"新刑诉法"中诸多涉及侦查行为的规则变化,迫切需要确立新的侦查观。新的侦查观的规范基础包括:侦查任务的增加,影响侦查行为的主体职能(作用)和范围扩大,以及侦查活动变化与延伸。其中,增加尊重和保障人权任务,要求侦查人员充分理解尊重和保障人权的主体、原因以及路径。检察院、法院、辩护人、利害关系人等诉讼参与人,对侦查行为的影响方式和程度虽有不同,但都明显挑战与突破了传统侦查观,而身处侦查行为空间领域变化与延伸的侦查人员,则更能直接体验到新侦查观的现实意义。     

应急警务措施运行中人权保护分析

应急警务措施运行中的人权保护是公安机关应对突发事件的重大现实问题,也是人权保护的重要理论问题。从学理上分析,应急警务措施具有行政紧急与紧急强制的属性,并具有紧急程度大、强制程度高、意思自治强、自由裁量权大等特征;应急警务措施的运行中由于价值诉求的偏差导致公共秩序与公民权利之间的冲突。因此,应急警务措施的运行要正确处理好公共秩序的维护与公民权利保障之间的平衡关系,实现社会管理状态的"零缝隙"对接,严格控制侵益性警务措施的适用规模、时限,并建立有效的监督机制,克减"蝼蚁溃堤"。     

论我国的审前羁押制度——以新《刑事诉讼法》的施行为背景

2013年1月1日起施行的新《刑事诉讼法》规范了强制措施的适用,加强了对公民权利的保护。其中,对逮捕的必要性进行了细化,同时增加规定了人民检察院审查批准逮捕时讯问犯罪嫌疑人和听取辩护律师意见的程序。但是,新《刑事诉讼法》关于审前羁押制度的规定还有很多方面有待完善。     

中国签署国际人权两公约的背景及意义

中国于１９９７年和１９９８年,先后签署了联合国国际人权两个公约。这是中国为实现联合国尊重人权的宗旨和原则作出的又一重要贡献,在中国及世界人权发展史上都具有重大意义。这一举动再次向国际社会表明中国认同人权问题上的共同国际准则的态度以及中国重视开展人权领域国际合作的诚意。它有利于进一步健全中国的人权保障机制和提高人权保障水平
