第八届全国民事诉讼法学术研讨会综述

本次会议承担了修改《民事诉讼法》的重任,因此,参会代表积极踊跃。通过两天紧张和热烈的讨论,与会代表就《民事诉讼法》修改的必要性、修改的形式、《民事诉讼法》的框架以及具体的诉讼程序等许多重大问题达成了共识。     

制定行政程序法应正确处理的几对关系

影响乃至决定行政程序法的性质、功能、作用和调整范围的问题主要有八对关系:(1)统一法典与单行法;(2)程序法与实体法;(3)规范具体行政行为与规范抽象行政行为;(4)规范外部行政行为与规范内部行政行为;(5)规范行政行为与规范行政救济行为;(6)规范权力性行政行为与规范非权力性行政行为;(7)规范国家公权力行为与规范社会公权力行为;(8)规范行政机关公权力行为与规范其他国家机关公权力行为。     

The Italian Welfare State in the Crisis: Learning to Adjust?

Abstract

After a decade of inertia, that left it unprepared to withstand the blow of the great recession, the Italian welfare state has witnessed significant changes since 2012. Externally driven consolidation in the wake of the sovereign debt crisis spurred yet another wave of social policy reforms after that of the 1990s. These reforms did not however invariably entail retrenchment. Both the Monti and the Renzi governments combined liberalisation with expansion of social rights, particularly in income support. As a result, the Italian welfare state looks more comprehensive than it was before the crisis. At the same time, there was no overall strategy of welfare modernisation based on coordinated social investment measures. The changes in Italian social policy since the outburst of the great recession highlight the importance of domestic politics interacting with external drivers of change. They also facilitate an assessment of the opportunity structures for further reforms in a political system that appears to be veering again towards consensus democracy.

王泽鉴教授把无权处分比喻为民法上的“精灵”,孙毅教授把多重买卖比喻为“潘多拉的魔盒”.“无权处分与一物数卖”专题探讨会上,学者们以《买卖合同解释》对无权处分和一物数卖的相关规定为基础,对“无权处分”和“一物数卖”的相关法律问题进行了分析与总结,对我国司法实践中的棘手问题具有参考意义.     

美国《病人保护和可负担医疗法》的主要内容及启示

美国《病人保护和可负担医疗法》围绕扩大保险覆盖面、强化公共项目、提升医疗质量和效率、提高项目透明和廉正度、加强医疗服务人力资源建设和合理化资金投入等对美国医疗体系进行了全面而深入的变革。美国＂低成本、全覆盖＂的医疗改革可以为中国提供有益借鉴。     

Leadership Styles as Perceived by Career Senior Service Executives

Abstract

This study identifies the prevailing leadership styles of career Senior Executive Service (SES) members of the Federal Government. This study also determines if an association exits between SES member's self‐perceived leadership style and personal characteristics, such as gender, years in the Federal Service, and highest academic degree earned. The study population consists of 6395 career SES members. A random sample of 364 career SES members was selected. The selected group was asked to respond to a demographic data questionnaire and the Styles of Leadership Survey (SLS). Over 34% of the sample completed the instrument and data questionnaire. This study reveals that Strategic Leadership Style (5/5) is the dominant self‐perceived leadership style of career SES members. The personal characteristics of gender, years employed in the Federal Government, and educational attainment were identified as being significant factors influencing leadership styles of Federal Government executives.

充分而公正的市场竞争机制是市场经济健康发展的关键。行政垄断凭借行政权力分割市场,阻碍了全国统一、有序的竞争体系的形成,损害了竞争者和消费者的利益。鉴于行政垄断带来的极大危害,我们必须深刻认识并采取综合性的制度性策略,具体可通过完善市场运行法律以营造和谐竞争环境,完善现行《反垄断法》规定,进一步规范政府行为,并通过加强社会监督等方式来进行全面规制。     

Evidence and Actions on Mortgage Market Disparities: Research,Fair Lending Enforcement,and Consumer Protection

ABSTRACT

In this article, we present an overview of the research on discrimination in mortgage underwriting and pricing, the experiences of minority borrowers both prior to and during the financial crisis, and federal efforts to mitigate foreclosures during the crisis. We next discuss the history of legal cases alleging disparate treatment of minority borrowers, and recent cases alleging disparate impact in the wake of the Supreme Court’s Inclusive Communities decision. Using these discussions as a background, we examine and discuss mortgage regulations issued by the Consumer Finance Protection Bureau following the financial crisis, describe recent developments in the FinTech industry and explore the implications for fair lending policy and minority borrowers more generally. Finally, we draw conclusions and make recommendations for improving the mortgage market outcomes of minority borrowers and increasing minority borrowers’ access to credit.

The Law and Incapacity Determinations: A Conflict of Governance?

This article will consider the highly charged questions raised by two major sets of law reforms in England and Wales, the Mental Capacity Act 2005 and the Mental Health Act 2007, which, although applying to closely related clinical populations, proceeded along entirely separate legislative paths. By justifying its proposals for reform of mental health legislation on the grounds of 'risk', the Government failed to take into account the implications of enforced treatment on patients who may retain decision-making capacity.
