《刑法》中界定食品的概念应当以《食品安全法》为法律依据,两者在范围上应当保持一致。食品添加剂从食品功能拓展的角度来看,应当属于食品原料。"食品安全"的内涵需要从"无毒无害"、"符合应当有的营养要求"以及"不造成任何形式的危害"三个方面加以认定,缺少其中任何一项的就属于"不符合食品安全标准的食品"。而"有毒有害的食品"的认定应当以"毒害性"作为具体的判断标准,对象是否属于"非食品原料"不能作为否定罪名成立的消极条件。  相似文献

发生食品安全事故,往往会涉及多个责任人,其责任是不同的。食品生产者承担严格责任并不意味着其他连带责任者也一样承担严格责任。销售者、广告者承担的是过错责任。《食品安全法》关于销售者的责任规定,有宽纵之嫌;而广告者的责任似乎又过于严厉。为求平衡,销售者、广告者的责任均以过错推定责任为宜。消费者向原材料提供者的索赔,也面临法律障碍。《食品安全法》关于销售者十倍赔偿的责任规定,是“纸老虎”,消费者要胜诉十分困难。农民个人作为农产品生产者,其责任监管十分欠缺,是急需研究和完善的一个领域。  相似文献

食物权作为一项基本人权关乎人类的生存、健康和尊严。《经济、社会及文化权利国际公约》第11条首次对食物权作出规定,并通过一系列评论文件阐明其内涵、国家权利和义务以及监督机制。有关食物权的规定的出台有着重要意义,但金融危机和粮食危机给食物权的实现带来了巨大的阻力。在该背景下,如何消除饥饿,提供足够的食物是国际社会共同面临的问题。  相似文献

一起卫生许可证的行政诉讼案件,反映了《食品卫生法》关于主体的规定,由于时代的变迁产生了法律漏洞,导致司法实践中理解与适用法律的困难。这一法律漏洞,涉及行政许可主体的扩大,不宜由部门规章与法院加以补充。因此,在《食品卫生法》全面修订为《食品安全法》时,应运用经济法的主体理论,加以修改与完善。  相似文献

Diabetes type 2 is a growing public health problem worldwide resulting in substantial costs both to the public purse and to individual health and wellbeing. The disease has long been associated with sexual and reproductive health problems, but otherwise, there has been little attention to the way gender might shape the experience of diabetes. Diabetes prevention and management place heavy emphasis on ‘lifestyle’ which foregrounds several gendered domains of social life. This study investigates how gender influences the experience of living with diabetes type 2 in a sample of 119 adults with diabetes. Employing Connell's relational perspective on gender, this article shows that the management of chronic illness entails structures of production, power, cathexis, and symbols through which the experience of living with this chronic condition simultaneously reflects and produces dominant and more marginal forms of femininity and masculinity. We conclude with suggestions for how the findings might assist service providers to improve diabetes care.  相似文献

Abstract

Food replicas (shokuhin sanpuru) line the show windows of cafes and restaurants in cities, towns, and villages throughout Japan. They are usually found artfully arranged in restaurant show windows or cases, facing and visible from the street, corridor, hall, etc., on which the restaurant is located. Building on consumers’ familiarity with foods, ingredients, and cooking techniques, these replicas visually evoke other senses – taste, scent, texture, and mouthfeel – instantly providing massive amounts of information. As a ubiquitous visual marketing tool, sanpuru have contributed to the creation and maintenance of Japan’s hybrid national culinary culture, especially the pervasive ‘middlebrow’ echelon of mainstream, everyday consumer culture. In particular, it is argued in this article that, as an inevitable, almost transparently naturalized part of the visual landscape of food and consumer culture, samples have played a crucial but underappreciated role in the establishment and dissemination of the much-remarked-on visual aesthetic of Japanese culinary culture.  相似文献

Abstract

The coordination of activity across sites and spaces of production and consumption is a key concern for economic analysis. Joining a revival in the application of convention theory to agro-food scholarship, this paper considers complementary insights – related principally to ‘the economy of qualities’ – that animate different aspects of e/valuation, competition and alignment. These understandings are extended by more thoroughly acknowledging contemporary developments in consumption scholarship. The arguments are advanced through a case study of the orange juice market, linking its current high-carbon trajectory to the commercial and cultural significance of freshness. The analysis offers new insights into distributed processes of qualification as well as the mechanisms through which conventions are assembled and sustained. Finally, a more integrated approach to food production and consumption is outlined.  相似文献

China's forest cover has been increasing in the past three decades, which is in sharp contrast to rapid declines in other natural resources. Understanding the mechanisms of forest recovery and their effects is essential for sustaining forests in China and elsewhere. Some studies suggest that imports of forest products have contributed to the increase in forest cover of China and the decline in forest cover of exporting countries. However, it is not clear whether other countries beyond the exporting countries are affected. Using the framework of telecoupling (socioeconomic and environmental interactions over distances), we found that China's forest cover increase is affected by multiple telecoupling processes (e.g. trade of food and forest products) and their interactions with each other and with other factors. The socioeconomic and environmental impacts of telecoupling processes go well beyond China and the exporting countries. As China's demand for forest products and other ecosystem services such as food and water continues to rise, telecouplings will become even more important for sustainable forests, food security, water security, human well‐being and environmental sustainability in the future. New and more effective policies are needed to minimise negative and enhance positive impacts of telecouplings on China and other countries around the world.  相似文献
