Explaining Majority and Minority Trust in the Police

This article tests the contribution that social capital theory, performance theory, and the procedural justice-based model can make towards explaining the trust of majority and minority group members in the police. The central research questions are: (1) do the same factors determine their levels of trust? and (2) are the effects parallel? To answer these questions, we carried out regression analyses on data collected from majority and minority group members living in Belgium (960 face-to-face interviews). The results show that, although the three theories offer explanatory elements for members of both majority and minority groups, the explanation of their trust in the police is not identical. Implications for research and theorization are discussed.

论委托贷款的法律价值和政策取向

在从紧货币政策和后国际金融危机影响下,委托贷款成为企业间借贷的重要工具,尤其上市公司利用融资优势和自有资金充足,面对暴利的房地产企业大量发放委托贷款,但是出现了问题。不由我们不重新审视委托贷款的形成背景、法律政策依据、法律属性、法律关系风险,从而提出委托贷款的法律和政策选择。     

技术标准中专利权垄断行为的理论分析及其法律规制

在专利的标准化及其实施过程中,有可能出现专利权的滥用现象,特别是专利权的垄断行为。技术标准中专利权垄断行为导致专利制度的异化,破坏了知识产权制度的利益平衡原则,并扭曲了公平自由的国际市场经济秩序。美国的反托拉斯法、欧盟的竞争法和日本反垄断法体现了对该种垄断行为的基本态度和解决路径,起到积极的规制作用。我国的《反垄断法》一定程度上加强了对滥用知识产权行为的规制,但并不能全面解决国际贸易中产生的众多垄断行为或者限制竞争行为。在技术标准越来越成为新的技术壁垒的背景下,积极借鉴欧盟和美国等的相关立法,根据我国的国际竞争政策需要,构建我国规制技术标准中的专利权滥用行为的法律体系已成当务之急。     

Co-operation in institutional economics and the political economy of trust

The aim of this paper is to analyze the institutional economics of co-operation and the political economy of trust. It is reviewed the transactions costs, the principal-agent theory, market power, increasing-returns theory and value creation, strategic management, competitive forces, resource-based theory, organizational knowledge and learning, strategic choice theory and the collective efficiency theory. Finally, it is sustained the political economy of trust.     

提高政府公信力是构建和谐社会的关键

构建和谐社会,就是要达到经济、政治、文化等社会各系统之间的和谐发展以及各子系统内部的和谐发展。政府公信力是构建和谐社会能力的重要组成部分,对构建和谐社会具有重要的作用。当前,应该把提高政府公信力作为构建社会主义和谐社会的紧迫任务,认真研究、采取得力的措施加以解决。     

影响公共部门内部效率的因素

公共部门主管当局与其工作人员之间是委托代理的关系 ,这一关系的核心是激励约束机制。激励约束机制是否有效率 ,直接影响公共部门内部效率的高低 ,而处理好集权与机动权的分配关系则是建立委托代理关系 ,明确委托人与代理人各自权责的前提。而不同的公共部门存在着不同的权力分配关系 ,在不同的权力结构下 ,委托人与代理人可能出现的道德风险问题也会有所不同。     

Thoughts on building a just market society

This paper explores the tensions that exist in contemporary society between the individual as citizen and the individual as consumer. The power of the global market place can potentially drive the polity, so it is necessary to raise questions about the means to secure a healthy civic and political life. Financial capitalism, knowledge capitalism and social capitalism are explored as a means of understanding the nature of modern market capitalism. Can financial knowledge and social capitalism be turned into a virtuous circle of innovation, growth and social progress? The paper suggests that trust is the glue, the cement of a just society, and the dimensions of this trust are explored. Finally, the paper examines the nature of stakeholder society. 试析侵占罪中财产关系变动的本质

侵占罪在司法实务中虽较为常见,但其认定却往往存在着分歧,主要体现在与盗窃、诈骗等相关犯罪的区分问题上。其中争论的核心主要集中在侵占行为财产关系变动的本质,具体而言就是对侵占行为实施的前提和＂非法所有＂行为的界定。由于侵占罪财产关系变动的方式与其他犯罪有很大差别,所以只要对其财产关系变动的本质加以明确,就能更好地界定各个侵财型犯罪。     

Of legitimacy,legality and public affairs

This paper argues that legality is not enough and that sound public affairs underpins the legitimacy of a political system. It examines the impact of lost legitimacy on Tony Blair, President Bush and America's foreign policy. The author draws historical comparisons between Britain in the Middle East in the 1920s and the USA's problems today and suggests that the fundamental problem is the lack of legitimacy in the region's politics. The paper concludes by asserting that the legitimacy of the EU political system will be endangered while public understanding of its institutions remains limited.
