Der Beitrag besch?ftigt sich mit jener Rolle, die der Rechtsprechung bezüglich der Weiterentwicklung des ?sterreichischen Wohnrechts zukommt. Er zeigt ua die praktische Bedeutung auf, die der richterlichen Rechtsanwendung und Rechtsfortbildung in diesem Bereich zukommt, thematisiert die Frage, ob es in der wohnrechtlichen Rechtsprechung zu "Grenzverwischungen" zwischen Rechtsanwendung und Rechtspolitik kommt und analysiert charakteristische St?rken und Schw?chen von richterlicher Rechtsfortbildung im Wohnrecht.     

Institutional Collective Action on Drugs: Functional and Vertical Dilemmas of Unused Pharmaceuticals

The authors use the Institutional Collective Action Framework to analyze the barriers, opposition, and opportunities for residential pharmaceutical disposal programs in the United States via a case study on a series of take‐back programs pioneered in the state of Washington by local and state governments, as well as the corresponding backlash from federal agencies. While successful in some ways, these innovative solutions directly challenged the competing federal policy regimes controlled by the Drug Enforcement Agency (DEA), and, to a lesser extent, the Environmental Protection Agency (EPA). Findings from case studies suggest that functional dilemmas created by existing institutions with entrenched regulatory regimes are a key challenge to finding efficient solutions to vertical ICA dilemmas. Conclusions, then, connect to the broader ICA research agenda, and implications for multi‐level governance issues.     

Analyzing Territorial and Sectorial Dimensions of Public–Private Partnerships in Science,Technology, and Innovation policies

The performance of innovation systems depends, to a great extent, on the degree of public–private collaboration they involve. Thus, innovation policies often aim to enhance this collaboration through public–private partnerships. These partnerships are a multidimensional phenomenon whose success depends on factors related to each of their dimensions. This paper proposes the use of an analytical model that reflects the multidimensional nature of public–private partnerships and analyses to what extent they are applied in a specific innovation system in order to identify the territorial and sectorial factors that act as barriers or drivers to use them. This model aims to help policy makers design appropriate public–private partnerships in each context. The case under review is the Spanish innovation system, given that this system has been suffering from a structural lack of collaboration for several decades, despite the implementation of policies aimed to foster this. Thus, if the model works, it should be able to identify key factors that influence greater or more restricted use of the different PPP formulas.     

公安机关办理拒不支付劳动报酬案件应注意的问题

《中华人民共和国刑法修正案（八）》增设了拒不支付劳动报酬罪,为保护劳动者的合法薪酬权益和打击拒不支付劳动者报酬的行为提供了明确的刑事法律依据。作为新设罪名,公安机关应重点关注其中的新内容。在审查拒不支付劳动报酬案件的立案材料时,应当重点审查是否具有劳动行政部门要求用人单位支付劳动报酬的《劳动保障监察行政处理决定书》或者行政复议机关要求用人单位支付劳动报酬的《行政复议决定书》。对＂经政府有关部门责令支付仍不支付＂不能仅按字面意思简单理解,而是应当参照劳动保障行政部门或行政复议机关申请人民法院强制执行的条件对其作出认定;应以我国劳动法律法规为基础理解＂劳动者＂的范围。     

Keine Adoption durch Lebensgefährtin der Mutter

§ 182 Abs 2 ABGB hindert generell, also nicht nur im Falle gleichgeschlechtlicher Lebenspartner, die Adoption durch einen Mann, solange die verwandtschaftlichen Beziehungen zum leiblichen Vater, bzw durch eine Frau, solange die verwandtschaftlichen Beziehungen zur leiblichen Mutter bestehen. Gem § 182 Abs 2 ABGB ersetzt also der Einzeladoptierende nicht den Elternteil seiner Wahl, sondern jenen, der seinem Geschlecht entspricht. Die Adoption des Kindes durch die Lebenspartnerin der leiblichen Mutter ist daher rechtlich unm?glich. Art 8 und 14 MRK werden dadurch nicht verletzt.     

锌与维生素A对隐孢子虫感染小鼠免疫功能的影响

为探讨锌和维生素A对隐孢子虫感染小鼠免疫功能的影响,将75只清洁级昆明小鼠随机分成5组,各组均饲喂基础日粮。其中Ⅰ组和Ⅴ组不添加锌和维生素A,Ⅱ组以饮水方式添加锌(38.5μmol/mL),Ⅲ组以灌喂的方法添加维生素 A(400 IU/只),Ⅳ组添加锌和维生素 A,Ⅰ、Ⅱ、Ⅲ、Ⅳ组均在试验开始时灌喂小型隐孢子虫卵囊( 2.56×106/mL),Ⅴ组作为不接种对照。试验结果,Ⅱ、Ⅲ、Ⅳ组小鼠的粪便排卵量和排卵持续时间分别显著低于Ⅰ组(P<0.05);在试验的第 2 周和试验结束时,Ⅱ、Ⅲ、Ⅳ组小鼠血液中CD4、CD8细胞百分率以及CD4/CD8比值均极显著高于Ⅰ组(P<0.01)。表明,锌和维生素A均能够增强小鼠的细胞免疫功能,提高机体抗隐孢子虫感染的能力。

GAMarker基因分型专家系统的设计与实现

目的DNA基因分型软件是DNA检测技术体系不可缺少的一环,为拓展GA118系列遗传分析仪器的应用,须研制一套DNA基因分型专家系统,以满足法庭科学DNA检验鉴定工作的需要。方法基于已掌握的DNA片段定长和基因分型数据处理解决方法及相关核心算法,使用JAVA语言和MYSQL数据库,利用Maven进行项目管理,经对GA118系列、ABI系列数据文件解析和数据分析,研发了专家系统GAMarker。结果该系统实现了样本和数据呈现、样本分析要素质量评估、分析方法管理、分型结果展示和人工核查、电泳数据审查、生成分析报告、系统安全等功能,并可分析8色荧光数据。结论GAMarker可进行软件设定、数据分析与比对、图谱查看与编辑,是一套完整的DNA片段分析流程和直观的数据审核工具,可代替国外产品、有效支撑国产遗传分析仪相关系列型号的数据分析,能满足侦破案件、DNA数据库建设的需要。

在我国的刑法条文中,有相当一部分内容体现了刑法的谦抑性,与此同时,我们也不可忽略一些与刑法的谦抑性不符的规定,尤其是刑法修正案（八）出台后,出现了颇多争议。刑法的谦抑性,作为刑法的价值追求之一,对于建设社会主义法治国家具有重要意义。
