中国古代史研究21世纪展望--"21世纪中国历史学展望学术讨论会"中国古代史组讨论纪实

2002年5月云南大学召开了"21世纪中国历史学展望学术讨论会",这是进入21世纪以后中国历史学界的一次盛会。与会专家学者对20世纪的中国历史学研究进行总结,畅谈了对21世纪中国历史学的展望。中国古代史组的专家学者们在研讨中,提出一些重要的学术见解和改革建议。这对今后中国古代史的学科发展乃至整个中国历史学的发展,都将具有重要意义。     

From the Streets to the Screen: Sex Work,Stigma, Desire and Covid-19 in Mexico City

This article explores how the labour practices of sex workers in Mexico City have been affected by Covid-19. More specifically, it analyses (a) how the pandemic increases the stigmatisation of sex workers; (b) the causes that prompted Mexican sex workers to resort to erotic online platforms; (c) the advantages and disadvantages of online sex work; (d) the forms of mutual support sex workers in Mexico City offer each other in order to familiarise themselves with this new modality of work. Thus, this study provides the basis for analysis of sex work, stigma and desire in the context of Covid-19 in Mexico.     

The Soviet study of the Barefooted Flight of the Kazakhs

The defeat, devastation and exile of the Kazakhs in the early eighteenth century, commonly known as the Barefooted Flight, was the nation's most distressing pre-Soviet calamity. Kazakh nation-building and official remembrance projects – commemorated in state ceremonies, public education and popular culture – portray an uninterrupted, centuries-old practice of tribute to local heroes who challenged the foreign aggressors. Twentieth-century Kazakh and Russian intellectuals in the Soviet and post-Soviet eras studied and enshrined these events based on published, secondary sources, rarely giving attention to the thin trail of documents preserved in state archives. The historiography of the Barefooted Flight exposed a trend in how politically convenient historical lessons shaped the interpretation of events. By the end of the Soviet Union, some archival material was introduced, it was but misquoted so as not to challenge the current interpretation.     

How to not speak the ‘F‐word’: Federalism between mirage and imperative in the euro crisis

The recent financial and debt crisis has resuscitated the debate about European federalism – a theme that seemed not to have survived the painful constitutional adventure that ended with the ratification of the Lisbon Treaty in 2009. With the adoption of significant policy and institutional measures for tightening macroeconomic and budgetary coordination (including a constitutionally enshrined debt brake), the reforms of the monetary union have undisputedly brought the European Union further on the path towards an ever closer union. In an era where EU integration has been increasingly politicised, and Euroscepticism has been on the rise and exploited by anti‐system parties, national leaders have to face a political hiatus and respond to increased needs for symbolic and discursive legitimation of further federalisation. This is all the more crucial for French and German leaders who have brokered the main decisions during the crisis of the eurozone. Against this background, the purpose of this article is not to assess whether, or to what extent, the recent reforms of economic and monetary union have made the EU more federal. Rather, the purpose is to tackle the following puzzle: How have EU leaders legitimised the deepening of federal integration in a context where support for more European federalism is at its lowest? To elucidate this, a lexicographic discourse analysis is conducted based on all speeches held by the German Chancellor Merkel and the two French Presidents Sarkozy and Hollande, previous to, or after European summits from early 2010 until the spring of 2013. The findings indicate that federalism is both taboo and pervasive in French and German leaders' discourse. The paradox is barely apparent, though. While the ‘F‐word’ is rarely spoken aloud, two distinctive visions co‐exist in the French and German discourse. The coming of age of a political union through constitutional federalism is pictured as ineluctable, yet as a distant mirage out of reach of today's decision makers. At the same time, the deepening of functional federalism in order to cope with economic interdependence is a ubiquitous imperative that justifies further integration. The persisting gap between the constitutional and the functional vision of European federalism has crucial implications. Insofar as the Union is held responsible for not delivering successful economic policy, political leaders will fail to legitimise both functional and constitutional federalism.     

广东汉族人群H19基因上游差异甲基化区SNP

目的调查广东汉族人群中H19基因上游差异甲基化区(differentially methylated region,DMR)的单核苷酸多态性(SNP)及单倍型。方法应用PIA分型法,以限制性内切酶Mcr BC、HpaⅡ消化基因组DNA分别获得个体单亲源DNA模板链,经测序,分别获得个体H19基因上游DMR单亲源SNP等位基因、基因型及单倍型数据。结果共检出13个SNP(rs10840167、rs2525883、rs12417375、rs4930101、rs2525882、rs2735970、rs2735971、rs11042170、rs2735972、rs10732516、rs2071094、rs2107425、rs4930098)及1个突变点(g7351c)。所有位点经统计学分析均符合Hardy-Weinberg平衡定律(P0.05)。除rs12417375位点DP值为0.279,其余12个SNP DP值在0.446~0.614;g7351c突变点DP值为0.013,提示为南方汉族民族特异性位点。共检出8种单倍型(命名为单倍型1~8),其中有3种为新发现的单倍型,其DP、PIC、PE及H分别为0.891、0.714、0.524和0.758。结论 PIA分型法获得的H19基因上游DMR SNP位点及其单倍型遗传标记系统具有较高的鉴别能力,在法医学鉴定中具有较好的实用价值。     

Gendered electoral systems in the French Sénat

A longstanding but contested hypothesis in political science suggests that proportional (rather than majoritarian) electoral systems tend to increase the share of legislative seats held by women. While scholars have used a variety of empirical methodologies to test this hypothesis, they have mostly neglected legislatures where different parts of the country use different electoral systems. This note looks at women’s election to the longest-established legislative body using such a mixed electoral system: the upper house of the French parliament, the Sénat, where high-population constituencies use proportional elections but low-population constituencies use a majoritarian system. Among elections to the Sénat from 1959 to 2014, regression estimates indicate that women’s share of seats is approximately 10 percentage points higher in proportionally allocated elections, all else being equal. This finding both contributes to the literature linking gender to electoral systems and shows the potential value of considering understudied institutions.     

Verspätete Hinterlegung des beim RA eingegangenen Betrages und Aufrechnung mit dem Honoraranspruch

§ 19 RAO regelt das Aufrechnungsrecht des Rechtsanwalts gegenüber seinem Mandanten nicht abschlie?end. Diese Norm l?sst somit das allgemeine Kompensationsrecht nach den §§ 1438 ff ABGB unberührt. Diese allgemeinen Aufrechnungsregeln finden somit bei Auslegung des § 19 Abs 1 RAO und damit auch bei Beurteilung des vom Rechtsanwalt ausgeübten Aufrechnungsrechts Anwendung, soweit dem nicht die Besonderheiten des Bevollm?chtigungs- und Auftragsvertrags entgegenstehen. Sind Richtigkeit und H?he der Honorarforderung bestritten, so ist der Rechtsanwalt nach § 19 Abs 3 RAO "zu seiner Deckung" befugt, die bei ihm eingegangenen Gelder bis zur H?he der bestrittenen Forderung gerichtlich zu erlegen. Macht er von der Befugnis zum Gerichtserlag nicht Gebrauch, besteht die Verpflichtung, die Betr?ge unverzüglich auszufolgen. Eine versp?tete gerichtliche Hinterlegung l?sst die Berechtigung zur Geltendmachung des bestrittenen Honoraranspruchs durch prozessuale Aufrechnungserkl?rung ab dem Zeitpunkt der Hinterlegung des zuvor eingegangenen Geldbetrags unberührt. Sobald der Rechtsanwalt für seinen Mandanten von einem Dritten entgegengenommene Geldbetr?ge nach Bestreitung seiner Forderung aus dem Mandatsverh?ltnis gerichtlich hinterlegte, steht § 19 Abs 3 RAO daher einer prozessualen Aufrechnungseinrede des Rechtsanwalts im Rechtsstreit über die Verpflichtung zur Ausfolgung jener Betr?ge nicht (mehr) im Weg.

Zum Eintrittsrecht des homosexuellen Lebensgefährten in den Mietvertrag

Kürzlich hat der OGH das Eintrittsrecht des homosexuellen Lebensgef?hrten in den Mietvertrag unter Berufung auf die MRK-konform vorzunehmende Auslegung des § 14 Abs 3 MRG grunds?tzlich anerkannt. Der folgende Beitrag setzt sich n?her mit der aktuellen Entscheidung unter Berücksichtigung der Vorjudikatur und des neueren Schrifttums auseinander und bezieht dazu ausführlich Stellung.     

Wohnungsrückstellung "neu ausgemalt weiß" gebührenschädlich

Die Verpflichtung des Bestandnehmers, bei Beendigung des Bestandverh?ltnisses "die Bestandseinheit neu ausgemalt wei?" zurückzugeben, stellt eine Leistung des Bestandnehmers dar, die zum Wert (mithin zur Gebührenbemessungsgrundlage) hinzuzurechnen ist. Gleiches gilt für die Verpflichtung zum Abschluss eines W?rmeenergiebezugsvertrages.
