面向机遇与挑战并存的“十四五”时期,重构中国区域经济格局对实现更高质量、更具效率、更加公平的发展具有里程碑式的意义。从国家、区域、城市、县域四级空间尺度出发,以“整体分散,优势集中”为行动指南展望新时代区域协调发展新格局。在国家尺度下,在集中力量缓和东西失调、南北分野以促进国内大循环的同时,以“一带一路”为牵引融入国际大循环。在区域尺度下,打造京津冀城市群、长三角城市群、粤港澳城市群、长江中游—中原城市群、成渝城市群五大核心增长极,助力沿海经济带与长江经济带建设、黄河流域生态保护与高质量发展。在城市—县域尺度下,抓好国家中心城市、区域中心城市的培育工作,激发县域经济活力。在此基础上,融通国家、区域、城市、县域四级尺度,共同引领“普遍沸腾”。     

‘Notice and staydown’ and social media: amending Article 13 of the Proposed Directive on Copyright

ABSTRACT

This paper critically assesses the compatibility of content recognition and filtering technology or so-called notice and staydown approach with the right of social network platforms and users to a fair trial, privacy and freedom of expression under Articles 6, 8 and 10 of the European Convention on Human Rights (1950) (ECHR). The analysis draws on Article 13 of the European Commission’s proposal for a Directive on Copyright, the case-law of the Strasbourg and Luxembourg Court and academic literature. It argues that the adoption of content recognition and filtering technology could pose a threat to social network platforms and user human rights. It considers the compliance of ‘notice and staydown’ with the European Court of Human Rights’ (ECtHR) three-part, non-cumulative test, to determine whether a ‘notice and staydown’ approach is, firstly, ‘in accordance with the law’, secondly, pursues one or more legitimate aims included in Article 8(2) and 10(2) ECHR and thirdly, is ‘necessary’ and ‘proportionate’. It concludes that ‘notice and staydown’ could infringe part one and part three of the ECtHR test as well as the ECtHR principle of equality of arms, thereby violating the rights of social network platforms and users under Articles 6, 8 and 10 of the Convention.

Developing a Model Intervention to Prevent Abuse in Relationships Among Caribbean and Caribbean-American Youth by Partnering with Schools

SUMMARY

This paper proposes a model intervention to prevent relationship abuse among Caribbean and Caribbean-American adolescents. Specifically, the model partners with a high school with a strong Caribbean student population and incorporates education, prevention and intervention, as the three core components. This paper highlights the importance of working with young people in a school setting, working with young people before they have fully tackled the developmental task of defining norms of and values in relationships, utilizing culturally competent staff and specialized programming, and emphasizing the need for early intervention in the instances of adolescent relationship violence before its evolution into adult domestic violence. The model proposed serves as an outline for further development of culturally-specific and competent interventions to prevent and address relationship violence among adolescents.     

伪狂犬病病毒Ea株UL14基因的真核表达和功能域分析

通过PCR方法扩增伪狂犬病病毒(PRV)Ea株UL14基因,克隆到pEGFP-C1载体中,构建EG-FP-UL14融合的真核表达质粒pEGFP-UL14。将pEGFP-UL14转染Hela细胞,并与对照质粒pEGFP-C1进行比较,发现EGFP-UL14融合蛋白在转染后第48小时荧光主要分布在胞浆,但随着时间的延长,荧光逐渐向细胞核中转移,在转染后第72小时完全定位于核中。为进一步分析UL14蛋白的细胞定位功能域,构建了一系列UL14C-端、N-端缺失突变体。将上述突变体分别与EGFP融合,构建了UL14不同区域与EG-FP融合的重组表达质粒,分别转染Hela细胞后,证实UL14的第37～65位氨基酸对其细胞定位具有重要作用。研究结果为进一步阐明PRV UL14的功能奠定了基础。     

论嫖宿幼女罪之司法适用

嫖宿幼女与奸淫幼女型的强奸是一种想象竞合,在一个行为同时符合两罪的犯罪构成时就应该从一重处罚。嫖宿幼女罪保护的是幼女之身心健康与社会管理秩序之双重法益,特别是嫖宿行为中支付嫖资的情节并非其减责事由,因为这种情节既不是违法性减轻事由（所保护的法益并未因此受到较小之侵害）,也不是责任减轻事由（行为人之主观恶性并未有任何降低）。相反,这种给付嫖资的行为恰恰是一种容易引起社会之仿效的加重处罚理由。因此,对于嫖宿幼女罪的司法适用,不论从法律解释、立法目的还是其与强奸罪的关系来看,都有其单独存在之合理与必要。     

Privacy,Data Retention and Domination: Digital Rights Ireland Ltd v Minister for Communications

In Digital Rights Ireland Ltd v Minister for Communications, the European Court of Justice found the EU Data Retention Directive, which required the retention of communications data for up to two years, to be incompatible with Articles 7 and 8 of the EU Charter of Fundamental Rights – the rights to privacy and to the protection of personal data. It is argued in this note that the decision ought to be taken as one that is concerned with the exercise of arbitrary power, a concern that is captured by the concept of domination.     

Inhuman and Degrading Punishment,Dignity, and the Limits of Retribution

The recent judgment of the Grand Chamber of the European Court of Human Rights (ECtHR) in Vinter and others v United Kingdom provides a much needed clarification of the parameters of the prohibition on inhuman and degrading punishment under Article 3 of the European Convention on Human Rights (ECHR) as it applies to whole life orders of imprisonment under mandatory life sentences – essentially, life imprisonment without parole. The Grand Chamber's judgment refines Strasbourg doctrine on life imprisonment and the prospect of release and illuminates key principles concerning inhuman and degrading punishment under Article 3 of the ECHR. This article considers the judgment's profound significance in relation to both human rights and penology.     

“十四五”时期我国社会救助制度改革的目标与任务

“十四五”时期我国完成现阶段脱贫攻坚任务后将开启以解决相对贫困问题为目标的新的贫困治理阶段,社会救助制度在此期间应该发挥更加积极的作用。本文在总结“十三五”时期我国社会救助发展成绩和短板的基础上,提出了“十四五”时期社会救助改革与发展的基本目标和主要任务。本文认为,“十四五”时期社会救助应该转向以治理相对贫困为目标,继续提高社会救助的公平性,着眼于更高的社会效益和运行效率。为此,“十四五”时期应该提升社会救助的贫困识别标准,扩大社会救助的行动体系,优化社会救助制度体系,加强服务救助体系建设,并加强和优化社会救助的管理体系。     

中国人口老龄化对经济发展的影响机制及对策研究

人口老龄化与少子化已经成为我国人口结构的基本特征，将对我国经济高质量发展产生深远的影响。最新公布的全国第七次人口普查数据显示我国人口老龄化呈现四个特征：人口老龄化省际差异大、未来会加速进入深度老龄化社会、城市人口老龄化问题更加严重以及“未富先老”等。人口老龄化会通过影响劳动力供给、社会资本形成以及技术创新三个方面影响经济发展。“十四五”期间积极应对人口老龄化，需要“放大”其对经济发展的正面效应，“缩小”负面效应，实行一揽子政策,从三个方面着手，分别是：增加全社会劳动力供给以及挖掘人口“二次红利”、通过不同渠道养老资金的统筹安排促进全社会资本形成以及通过拉动消费促进产业结构升级与技术创新。
