网上传播黑客技术行为应构成传授犯罪方法罪

利用互联网传播黑客技术的行为是众多计算机犯罪的“罪魁祸首”,严重危害网络安全,对用户的合法利益造成巨大损害。这种行为的实质是向他人传授犯罪方法,情节严重的应构成传授犯罪方法罪。

The new economics of the university: a knowledge governance approach

University is becoming a cornerstone of the new emerging mode of governance of the generation and dissemination of knowledge as it reveals remarkable institutional advantages both in providing a solution to the knowledge trade-off and in reducing agency costs. The typical academic labor relationship emerges as an appropriate institutional device to handle the principal-agent problems when creative talents are required. The unique quasi-hierarchical setup of the academic system creates a supply of certified skills that are ready to operate on a professional basis. Such academic consultants can be paid on an ex-post per job basis matching only their variable costs. This supply leads to the creation of a specific market for research services where the demand is provided by the knowledge outsourcing of corporations. For this system to work effectively the non-exclusivity of intellectual property rights on the results of the research performed under contract is necessary. Non-exclusivity in academic employment relations should parallel non-exclusivity in knowledge ownership.

论遗传资源获取与惠益分享中的事先知情同意制度

为了应对遗传资源利用中的"生物剽窃"现象,对遗传资源的获取与惠益分享进行有效管制,1992年《生物多样性公约》借鉴其他领域的成功经验,引入了事先知情同意的程序制度,并为各国建立国家与利益相关者的双重事先知情同意制度确立了国际法框架。事先知情同意要求遗传资源获取申请者应在其生物开发活动开展之前的合理期限内寻求相关主体的同意,在这段时间内相关主体可以根据获取申请者以合理方式提供的信息做到全面知情,并以特定格式就获取申请者的获取与惠益分享安排作出明确的、肯定的授权。     

我国法律方法教育的反思

在法学教育中,法律方法即把法律规范运用到裁判案件中所采用的方法具有双重属性,即知识的属性和能力的属性。就法律方法的知识属性而言,它应成为法学教学中的知识传授对象,就法律方法的能力属性而言,它又是法律人才必备的素养。目前,我国法学教育既没有重视法律方法知识在法律人才培养中的作用,也没建立起较完善的训练法律技能的有效机制。法律方法教育是我国目前法学教育的薄弱环节,因而应当成为当下法学教育必须重视并着力解决的根本性问题之一。     

权力知识：关于费耶阿本德研究的一个新视角

相对主义、非理性主义、反科学主义、方法论上的"怎么都行"的无政府主义等似乎已构成费耶阿本德哲学思想的基本标志,但其思想中"权力知识"的主题并没有得到应有的突出和重视.费耶阿本德的权力知识论突出表现在:国家权力支配了科学划界的标准;理性霸权垄断了知识生产的路径;唯科学独尊的科学知识妨碍了社会的民主和自由;在国际领域则是科学知识帝国主义和文化霸权.这些论述可以为提升中国学术自主性提供有益的借鉴.     

商品房预售中与抵押权相关的权益冲突及其立法完善

对于建筑工程价款优先受偿权和房地产抵押权的冲突,为平衡承包商与抵押权人的利益,法律可以规定承包商进行垫资的,双方应当就预期垫资款额进行强制公示性登记,该登记款额为承包商行使建筑工程价款优先受偿权的最高限额。如果实际发生的垫资款少于该登记款额,则以实际发生的垫资额为优先受偿权的范围。对于该范围内的优先受偿权应当优先于抵押权和其他债权实现,而不论其发生的时间先后。     

Thoughts on building a just market society

This paper explores the tensions that exist in contemporary society between the individual as citizen and the individual as consumer. The power of the global market place can potentially drive the polity, so it is necessary to raise questions about the means to secure a healthy civic and political life. Financial capitalism, knowledge capitalism and social capitalism are explored as a means of understanding the nature of modern market capitalism. Can financial knowledge and social capitalism be turned into a virtuous circle of innovation, growth and social progress? The paper suggests that trust is the glue, the cement of a just society, and the dimensions of this trust are explored. Finally, the paper examines the nature of stakeholder society.
