少数民族中心城市和谐行政执法方式的探索——以贵州省凯里市为例

少数民族地区中心城市是少数民族聚居地,在城市管理执法中由于民族习惯引发的纠纷较多,构成城市管理的特殊问题,这些民俗习惯将渗透于案件的执法管理过程,形成特殊性。基于此,少数民族地区城市的执法管理,应该充分考虑少数民族文化习惯尤其是民族禁忌,采取变通执法,做到国家法律与地方文化习惯的兼容,才能使少数民族地区城市执法达到和谐目的。

当今中国各个领域的重大转型都根源于国家与社会的二元化和由此所导致的国家、社会与个人关系的转型,即从"国家、社会/个人"模式转向"国家/社会、个人"模式,其实质是从国家本位主义转向社会本位主义和人本主义。中国社会的这一转型导致了刑事诉讼本质观、目的观、价值观、构造观和刑事证明理论的变迁,而这些观念和理论的变迁又反映在《刑事诉讼法》的修改中。

社会和谐是中国特色社会主义的本质属性，构建和谐社会是贯穿中国特色社会主义事业全过程的长期历史任务，而社会是由个体构成的，所以构建和谐个人具有现实的意义和价值。文章从儒家思想中的和谐观人手，探讨个人怎样在儒家和谐思想的基础上建立与自我、他人、社会、自然四个层次的和谐关系，从而最终构建真正意义上的和谐个人。

Divided we Fall: Division Within the National Partisans of Vidzeme and Latgale,Fall 1945

Heinrihs Strods has shown that Latvia's national partisans were defeated primarily because of the overwhelming military odds they faced, but he added a secondary cause–the lack of unity in their ranks. This article explores the causes of such disunity and suggests that Björn Felder is right to see a blurring of ideological divisions as the Second World War came to an end; however, even at the height of summer 1945 there were some signs of tension, and as the likelihood of foreign intervention waned, fundamental tactical disagreements developed, disagreements which reflected different political pasts and differing visions of Latvia's future.     

No translator is an island: the changing dynamics of Murakami Haruki translations around the world

Abstract

Tim Parks has included Haruki Murakami among the group of authors writing ‘dull global novels’, a perception that is in part the result of an exclusive focus on English-language translations of Murakami. By turning attention to translations in other languages, this essay reveals a more nuanced and complex picture, showing that depending on where and by whom he is translated, Murakami in fact emerges differently than in English, and arguing that his writing is perhaps not so ‘dull’, after all. After briefly describing the history of Murakami translations in North America, the essay examines the history of translations in East Asia, using the example of greater China, where the two main translators, Lai Ming Chu (Taiwan) and Lin Shaohua (China), produce strikingly different versions of his writing. The essay then goes on to trace the main patterns of Murakami translation in Europe and into some Middle Eastern languages and Persian. In Europe there is a gradual shift away from indirect translations through English toward direct translations from the Japanese, and a greater degree of collaboration among translators. The essay analyzes the effects of these changes, offering a few examples from Murakami’s latest novels.     

Reimagining civil society in conflict: Findings from post-2001 Afghanistan

What is the meaning and role of civil society in Afghanistan? And what contribution could civil society actors make to promoting peace and political reform? Drawing on a research and dialogue project conducted in 2009–2012, this article explores local understandings and practices of civil society in Afghanistan, and examines their relationship to security and social change. It argues that studying civil society can help shed light on the changing dynamics of political authority and security in the country, as well as offer new avenues for promoting progressive change. The article addresses some of the conceptual and analytical limitations of dominant narratives about civil society in conflict-affected environments, demonstrating how they tend to neglect certain forms of agency that have the potential to be transformative.     

Security Identities and ‘No More,No Less’ Operations: On Making NATO's Involvement in Darfur Possible

This article explores NATO's support mission to the African Union's peacekeeping operation in Darfur, Sudan between 2005 and 2007. NATO policies are commonly presented as functional responses to events, but how did a conflict on the African continent become the Atlantic Alliance's business? In this essay, a poststructuralist practice-oriented approach is used to understand the way in which discursive practices progressively establish a policy option as ‘natural' in a given situation. It is argued that the normalization of NATO's support mission to the African Union in Darfur and the integration of this operation in NATO's security identity were the result of complex and conflict-ridden social interactions between different discursive practices supported by different actors.     

多元社会治理中政府主导作用探析

在多元复合治理体系的建设中,既需要以社会组织为代表的社会力量发挥主体作用,更需要政府发挥主导作用。政府在社会治理中的主导作用,不仅是对传统社会管理方式的自我扬弃,而且是对新的社会治理方式的积极创新,但目前对这个问题的研究还很不够。为此,就迫切需要正确认识和把握政府在多元社会治理中主导作用的科学性内涵、理论合理性和现实必要性等。对政府在多元社会治理中主导作用的探索与研究,对创新社会治理体系、提高社会治理水平、推进国家治理体系和治理能力现代化等,均具有重要的参考价值和借鉴意义。
