Today there is no sophisticated theory, which continues to rely on subjectivist premises. It is important, however, that anti-humanism theory's disinterestedness in the (imaginary) subject of voluntarism does not lead to an indifference towards being's constitutive non-essence and passivity in the manner of the worst kind of humanism. Emmanuel Levinas' places ‘absurd’ suffering in the place of essence as the knot of subjectivity; his view of the quiddity of suffering as mode of being passively rather than as psychological content and of the modality of disinterested compassion are used in order to formulate the question `who comes after the subject' in ways which allow us to continue thinking of what it means to be affected in an individuated manner without returning us to the subject of self-presence and autonomy. 马克思与施蒂纳的争论关涉到如何理解形而上学、本质主义在马克思哲学中的地位问题。马克思受施蒂纳影响而提出的“现实的人”,与施蒂纳主张的“惟一者”虽然都具有主体自持性的特点,但在是否追求本质(精神)世界,是否承担对虚无的充实,是否追求永恒、普遍、整体,“现实”或“感性”中是否还拥有超出离散性原子事实的整体性维度及与此相关的超验性维度,对人、现实、历史的理解还是否需要保持辩证法的框架等方面,存在根本性的差异:马克思的回答是肯定的,施蒂纳是否定的。马克思的“现实的人”仍然具有以“现实”、“感性”为根基的“本质性”、“普遍性”、“神圣性”和某种意义上的“抽象性”。所谓马克思反现代性、反本质主义和反传统形而上学,也只能在这样有限的限度内理解,否则就等于把马克思施蒂纳化了。  相似文献

冲突法迄今为止的发展是由主体性、主体间性和社会性三种范式的进化演变构成的。三种范式的根本区分在于其致思路径的差异。主体性范式立足于冲突主体的身份、法则及其利益来直观和直接地解决法律冲突;主体间性范式发展出“间性”思维以变革主体性范式的“极化”思维,要求从主体间的关系或者主体间的协调立场出发构思法律冲突消解方案;社会性范式以境域化的现象学思潮为背景支撑,构建出社会责任、公益责任和私益责任三位一体的冲突法新使命。社会性范式远非冲突法的终点,它自身再次暴露的范式危机表明冲突法的征程乃是一条永不休止的进化之旅。  相似文献

This paper offers a normative argument for reconfiguring borders that rests on a critique of intersecting logics bearing on security, incorporation, agency, subjectivity, encounter, and citizenship. Especially important to my critique is the mutually reinforcing relationship between border security and prevalent assimilationist and integrationist forms of incorporation associated with the dominant single-citizenship model. I offer instead an alternative framing of incorporation I call enfoldment, which is anchored in the contingent and negotiated agency and subjectivity of mobile persons and a multiversal understanding of societies. As I argue, one avenue for opening the possibilities of migrant agency and subjectivity is via what I term ‘mediated passage’. It entails shielding migrants and travellers from the direct control of movement by states at borders, allowing for passage across borders mediated by civil society organizations possessing independent power and authority.  相似文献

Public policy-making does not follow the long-established and well-recognised principles of rational decision analysis under risk. Public views of risk are often inconsistent and seemingly irrational, and a gulf exists between risk perceptions and attitudes of the public and those of 'experts'. On the other hand, experts often claim unjustifiably high levels of confidence in their predictions of policy choice outcomes, creating a lack of public faith in their recommendations. While risky policy choices deserve more systematic decision analysis, many challenges remain to effective implementation of such analyses. Among the suggestions for improvement that we offer is the need for more effective interaction between policy-makers, decision analysts and the public.  相似文献

Abstract: This article explores the construction of Andrea Dworkin as a public persona, or a ‘feminist icon’, revered by some and demonized by others. It argues that in both her fiction and non-fiction, Dworkin engaged in a process of writing herself as an exceptional woman, a ‘feminist militant’ as she describes herself in the subheading of her 2002 memoir, Heartbreak. The article illustrates Dworkin's autobiographical logic of exceptionalism by comparing the story told in Heartbreak to the story of Dworkin's major novel, Mercy, which features a heroine, Andrea, who shares Dworkin's name and significant biographical details. While Dworkin has insisted that Mercy is not an autobiographical novel, the author undertakes a reading here of Mercy as the story of Dworkin if she had not become the feminist icon of her own and others' construction. In Mercy, Andrea unsuccessfully attempts to escape the silent, victimized status that Dworkin has insistently argued is imposed upon women. In her repeated victimization, Andrea functions for Dworkin as an ‘everywoman’ who both embodies Dworkin's world-view and highlights how Dworkin's own biography exists in tension with some of her central assumptions about women, gender and contemporary society.  相似文献

French filmmaker Catherine Breillat has consistently challenged viewers to consider the ways women negotiate sexual freedom in light of numerous forces of repression. This essay considers how Breillat's depiction of women's sexuality in Romance and Anatomy of Hell simultaneously evokes abjection and empowerment. Specifically, we consider Breillat's contrast between her female protagonists and male protagonists, her treatment of women and their bodies as infused with desire yet struggling towards sexual subjectivity, and the avenues available to women to define themselves outside of hegemonic masculinity. We argue that Breillat's provocative portrayals provoke consideration of the problems inherent in hegemonic female sexuality while also offering hopeful alternatives to sexual expression, sexual freedom, and changing definitions of power and pleasure.  相似文献
