Durchsetzung von Rechnungslegungsansprüchen gegen den verwaltenden schlichten Miteigentümer im Außerstreitverfahren nach § 838a ABGB

In das Au?erstreitverfahren nach § 838a ABGB idF FamErbR?G f?llt seit 1. 1. 2005 die Durchsetzung der mit der gemeinschaftlichen Verwaltung und Benützung "unmittelbar zusammenh?ngenden Rechte und Pflichten" der Miteigentümer, somit jedenfalls die Auseinandersetzungen nach den §§ 833 bis 838 ABGB. Dazu z?hlen daher Rechnungslegungsansprüche gem § 837 ABGB gegen einen Miteigentümer, der die gemeinschaftliche Verwaltung mit allen Rechten und Pflichten eines Machthabers iSd §§ 1002ff ABGB besorgt. Zur Umdeutung einer Klage in einen verfahrenseinleitenden au?erstreitigen Antrag bei Zweifeln über die richtige Verfahrensart gem § 40a JN.     

Eintragung eines Bestandrechts ins Grundbuch – dingliche Wirkung der "Einverleibung"?

Zwar spricht § 19 GBG von der "Einverleibung oder Vormerkung von Bestandrechten" und § 1095 ABGB beim eingetragenen Bestandvertrag von einem dazu gewordenen "dinglichen Recht". In Wirklichkeit ?hnelt aber die grundbücherliche Eintragung eines Bestandrechts eher einer Anmerkung; ihre Rechtsfolgen beschr?nken sich – und zwar blo? im Verh?ltnis zwischen Bestandgeber und Bestandnehmer ohne allgemeine dingliche Wirkung gegenüber Dritten! – auf § 1120 und § 1121 ABGB.     

Politics and Corporate‐Sector Environmentally Significant Actions: The Effects of Political Partisanship on U.S. Utilities Energy Efficiency Policies

This study assesses the direct, indirect, and total impacts of political partisanship on state‐level utilities' investment in energy efficiency. This subject is of utmost importance because energy efficiency improvement has become a linchpin in worldwide efforts to combat climate change and other environmental challenges. Analysis of data on 51 electric utilities nested within 31 U.S. states indicates that political partisanship influences utilities' energy efficiency policies. There is strong evidence that electric utilities in states dominated by the Republican Party are less likely to invest in energy efficiency than those in states governed by the Democratic Party. This finding suggests that political partisanship may be shaping the policy and regulatory frameworks put in place by state governments to incentivize or compel the participation of private‐sector entities' in environmental management and/or resource conservation.     

糖尿病肾病血瘀证大鼠铁死亡相关基因GPX4、ACSL4表达水平变化

目的 探究糖尿病肾病(diabetic kidney disease, DKD)血瘀证大鼠肾损害与肾脏铁死亡的潜在机制。方法 将50只SPF级雄性SD大鼠分为对照组、DKD组、DKD血瘀证组。采用腹腔注射链脲佐菌素的方法复制DKD大鼠模型,采用尾静脉注射右旋糖酐的方法复制DKD血瘀证模型。实验过程中观察大鼠血瘀证表现及检测24 h尿蛋白、血清肌酐、血尿素氮、血液流变学指标,采用苏木精-伊红染色、Masson染色、PAS染色观察肾脏的组织形态,采用透射电子显微镜观察铁死亡典型细胞的线粒体变化;采用免疫组织化学法、Western blot法检测肾组织铁死亡相关蛋白[长链酯酰辅酶A合成酶4(Acyl-CoA synthetase long chain family member 4,ACSL4)、谷胱甘肽过氧化物酶4(glutathione peroxidase 4,GPX4)]及肾脏纤维化指标[纤维连接蛋白(fibronectin, FN)、Ⅳ型胶原蛋白(typeⅣcollagen, Col-Ⅳ)]的表达水平。结果 与对照组比较,DKD组大鼠肾脏病理变化加重,线粒体损伤明显,24 h尿蛋白...

阿片依赖患者血清FT3、FT4、TSH浓度变化

观察34例阿片依赖患者血清FT3、FT4及TSH浓度变化，结果显示，FT3、FT4及TSH浓度均明显低于正常对照组（P＜0．01）。说明阿片类毒品对丘脑－垂体－甲状腺轴具有抑制和损伤作用。长期使用阿片类毒品，甲状腺激素水平明显下降，从而产生一系列相应的生理变化和临床表现。     

What Mr. Spock told the earthlings: the aims of political philosophy,action-guidingness and fact-dependency

Abstract

Recently, G. A. Cohen introduced an influential distinction between fact-sensitive and fact-insensitive principles arguing that all basic normative principles are of the latter type. David Miller rejects this claim submitting that the validity of basic normative political principles depends on some general propositions about human nature and societies; for example, that men’s generosity is ‘confined’ and that nature has made ‘scanty provision’ for his wants. Miller ties this view of the nature of basic political principles to the view that political philosophy ought to guide people engaged in real-world politics and claims plausibly that in order to fulfil this purpose, political philosophy must be informed by social science. I argue that Miller neither succeeds in showing that basic principles can be fact-sensitive, nor establishes any connection between the Cohen-Miller disagreement on fact-sensitivity, on the one hand, and the nature and aims of political philosophy, on the other hand.
