Overreaching In Registered Land Law

Beneficial interests under a trust were not intended to be overriding interests under section 70(1)(g) of the Land Registration Act 1925. The position was altered by Williams & Glyn's Bank Ltd v Boland , which determined that an interest under a trust for sale would bind a purchaser if the beneficiary were in actual occupation. The decision raised the question whether such interests could be overreached once the beneficiary was in occupation of the trust property. City of London Building Society v Flegg held that the relevant beneficial interest had been overreached. Both decisions assume that overreaching in registered conveyancing takes effect as it does in unregistered land. Yet there is considerable evidence that the Land Registration Act contains its own overreaching machinery. The House of Lords applied the wrong overreaching provisions in Boland and Flegg and there is no legal basis on which to recognise that trust interests can override a subsequent disposition under section 70(1)(g).     

Orphans,apprenticeships, and the world of work

This article explores a frequent and important practice in the ancien Régime society, namely, apprenticeship. The apprenticeship contracts of legitimate orphans (boys and girls) who were received in institutions that specialized in caring for them — such as the Trinité or the Saint-Esprit — provide the data for this study. By focusing on these two, it is possible to compare two groups of orphans, as well as differences in the intentions and accomplishments of the institutions in terms of offering instruction and preparation for the working world. This examination focuses on the transition from the institution to society. How did the orphans interpret this transition? And how did administrators perceive their roles? The example of the Trinité and the Saint-Esprit serves to rectify the common image of the hospitals as poor and highly imperfect in terms of education and apprenticeship. It shows that these were genuine training institutions for older children.

韩国国家形象的变迁及其启示

得益于本国的高速发展和积极的对外传播,韩国的国家形象在近30年的时间里实现了质的飞跃：从一个经济落后、军人专制、南北对峙的形象,转变为以经济发达、政治民主、南北和解、活力动感等为主要内容的新形象。韩国经验的启示在于：一,国家形象提升的基础是国力的提升,对外传播工作的实质是把这一情况适时准确地告知传播对象;二,国家形象的定位要与国家的发展战略方向一致,由适当的机构统筹协调国家形象建设工作,切实贯彻国家的发展战略和与此相辅相成的国家形象战略;三,对外传播要以传播对象为本,充分考虑外国人的真实感受,针对传播对象的特性选择最有效的沟通方式;四,充分发挥跨国企业在国家形象建设中的积极作用。

收入分配问题是社会各界普遍关注的热点和焦点问题,它事关人民群众生活是否幸福安康和能否维护尊严,关乎改革开放成果能否由广大人民群众共享,也关系到社会是否和谐、公平和正义。进一步改革完善收入分配制度,要完善市场经济体制,实现收入分配相对公平;要完善税制,缩小社会收入分配差距;要消除行政性行业垄断,控制垄断行业收入;要完善基本公共服务均等化和社会保障制度;要解决我国城乡居民收入分配差距。     

嬗变与飞跃：农村基层民主建设的新成就

党的十七大以来我国农村基层民主建设在制度、观念和实践三大层面上取得了新进展。同时，在中国发展农村基层民主是一大创举，有一个发展过程，在这一过程中不可避免地存在一些问题。在当前深入推进农村基层民主建设，重要的是要实现党内民主与人民民主的良性互动，把尊重人民群众首创精神同加强和改善党的领导结合起来，要坚持走制度化、规范化的发展路径。     

The Leaderless Nexus: When Crime and Terror Converge

This article argues that the breakdown of hierarchical structures in illicit organizations is creating new opportunities for criminals and terrorists to collaborate. The rise of networked organizations has given greater independence to criminals and terrorists who previously answered to a clear chain of command. These members are now willing to engage in operations that before had been off-limits because the leadership believed the activity would hurt the organization's broader mandate. The result is that a “leaderless nexus” is beginning to emerge between criminals and terrorists. The phenomenon has far-reaching and dangerous implications for U.S. security, and should be thoughtfully considered as lawmakers debate homeland security reform.

Die grundbücherliche Anmerkung der schriftlichen Zusage der Einr?umung von WE an den WE-Bewerber durch den WE-Organisator ist auch für erst zu schaffende WE-Objekte (hier: durch Teilung bestehender Objekte sowie Dachbodenausbau) zul?ssig. In diesem Fall sind die Objekte m?glichst genau, idR durch Bezugnahme auf den beh?rdlich genehmigten Bauplan, zu bezeichnen, ohne allerdings allzu strenge Anforderungen an den "Nachweis" der Identifizierbarkeit (hier: lokale Beschreibung ausreichend) zu stellen. Nach § 40 Abs 2 WEG 2002 muss die Zustimmung des Grundeigentümers zur grundbücherlichen Anmerkung der Zusage nicht mehr ?ffentlich beglaubigt sein.     

Bundesstaat und Gleichheitsgrundsatz

Gleichheit und Bundesstaatlichkeit stehen in einem Spannungsverh?ltnis. Nicht nur, dass die von der Bundesstaatstheorie geforderte "arithmetische Gleichheit" angesichts realpolitischer Disparit?ten zwischen den Gliedstaaten in der Praxis kaum durchsetzbar ist, sondern auch die im Wesen des bundesstaatlichen Prinzips gelegene f?derale Differenzierung der einzelnen Landesrechtsordnungen birgt Sprengkraft in sich. Der vorliegende Beitrag geht der Frage nach, in welchem Verh?ltnis Bundesstaatlichkeit und Gleichheitsgrundsatz zueinander stehen. Dabei wird auch untersucht, welche Auswirkungen die Einbindung ?sterreichs in die Europ?ische Union auf dieses Verh?ltnis hat.
