Staatenimmunität / Zumutbarkeit der Prozessführung in Tunesien

Ausl?ndische Staaten sind nach allgemeinem V?lkerrecht nur insoweit von der Gerichtsbarkeit der inl?ndischen Gerichte eximiert, als es sich um Akte handelt, die sie in Ausübung der ihnen zustehenden Hoheitsgewalt (acta iure imperii) vorgenommen haben; in Rechtsstreitigkeiten aus Privatrechtsverh?ltnissen (acta iure gestionis) sind ausl?ndische Staaten hingegen auch nach innerstaatlichem Recht der inl?ndischen Gerichtsbarkeit unterworfen. Ausl?ndische Staaten haben ihren allgemeinen Gerichtsstand nicht im Inland. Ihre Vertretung in einem Verfahren vor inl?ndischen Gerichten bestimmt sich nach dem Recht des jeweiligen beklagten ausl?ndischen Staats. Die Anwendung des § 99 Abs 3 JN auf all jene ausl?ndischen Staaten, mit denen die Republik ?sterreich diplomatische Beziehungen unterh?lt, k?me der Schaffung eines allgemeinen Gerichtsstands am Sitz der diplomatischen oder konsularischen Vertretung des ausl?ndischen Staats gleich. Ein solches Verst?ndnis entspricht weder den aktuellen Wertungen des Gesetzgebers noch dem Sinn der strittigen Zust?ndigkeitsnorm, würde es doch in v?lkerrechtswidriger Weise zu einem Eingriff in die Souver?nit?t fremder Staaten führen. Keine Ordination wegen Unzumutbarkeit der Prozessführung in Tunesien gegen den tunesischen Staat.     

Klageeinschränkung im Berufungsverfahren?

Im Berufungsverfahren ist eine Klageeinschr?nkung auf Kosten jedenfalls im Fall einer Beweiserg?nzung in der dafür dienenden mündlichen Berufungsverhandlung zul?ssig.

Der Individualantrag eines Hauseigentümers auf Aufhebung des Mietrechtlichen Inflationslinderungsgesetzes betreffend die ?nderung von Richtwerten ist infolge Zumutbarkeit der Beschreitung des gerichtlichen Rechtsweges in einem mietrechtlichen Au?erstreitverfahren unzul?ssig und daher zurückzuweisen.

Wird der Fahrzeughalter als Insasse des von ihm gehaltenen Kraftfahrzeuges bei einem Verkehrsunfall verletzt, so muss er sich – anders als ein Fahrgast, der nicht Beteiligter im Sinne der §§ 8 und 11 EKHG ist – auf seinen Schmerzengeldanspruch das Verschulden des Lenkers anrechnen lassen.     

黔东苗语“来”义动词lo^4与ta^2语义差异的认知解读

lo^4与ta^2 是黔东苗语中描述某物从别处向说话人靠近的位移动词,即"来"(COME)义动词。二者表达相同观察视角下的同一位移过程,却有不同的意象图式:lo^4所描述的运动事件的动体在社会空间归属上原本就属于观察点(即归来),起、终点在同一个空间内,属单纯的"路径"图式;ta^2 所述运动事件的动体并不属于观察点(即非归来),起、终点分属不同的空间,属起点套叠有容器在内的"容器-路径"图式。二者作趋向补语、结果补语(可能补语)、状态补语以及事态助词时所表达的语义都体现了意象图式投射的差异性。     

A Monte Carlo simulation and sensitivity cost benefit analysis for use of nylon 4N6FLOQSwabs®

Forensic genetic laboratories are challenged with implementing innovation even if the benefits to operational performance are well demonstrated often because of internal budget constraints. A prospective cost–benefit analysis (CBA) could support justification for an increased budget by effectively demonstrating in a system-based approach the relatively small cost of increasing a laboratory budget can substantially reduce costs to society (both qualitatively and monetarily). A Monte Carlo simulation and sensitivity CBA was performed using a more expensive swab (i.e., nylon 4N6FLOQSwabs®) compared with a less costly cotton swab. Ranges of input values and tangible and intangible benefits were considered. The outcome is that the relatively small increased cost of using a nylon swab pales compared with the potential tangible and intangible benefits to the overall system. This approach provides a sounder basis for requesting additional funds to support implementation of technologies and better approximates realistic situations while accommodating uncertainty of input values.     

我国非常夫妻财产制之建构

夫妻财产问题愈渐在亲属法领域受到瞩目,因它兼具身份法与财产法之双重属性之特点,既引发研究者对亲属法基本理论的思考,又引发其对婚姻家庭制度的审视。基于完善我国夫妻财产制之目的,本文立足于《婚姻法司法解释三》1第4条之规定,既肯定其立法意义,又指出该条的立法不足,同时借鉴域外立法的科学合理性,在必要性与可行性基础上对我国非常夫妻财产制度做了简要建构。

A Bridge in Flux: Narratives and the Policy Process in the Pacific Northwest

Policy narratives play an important role in the policy process. Often policy narratives originate from advocacy coalitions seeking increased support from the public for their policy stance. Although most Narrative Policy Framework studies have focused on national policy issues, this study examines a state and local economic development project by exploring the policy narratives from competing coalitions in favor and opposed to the project. Specifically, in the Portland–Vancouver area of Oregon and Washington, local policy discussions have been dominated by a proposal for a new mega bridge on Interstate‐5 connecting the two cities across the Columbia River. A new government agency (CRC—Columbia River Crossing) was formed for the implementation of this project. Upon approval of a proposal, CRC experienced heavy backlash from citizens, local businesses, community leaders, and other stakeholders leading to the formation of two competing coalitions in opposition and support of the bridge. This study, using content analysis of 370 public documents, finds that competing coalitions utilize policy narratives in strategic ways to characterize the opposing coalition, themselves, and other actors in the policy subsystem. This study also suggests that the strength and cohesion of a coalition's narrative contributes to its policy success and the winning/losing status of a coalition potentially determines the types of strategies they will use. Last, this study introduces and tests a new narrative strategy called the impotent shift testing a coalition's strategic use of the victim character.
