研究创新是在全面了解和掌握前人积累的知识和经验的基础上发现新知识和形成新理论的活动。创新性正是通过大量的科学研究和实践活动反映出来的,是研究生教育的生命源,是研究生培养体系形成和发展壮大的基础,是强化研究生创新能力和实践能力的前提。我国现代公安院校研究生教育必须担负起传授公安专业知识、进行技术创新的使命,通过调整课程设置、更新科研理念等切实性措施,培养具有创新精神、创新能力的高层次人才,将创新作为自身发展的永恒主题。

人民监督员制度是权利制约权力、主权在民、公众参与司法、司法民主理念的充分体现。它是一种救济程序,也是一种监督程序。人民监督员制度改革要在宏观上处理好“应然”与“实然”、“渐进”与“嬗变”、“监督”和“独立”的关系;要在微观上健全配套机制,实现人民监督员的独立。     

Enhancing Delivery and Assessment: A Case Study in Module Redesign for Improved Transition Into Higher Education

Understanding student transition into higher education is an important aspect of module design, linking content, delivery, and assessment with a student’s prior educational experience and knowledge bases. However, reflections on how modules designed choices are, generally, not widely disseminated. Here, we document the reflections of a junior lecturer responsible for redesigning a Level-4 Political Systems module and analyze the intentions of change via a transition pedagogy perspective, presenting a program renewal that establishes connected curriculum as an enabling infrastructure for students to actively engage with learning. First-year experience is considered as a major impacting factor of a student’s subsequent success on a program of higher education and the diversification of student cohorts requires teaching staff to consider a wider number of intersectional factors that may impact on a student’s opportunity to succeed in their studies. With a focus on simulations and active-learning, by providing examples of the thinking behind the resultant activities and assessment realignment we hope to provide an example of how a transition approach to a first-year module can be explored.     

First-time boost beats experience: The effect of past eligibility on turnout

Recent findings from the US indicate a clear positive causal effect of past eligibility on voting in subsequent elections. Based on individual-level register data from four elections held in Denmark and Finland, we find that past eligibility either decreases voting propensity or has a zero effect among young voters. The hype associated with the first elections thus appears to cancel out the habit among young adults in countries where the institutional barriers against voting are weak. Moreover, differences across the types of elections can be noted. The negative effect of past eligibility is strongest in elections characterized by low saliency, implying that high-salient elections mobilize all voters equally and therefore narrow the gap between first and second-time eligible voters.

Negotiating in the European Council: A Model European Union Format for Individual Classes

This paper demonstrates the use of an in-class simulation to model negotiations in the European Council. Simulations are an increasingly popular way to teach the complex processes of policymaking and negotiations in the European Union (EU) where institutional procedures are difficult to understand and where intergovernmental and supranational issues often conflict. Advocates of active learning promote simulations to get students more involved and to reach an increasingly diverse student body. The simulation presented here has three separate sessions, each covering a different issue and lasting for a week (two class days) each. Modeling the European Council allows students to experience the intergovernmental side of policy decisions in the European Union while at the same time learning about the issues facing EU policymakers. It is a useful tool for teaching about the EU presidency and a worthwhile exercise for studying the national aspects of European integration. Student surveys indicate that students process the information they gain by role-playing better than information they receive in the traditional classroom. A simulation of the European Council gives students a base for understanding issues of European integration and can serve as a springboard for further study of EU institutions.     

Simulating the Creation of a New International Human Rights Treaty: Active Learning in the International Studies Classroom

This article details a simulation of formulating a new international human rights treaty designed for an introductory international studies course. Student understanding and interest in a range of international relations topics—including diplomacy, two –level games, international law, human rights, and group decision making—are reinforced by actively engaging the students in policy formulation and state –to –state negotiations. The article is structured around the four key components of active learning approaches—educational objectives, design parameters, procedures, and assessment and debriefing—in order to provide a full understanding of the goals, set –up, process, and advantages of the simulation. The simulation has been successfully run multiple times at both a large state university and a small liberal arts institution. Supportive student feedback and an interesting variety of outcomes indicate that this simulation is a positive addition to the course and reinforces the use of active learning approaches in the international studies classroom.     

治理信用缺失的法律责任制度设计

导致我国信用缺失的最根本原因是法律责任制度的不完善.健康的市场经济必须要有完善合理的信用法律责任制度来维系.我国现行的信用法律责任制度的缺陷表现为设定缺乏、设置非适度和规定的缺位.只有从多角度综合运用各种责任形式,进行完善的信用责任制度设计才能最终为市场经济的发展保驾护航.     

Presidential activism and government termination in dual-executive Ukraine

The limits on presidential authority in premier-presidential regimes permit legislatures to wield preeminent influence over government formation and termination. This article shows that even without formal powers to dismiss the prime minister, the president may play a decisive role in government replacement. The article compares three successful and one failed attempt by the president to unseat the prime minister in Ukraine under a premier-presidential system. Based on a review of the significance of 10 variables accounting for presidential activism, it finds that the president’s informal control over institutional veto players as well as the unity of his party faction and cooperation of opposition groups were necessary for the success of attempted cabinet turnover.     

Designing Ethical Online Dispute Resolution Systems: The Rise of the Fourth Party

As the pandemic forces public and private institutions to move online, many court and business leaders are looking to the field of online dispute resolution (ODR) for best practices and lessons learned. Developed over the last twenty years, largely in response to the growth of e‐commerce, the ODR field has generated a deep well of theory and practice while also identifying potential ethical dilemmas and risks. The application of technology, the “fourth party,” plays an increasingly integral role in how we negotiate resolutions to our disputes, with or without a third party. A brief overview of the history of ODR’s development will set the context for the exploration of the range of tools and techniques encompassed by online dispute resolution. Consideration of the ethical challenges raised by ODR practice will illuminate key questions and choices that need to be made in designing ODR systems and in governing their use.
