关于河南省私营企业工会组建和维权情况的调查报告

在党的十五大精神指引下 ,河南省各级工会组织 ,在探索私营企业工会组建、建立私营企业工会领导体制、工作机制、努力提高工会工作水平、维护私营企业职工合法权益、不断开创工会工作新局面方面取得了显著成绩 ,基本形成了“党委领导、人大立法、政府支持、工会主抓、社会各界配合”的工作格局。     

职工持股会法律地位研究

近年来因职工持股会股权转让而引发的诉讼时有发生,已经引起了社会各界和工会的高度重视。目前,由于我国法律缺乏对职工持股会法律地位的明确规定,而各地有关职工持股会的规定和做法又正处于探索之中,职工持股会在实践中存在着一系列的问题。因此如何认识职工持股会的性质,如何正确处理工会和职工持股会的关系,以及职工持股会法律地位的立法选择等方面的问题需要进行深入的研究和思考。     

Different ways of blowing the whistle: Explaining variations in decentralized enforcement in the UK and France

The factors explaining decentralized enforcement – the monitoring and reporting of illegalities in organizations by employees – remain poorly understood. This article contributes to filling this gap by presenting a study of employee reports to regulatory authorities of incidents that have taken place in British and French high hazard industries. The article distinguishes between two different registers of “quiet” and “loud” reporting, reflecting the varying echo of employee reports, as intended either by employees themselves or by other stakeholders. The study finds quiet reporting to be widespread in the UK, while loud reporting was salient in France only. The contrast can be explained by making reference to the relationships between unions, regulators, and managers, and the history and institutions of industrial relations that shaped them in particular ways in each country. The comparison suggests also that whistleblower protection legislation has played little role in encouraging reporting.     

Between ballots and bullets: elections and citizenship in and beyond the nation-state

This article approaches electoral acts and performances as central sites for the negotiation of citizenship relations. I argue that, in order to understand how these relationships are shaped, we must attend to governmental actors beyond the nation-state, from trade unions to criminal organizations. Focusing on the case of Jamaica, I show how non-state actors have come to play a central role in hybrid forms of governance, shaping citizens' allegiances to multiple, overlapping political communities. How are campaigning and voting affected by such multiple allegiances? What new understandings of citizenship can we develop if we take the role of non-state actors in the electoral process seriously? I suggest that we should study elections as a site where citizenship – understood here in its broad sense of membership of a political community – can develop both within and beyond the nation-state.     

Stratégies syndicales et renouvellement des élites: le syndicat FTMH face à la crise des années 1990

En nous centrant sur le cas de la FTMH entre 1970 et 2004, nous analysons l'adaptation des syndicats dans le contexte de leur affaiblissement au cours des années 1990. Selon nous, l'affaiblissement du syndicat dans la sphère économique a donné lieu à un déplacement de l'action syndicale vers la sphère politique. Il est possible de dégager deux axes dans la redéfinition de la stratégie de la FTMH, dont le premier concerne le renouvellement des élites: des nouveaux dirigeants, universitaires et marqués par leur appartenance au PSS, remplacent les “élites traditionnelles” du syndicat. Ce renouvellement a appuyé un deuxième changement: un nouveau rapport à l'état et une diversification des registres d'action du syndicat. Les négociations collectives s'accompagnent désormais de stratégies de politisation, mais aussi de mobilisations, ainsi que d'une volonté de s'assurer une meilleure visibilité médiatique. L'ensemble de ces évolutions témoignent d'un rapprochement avec le PSS.

社区工会的实践与思考

社区工会工作是一项全新的工作。组建社区工会是加强社区建设、维护工人阶级团结统一、巩固党的阶级基础、执政地位、履行工会职能和加强基层政权建设的需要。开展社区工会工作,没有现成的模式和经验可供借鉴,必须坚持思想观念的创新和工作方法的创新。南京市总工会在社区工会建设上进行了大胆尝试并取得了实践经验,并就社区工会的发展方向提出了创新性意见。
