面出发,评析英国学者露斯·佩奇的女性主义叙事理论.文章指出,一方面,佩奇采用文学与语言学的双重视角,对女性主义叙事学的发展做出了重要贡献;但另一方面,佩奇关于叙事形式可以脱离性别的论点又偏离了女性主义叙事学研究的主流.     

Interactional Aspects of Intimate Partner Violence Result in Different Help-Seeking Behaviors in a Representative Sample of Women

This article reports a study of the possible impact of sociodemographic and interactional aspects of intimate partner violence (IPV) on help-seeking behavior. Do different sociodemographic groups of IPV survivors use different professional supports and treatments? Do different professional support and treatment agencies come predominantly in contact with women who have been subjected to different characteristics of IPV? Do different interactional IPV variables predict whether IPV victims contact the police, a family doctor, or a psychologist or psychiatrist? A representative sample of 157 women recruited from family counseling, the police, and shelters in Norway was interviewed. Three of seven sociodemographic variables showed statistically significant differences among the recruitment groups. No significant differences in characteristics of IPV were found among the recruitment groups. However, there were significant differences between the main categories (physical, psychological, and sexual) of IPV and interactional IPV factors concerning help-seeking. Our findings indicate that the help-seeking of IPV survivors is differentiated and interaction-specific and that they respond adequately to the different interactional consequences of IPV.
