2011年越南政治、经济与外交综述

2011年,越南在政治、经济、外交等各个方面都有不少值得关注的重要事件。越南召开了越共十一届党代会,进行了第十三届国会选举。在2011年里,越南完成了预定的经济计划,但仍面临诸多重大挑战。这些挑战构成了越南实现经济可持续发展的障碍。越南在外交方面注重与东南亚地区内外国家发展外交关系,其中尤为注重发展军事交往关系,积极参与国际事务,力图以此提高国际地位。但如何解决与邻国关系问题,已成为越南保持稳定的国际环境的关键因素。     

我国经济体制改革的主要历程及宝贵经验

十一届三中全会开启了改革开放的历史新时期。在这场历史上从未有过的大改革大开放中，党领导全国各族人民坚持解放思想，实事求是，大胆实践，积累了宝贵的经验。     

Distribution of ∆9‐Tetrahydrocannabinol and 11‐Nor‐9‐Carboxy‐∆9‐Tetrahydrocannabinol Acid in Postmortem Biological Fluids and Tissues From Pilots Fatally Injured in Aviation Accidents

Little is known of the postmortem distribution of ?⁹‐tetrahydrocannabinol (THC) and its major metabolite, 11‐nor‐9‐carboxy‐?⁹‐tetrahydrocannabinol (THCCOOH). Data from 55 pilots involved in fatal aviation accidents are presented in this study. Gas chromatography/mass spectrometry analysis obtained mean THC concentrations in blood from multiple sites, liver, lung, and kidney of 15.6 ng/mL, 92.4 ng/g, 766.0 ng/g, 44.1 ng/g and mean THCCOOH concentrations of 35.9 ng/mL, 322.4 ng/g, 42.6 ng/g, 138.5 ng/g, respectively. Heart THC concentrations (two cases) were 184.4 and 759.3 ng/g, and corresponding THCCOOH measured 11.0 and 95.9 ng/g, respectively. Muscle concentrations for THC (two cases) were 16.6 and 2.5 ng/g; corresponding THCCOOH, “confirmed positive” and 1.4 ng/g. The only brain tested in this study showed no THC detected and 2.9 ng/g THCCOOH, low concentrations that correlated with low values in other specimens from this case. This research emphasizes the need for postmortem cannabinoid testing and demonstrates the usefulness of a number of tissues, most notably lung, for these analyses.

Ihr Rechtsverh?ltnis zum Wohnungseigentümer als Vermieter stellt aber blo? eine formelle Streitgenossenschaft iSd § 11 Z 2 ZPO dar.     

Phenolphthalein False‐Positive Reactions from Legume Root Nodules

Presumptive tests for blood play a critical role in the examination of physical evidence and in the determination of subsequent analysis. The catalytic power of hemoglobin allows colorimetric reactions employing phenolphthalein (Kastle‐Meyer test) to indicate “whether” blood is present. Consequently, DNA profiles extracted from phenolphthalein‐positive stains are presumed to be from blood on the evidentiary item and can lead to the identification of “whose” blood is present. Crushed nodules from a variety of legumes yielded phenolphthalein false‐positive reactions that were indistinguishable from true bloodstains both in color quality and in developmental time frame. Clothing and other materials stained by nodules also yielded phenolphthalein false‐positive reactivity for several years after nodule exposure. Nodules from leguminous plants contain a protein (leghemoglobin) which is structurally and functionally similar to hemoglobin. Testing of purified leghemoglobin confirmed this protein as a source of phenolphthalein reactivity. A scenario is presented showing how the presence of leghemoglobin from nodule staining can mislead investigators.     

Narrating the cultural trauma of 3/11: the debris of post-Fukushima literature and film

Abstract

Images of debris dominate our understanding of the 3/11 triple disaster – earthquake, tsunami, nuclear meltdown – that took place in Japan on 11 March 2011. They have been effectively used to rewrite the story of individual suffering into one of collective tragedy. In this article, debris is a locus for examining the construction of the narrative of 3/11 as cultural trauma. The article analyzes three texts that deal directly with images of 3.11 debris: Fujiwara Toshi's documentary film No Man's Zone and two short stories: Murakami Ryū's ‘Little eucalyptus leaves’ (Yūkari no chisana ha, 2012 Murakami, Ryū, 2012b. Fujiwara interrogates the position of the viewer via images of destruction, Murakami connects 3/11 to the multidirectional memory of other global traumas like Auschwitz, and Saeki constructs a local narrative that contrasts the personal experience of the disaster with a televisual or filmic representation. These texts are engaged in the cultural work of constructing 3/11 as collective trauma. They create a collective identity, a ‘we’, for this trauma that speaks both for and against the national narratives of recovery. This article examines images of debris around the one-year anniversary of 3/11 and speculates on the concurrent lack of images of bodies.     

Legislative genesis and judicial death of a directive: The European Court of Justice invalidated the data retention directive (2006/24/EC) thereby creating a sustained period of legal uncertainty about the validity of national laws which enacted it

The Grand Chamber has ruled that the data retention directive was invalid ex tunc since it seriously interfered with the fundamental rights to respect for private life and protection of personal data and exceeded the limits of the principle of proportionality which are provided for in the Charter. The scope and temporal effects of this ruling should be clarified, especially its legal impacts on national laws of Member States which enacted the directive. In addition, the findings of the Grand Chamber on geographical safeguards have far-reaching implications on the retention and storage of personal data in the EU.     

Analysis of Job Market in Germany and Spain in Order to Reduce Unemployment in Serbia

The percentage of unemployed in Germany was at the lower level than in Spain until 2004. In 2004, the percentage of jobless citizens in Germany almost reached Spanish average, while in 2005 and 2006, German unemployment rate even overcame Spanish one. During the period of the crisis, unemployment rate in Spain has been nearly five times higher than in Germany and more than two times higher than the average unemployment rate in the EU. Youth unemployment in Spain is 50%. On the other side, Germany is becoming even stronger in the period of crisis The incredible recovery that Germany experienced after World War II is commonly referred to as the Wirtschaftswunder, which translates into English as the ＂economic miracle＂. It can be said that Germany＇s successful recovery following the global financial crisis could justifiably be classified as the Wirtschaftswunder II. In Serbia, situation is much worse than in above-mentioned countries and it could not be concluded that it is just caused by the crisis. Periods of wars, economic sanctions and hyperinflation, as well as the transition process from the centrally planned to the market economy caused great number of jobs to be lost.
