土地财政的行政法治视阈

中国模式的土地财政危及了国家经济安全,阻碍了经济社会的可持续发展。只有依照市场经济法治国家对行政权力的规制原则,清晰地界定政府与市场、公民、企业以及中央政府与地方政府的各种应然关系,加速土地财政向公共财政的转型,加强对行政权力的立法监督、民主监督、人大监督,建立以公共服务为导向的政绩评价体系,才能够从根本校正地方政府片面追求土地财政利益的行为,才能为加快转变发展方式提供强大动力和体制保障,才能实现社会和经济的可持续发展。     

Thematics of counterterrorism: comparing 24 and MI-5/Spooks

This paper examines terrorism and counterterrorism as they are manifest in the popular culture of the USA and UK, focusing on two contemporary televisual works, namely, 24 and the series named MI-5 when aired in the US or Spooks when broadcast in the UK. I compare similarities and differences in the representation of agents (individuals) and agencies (organisations) involved in counterterrorism, and how such representations impact upon the two democratic polities. I explore themes of legitimisation, normalisation, and subversion in these works.     

Is the Animal Liberation Front morally justified in engaging in violent and illegal activism towards animal farms?

The Animal Liberation Front (ALF) is an activist group, mainly focused on violent and illegal direct action, including destruction of property, the rescuing of animals and the clandestine filming of animal cruelty on animal farms. Here, I engage with three arguments that are often raised against the ALF’s actions, namely these actions are not morally justified because: (a) they are not measures of last resort; (b) they are excessively violent and do not discriminate targets; and (c) they have no reasonable probability of success. I contend that clandestinely filming animal cruelty is morally justified, the destruction of property is not and that rescuing animals is morally justified, if the ALF incorporates some changes as to how this is done.     

我国巨灾保险法与相关法的规范协同问题

我国巨灾保险法涉及面广,若要使巨灾保险法的功能得以有效发挥,巨灾保险事业得以长足发展,我国巨灾保险法的构建就必须充分考虑其与相关法律制度的规范协同问题,主要是与财政拨付法律制度、已有保险法律制度、证券保险法律制度以及税收制度间的规范协同问题。其中,巨灾保险法与财政拨付法的协同主要体现在巨灾预警预防、救助、恢复重建等方面;与保险法的规范协同主要体现在参保方式、保险机构的建立、相关法律责任认定以及保险原则的继承和发展等方面;与证券法的协同主要表现在特殊机构SPV的法律构建、证券化基本资产真实销售的规定、监督问题等方面;与税法的规范协同主要体现在两个方面,一是与企业所得税法的协同,以更好的促进保险公司开发巨灾产品以及促进企业开发防灾减灾技术,二是与个人所得税法的协同,以更好的促进和保障个人投保以及对特殊群体更多的税收照顾。     

Between competition and centralization: the new infrastructures of European finance

Ongoing European financial market integration relies on the creation of harmonized and centralized market infrastructures: the little-known institutions and systems that settle financial transactions across borders. Since the constitutional conception of market integration within the EU entails creating ‘a level playing field’ for competition, a fundamental problem emerges of how to provide that centralization and harmonization without violating the core principles of an open market economy either through private monopolization or public privatization. The paper presents a socio-technological study of a recent major infrastructure initiative by the European Central Bank, called Target2 Securities (T2S). Embedding the analysis of the struggles and debates around the birth and development of T2S in an analysis of the structural problem of competition and centralization in European financial market integration, the paper suggests an alternative perspective to that of performativity currently dominating the research field.     

Impunity or Punishment? An Analysis of Criminal Investigation into Kidnapping,Terrorism and Embezzlement in Colombia

This paper aims to identify the variables that contribute to explain the current ability of the Colombian criminal system to resolve cases of kidnapping, terrorism and embezzlement. In order to achieve this goal a sample of cold cases and sentenced files were analysed in three main cities of the country. The success of a criminal investigation was divided into three stages: a) the identification of at least one suspect per case; b) the accusation and putting on trial of the suspect; and c) his/her conviction. Econometric techniques were used to identify the criminal investigation variables associated to each of the three successes. Variables such as the evidence and investigative practices used by the judicial police, the attorneys and the courts were taken into account. The results of this study have important implications for criminal investigation and crime policy in Colombia and in the region.     

加强体育立法 完善财税支撑

为了全面总结和继承北京奥运会成功举办的丰富经验和宝贵遗产,加强我国体育事业的立法,改善体育发展环境是十分重要的。文章从加强国家体育事业立法和完善财税制度对体育事业的支撑的角度,进行两个方面的阐述。     

试论中国古代市场管理立法

自古以来统治者视"刑德"为治国之"二柄",但随着生产力的不断发展、经济繁荣,为此统治者们都会制订相应的法律制度来加以规范。这样,中国古代市场管理立法便随之而生,并且随着生产的进步,经济的繁荣发展而不断发展完善。在中国历史上,市场管理立法更能反映出当时经济发展状况,在一定程度上还代表着政治乃至文化的发展状况。古代市场管理立法也可以说是封建社会的统治者对封建时期商品经济的市场化的管理,它极力维护统治者的利益,为封建统治的中央集权提供制度保障。     

亚洲主要航运国家和地区鼓励航运发展的立法及政策探讨

中国香港和新加坡作为全球重要的航运中心,除了两者自身拥有的优越地理环境之外,还得益于其自由开放的经济环境以及政府适当得力的金融鼓励政策。而在经历了这次全球经济危机之后,中国航运业包括船舶制造业的快速恢复及增长,更使得全球目光再次聚焦在这个航运大国的身上。以中国和新加坡为例,通过对船舶注册登记、航运企业税收、航运融资和海事及仲裁法律制度等方面的介绍,探讨最近几年来这些亚洲主要航运国家和地区在有关鼓励航运经济发展方面的立法及政策,并加以比较分析。     

恐怖主义的宗教因素分析

本文通过分析当今世界的恐怖活动事件，指出与恐怖主义有关的宗教并非真正意义的宗教，而是宗教极端主义，是歪曲了的宗教。宗教并非恐怖活动产生的根源，而是其利用的工具。廓清了恐怖主义与宗教的关系，为更好地打击恐怖主义提供了理论支持。
