20世纪各国死刑废除运动的回顾及评述

死刑废除运动是进入20世纪以来世界范围内一项十分引入注目的问题,回顾和总结上个世纪死刑废除运动的历程和经验,是正确认识死刑废除运动的发生、发展及未来前景的重要课题。本文从法制史的角度,对世界范围内20世纪废除死刑运动的基本情况作了回顾和总结,并得出了几点启示,以期有助于目前对死刑废限问题的讨论。     

Keine Verordnungserlassung durch Kollegialbehörde mit richterlichem Einschlag (Übernahmekommission)

Kollegialbeh?rden mit richterlichem Einschlag sind verfassungsrechtlich nicht zur Verordnungserlassung befugt (teilw Abgehen von Vorjudikatur). Die Ausnahme in Art 133 Z 4 B-VG von Verwaltungsbeh?rden aus dem Weisungs- und Verantwortungszusammenhang mit obersten Organen stellt nur auf Beh?rden ab, die blo? zur Erlassung individueller Verwaltungsakte erm?chtigt sind. Die Verordnungserm?chtigung in Art 18 Abs 2 B-VG stellt auf den verfassungsrechtlich (hier durch Art 20 Abs 2 und Art 133 Z 4 B-VG) abgesteckten Wirkungsbereich der Verwaltungsbeh?rde ab. Die Zust?ndigkeit einer weisungsfreien Beh?rde zur Verordnungserlassung würde die Leitungsbefugnis oberster Organe beeintr?chtigen und w?re im Hinblick auf fehlende parlamentarische Kontrolle aus demokratischer Sicht bedenklich.     

Children in the 20th-century family economy: From co-providers to consumers

The position of children in the family economy changed fundamentally from the 19th century onward. In the Netherlands, the first child labor act was introduced in 1874; compulsory schooling was established in 1901. Since then, the economic contribution to the family income by children has gradually disappeared. Until the 1960s, in working-class families, the financial contribution of adolescents to the family income remained of great importance. Young workers gave their whole wage to the family in exchange for housing, food, clothes, and some pocket money. This article describes how the economic role of teenagers has changed since then. Nowadays, children and adolescents do not contribute to the family purse any longer.     

Pig Organ Energy Loss Comparison Experiments Using BBs

Torso models for ballistics research require that the mechanical properties of simulant materials must match the heterogeneous nature of tissues/organs within the human thorax/abdomen. A series of energy loss experiments were conducted on fresh porcine organs/tissues at room temperature and 37°C, using steel 4.5 mm BBs fired from a Daisy^® brand air rifle. They were compared to FBI and NATO specification ordnance gelatin and a candidate surrogate material called Simulant “A”. Two CED M2 chronographs measured BB velocity. The resulting energy loss was established using KE = 1/2 mv² before and after target perforation. The combined results at room temperature and 37°C were as follows: FBI specification gelatin was similar (p > 0.05) to heart and lung, spleen was similar to NATO specification gelatin, Simulant “A” was similar to hindquarter muscle, and hindquarter muscle, kidney, and spleen were similar to each other regarding energy retardation. These results can be used as a basis for the development of simulant materials to create an anatomically correct heterogeneous model.

本文试图从"跨政府网络"的角度探讨G20的治理模式,分析G20治理的动力、方式和成果.在世界面对气候变化与金融危机两大挑战之际,作为全球治理核心的G20通过跨政府网络的治理模式,为世界主要经济体的国内规则制定者和政府官员搭建了对话和非正式协调的平台,进而通过与国际组织的互动,实现对相关议题的治理.以"跨政府网络"为基础而达成的自愿性协议及公报,克服了需要长期谈判及国内批准的条约模式的限制,反映了G20在应对全球问题时的灵活性及迅速调动资源的能力.     

One in 20: the G20, middle powers and global governance reform

There is a growing consensus that the international system needs to be reformed to reflect the changing distribution of power with the rise of the Brazil, Russia, India and China (BRICs). The Group of Twenty (G20) has been at the centre of these discussions. Within the G20, emphasis has been on great powers or rising powers and their capacity to drive reform. Less attention has been given to the preferences and strategies of middle powers in the G20 and their capacity to shape global governance reform. Drawing on interviews with G20 officials, this paper considers the role of Australia as president of the G20 in 2014. Australia’s presidency presents a unique opportunity to examine the behaviour of a middle power as it balances the competing global governance claims of the USA and the BRICs.

20年来,中国—东盟关系走过了从消除疑虑、开展对话、增进互信到建立战略伙伴关系的不平凡的历程,成为南南合作的典范。尽管当前的中国与东盟关系还面临诸多挑战,但随着双方政治互信的增加、相互依赖的增强、安全合作的深化,未来的中国与东盟合作必将进一步走向成熟和共赢。     

以党的二十大精神引领劳动教育高质量发展——中国劳动教育100年的总结与展望

劳动教育对于中国式现代化具有基础性、战略性支撑作用。回眸历史,中国百年劳动教育的发展经历了萌芽起步、探索推进、稳步发展、创新飞跃四个阶段,分别呈现出为政治动员服务、为生产建设和阶级斗争服务、为经济发展服务、为素养教育服务的价值侧重。总结百年历史演变,劳动教育在发展完善过程中,始终将党的科学理论作为指导思想、将时代的迫切需要作为发展方向、将多样的教育形式作为重点要求,这为劳动教育的继续开展提供了借鉴。展望未来,在剖析劳动教育发展的复杂形势和根本任务的基础上,应明确劳动教育的地位、确立人全面发展的价值目标、坚持劳动与教育相结合的本质底色、构建多方共育的教育格局,从而发挥劳动教育在实现中国式现代化中的重要支撑作用,为中国式现代化培根、筑基、育人。     

Die Genossenschaftswohnung in der Exekution

Nachdem der OGH bereits in zwei Entscheidungen die Verwertung eines Kleingartenhauses und einer Genossenschaftswohnung im Konkurs trotz § 5 Abs 4 KO gebilligt hatte, hat er nunmehr in einer neuen Entscheidung die Verwertung einer Genossenschaftswohnung im Exekutionsverfahren – wenn auch mit Einschr?nkungen – für zul?ssig erkl?rt. Der vorliegende Beitrag stellt die Entscheidung vor und untersucht einige sich hier stellende Folgeprobleme.

20世纪日本流行语所反映的日本青年群体的偏差行为,不仅是相对于整个日本社会的思想、行为规范的偏差,而且是相对于绝大多数年轻人正统思想、行为的一种偏差。流行的是一种新奇或变异,而不是一种普遍的规则现象。所以从这一角度上说,不能把某一时期的流行语所反映的现象等同于特定时期整个日本青年的群像。
