论苏联解体后的“核遗产”及核扩散危机

苏联解体后其庞大的核武库也一分为四,在核武器系统、核材料、核科学家及核技术等三个层次都出现了失控的核扩散危机。以美国为首的国际社会从各个方面给予了大力援助,使前苏联庞大的"核遗产"得到了妥善的处理。因苏联解体而一度出现的核国家增多的问题得以解决,核扩散危机也基本得到消除。这不仅有效地捍卫了国际核不扩散体制,而且在实践上也是对国际核不扩散机制的补充和发展,对人类社会的和平与安全也是重大的贡献。当朝鲜和伊朗核问题屡成危机而长期困扰国际社会时,我们重温这段历史,也具有深刻的现实意义。     

DNA Recovery From Tape-Lifting Kits: Methodology and Practice

In the case of suspicious deaths, the technique of 1:1 taping is often used in Belgium. It consists of affixing a large number of adhesive tapes to the body of the victim. It is conventionally aimed at obtaining microtraces (e.g., fibers, hair) and is usually not used for DNA analysis. However, in some cases, DNA analysis of certain areas of interest identified on the 1:1 taping material can offer a last resort solution. The four-step method that is described in this article involves the selection of areas of interest on the body (Step 1), the selection of the corresponding tapes (Step 2), the decontamination of the tapes (Step 3), the selection of areas of interest on the tapes, for DNA sampling (Step 4). The method is illustrated by its successful application in four murder cases. In each case, DNA profiles of good quality could be identified, including profiles of persons different from the victim.

系列杀人案件在我国各地时有发生,问题突出,危害后果严重,把握这类案件的犯罪规律,研究侦查对策,将对有效预防、遏止和打击系列杀人案件起到积极作用。     

“携带凶器抢夺”适用的思考——刑法第267条第2款释疑

最高人民法院《关于审理抢劫案件具体应用法律若干问题的解释》第6条对“携带凶器抢夺”的两种情形明确界定为抢劫罪。但是在司法实践中对“携带凶器抢夺”的适用存在困难和分歧;因此应正确对“携带凶器抢夺”予以定性,并正确适用其构成抢夺罪、抢劫罪、转化型抢劫罪的情形。     

Murder, Extramarital Affairs, and the Issue of Probative Value

A paper previously published in Law and Human Behavior by D. Davis and W. C. Follette (2002) argued that certain "profiling" characteristics commonly admitted into court have little or no probative value. They argued that this is especially likely to be true when the characteristic used as evidence (e.g., having an extramarital affair) is rather common in the population whereas the act in question (e.g., a man murdering his wife) is rare. Their analysis has prompted a strong response by Friedman and Park and by Kaye and Koehler with a rejoinder by Davis and Follette (all three follow this paper in this issue of Law and Human Behavior). This paper describes some of the nature of this controversy.

美国刑法中的重罪谋杀罪规则评析

重罪谋杀罪是英美刑法中比较特殊,并引起很多批评和质疑的罪名。目前,美国大部分州的刑法仍保留有该罪名,但其适用范围和条件受到越来越多的限制,实际上被限于在实施重罪过程中故意或过失造成死亡结果的情形。由于该罪名的设置仍具有一些积极意义且限制了适用范围,尽管存在比较严厉的批评之声,但绝大多数州的刑法仍然保留了重罪谋杀罪规则,短期内没有被废除的迹象。     

The Homicide–Suicide Phenomenon: Findings of Psychological Autopsies

Homicide–suicide represents a single episode of violence which may decimate an entire family. This study aimed to further describe motives and context of these tragedies. Psychological autopsies were completed for 18 homicide–suicide cases in Dallas, Texas. This included postevent interviews with surviving family members and review of police and coroner records. Two‐thirds of perpetrators had made either verbal or written threats prior to the homicide–suicide. A simplified typology describing victim–perpetrator relationship and motive type is suggested for future studies and clinical ease. Two‐thirds of perpetrators fell into the category of Intimate‐Possessive, most of whom were depressed men who were abusing substances and undergoing separation. Additional categories included Intimate‐Ailing, Filial‐Revenge, Familial‐Psychotic, and Friend‐Psychotic. Further, implications from this psychological autopsy study regarding risk assessment include use of collateral interviews regarding threats and past violence.
