Articulating the threatened suffragette body: suffragette embroidered cloths worked in Holloway Prison, 1911–1912

ABSTRACT

In public archives there are a number of hand-embroidered cloths worked by suffragettes incarcerated in Holloway Prison between 1911 and 1912. Denied political status, some of the embroiderers used the hunger strike as a political tool and were forcibly fed. In this paper the embroideries are reframed as material and discursive evidence of suffragette prison experiences. The material narratives of the embroidered cloths are traced, drawing on a dialogue between critical theory, material object enquiry, practice as research and the work of contemporary textile practitioners. Embroidering by suffragettes is explored as an embodied and situated ‘thread act’ that materialised the making of networks, the need for protection of the body and mind, the powers and dangers of boundary crossing, and proto-political thinking.     

论刑法适用中道德评价因素的考量

道德评价能否在刑法适用中予以考虑,是刑事司法中的难题。一方面,道德评价在刑事司法中的体现是普遍存在的实然现象;而另一方面,法治原则一般又要求道德评价不应介入司法领域,否则,依法司法的理念将受到冲击。从理论上来看,道德评价可以在刑法适用解释中予以考虑,与其让道德评价潜在地、非理性地影响刑法的解释与适用,不如理性地承认和接受道德评价因素,并对其规范、限制和合理运用。道德评价因素在刑法解释和适用中的考量既是法理的要求,也是刑法原则所许可的,那种绝对排斥道德评价的观点,看似符合法治原则,但实际上并不能成立。从社会学的视角判断,刑法适用中考量道德评价因素是社会和谐的需求,也是社会学解释方法的题中应有之义。当然,对道德评价的考量与运用,应当在法律方法论的范围内,并在对其认真甄别、选择的基础上进行。     

INTRODUCING PERSPECTIVES IN FAMILY LAW AND SOCIAL SCIENCE RESEARCH

This article provides an editorial introduction to the following three related articles on the growing use and influence of social science research in family law. It first considers why this has become problematic and identifies some common strategies used by advocates, sometimes under the guise of scholarship, to destroy the standing of research findings contrary to their ideological or political position. Then it discusses briefly the remedies proposed to mitigate these kinds of problems within the following three articles.     

Stories as Lived Experience: Narratives in Forced Migration Research

Stories are part of everyday life and constitute means for actorsto express and negotiate experience. For researchers, they providea site to examine the meanings people, individually or collectively,ascribe to lived experience. Narratives are not transparentrenditions of ‘truth’ but reflect a dynamic interplaybetween life, experience and story. Placed in their wider socio-politicaland cultural contexts, stories can provide insights into howforced migrants seek to make sense of displacement and violence,re-establish identity in ruptured life courses and communities,or bear witness to violence and repression. The researcher mustpay particular attention to his/her own role in the productionof narrative data and the representation of lived experienceas text.

Linkages Methodology: No Man is an Island

The paper argues that given the diversity of the field of forcedmigration, research requires a multi-disciplinary approach andan awareness of the multiplicity of interacting factors whichcome into play. It examines two key texts published 20 yearsapart which exemplify the linkages approach. Imposing Aid (1986)studied the developing situation in Sudan as refugees arrivedfrom Uganda in the early 1980s, and showed the unproductivenature of interactions between officials and refugees. Landscapeof Hope and Despair (2005) examined the situation of Palestiniansin refugee camps, where the refugees’ own agency comesup against the structural constraints of camp administrationand the political actions of local and international power holders.
