诉讼时效,在大陆法系国家又称为消灭时效。作为民法的一项重要制度,诉讼时效问题直接关系到民事权利能否得到司法上的保护。由于现行法律对诉讼时效的规定不够具体、明确,因而诉讼时效制度的弊端也是显而易见。从这个角度而言,对传统的诉讼时效制度进行重新审视,对诉讼时效的适用范围作出梳理分析,对诉讼时效中断的法定事由进行再认识,对诉讼时效届满后的司法保护及时效利益抛弃等问题进行理性探讨无疑具有重要的现实意义。 相似文献

就管理学领域中关于组织学习的理论进行了比较系统的研究.在彼得·帕沃夫斯基提出的五大类组织学习理论的分类基础上,进一步对每类理论下各种研究视角和研究思路进行了更为系统的规范分析.主要是对管理学中关于组织学习问题研究的各种理论的缘起、分化、进程及现状进行了系统的分析与评价.研究发现,由于学者们对组织学习的本质的看法、研究视角以及研究范式的不同,使得组织学习问题的研究呈现出理论多元化倾向.但近年来,一些从不同角度研究组织学习问题的理论,又正在趋向于新的整合.认为,关于组织学习问题的更为系统的看法,将建立在关于组织学习本质的多元视角而形成的综合观点基础之上. 相似文献

This article examines the role of ethnicity in the formation of political cleavage and is based on the analysis of the political agenda of the Polish national minority in Lithuania after the re-establishment of the independent state in 1990. It analyzes the political performance of the Electoral Action of Poles in Lithuania (EAPL), an ethnic-based “niche” political party that tends to keep a monopoly over the representation of interests of the Polish minority in Lithuania and collects a vast majority of the votes of citizens of Polish origin. The article considers how specific in comparison to the titular nation the interests of the Polish national minority are, and how different in comparison to the political agendas of other political parties the political agenda of the EAPL is. 相似文献

General Zia-ul-Haq’s ambitious Islamization program vis-à-vis gender status in an Islamic Republic remains embedded in the legal system to the detriment of Pakistan’s females. Passage of the Hudood Ordinances of 1979 was a harbinger of things to come as the military junta moved to implement laws perceived to be congruent with Shariah (Islamic) law. This article examines specific discriminatory legal measures, which ensured the reversal of the slow but significant gains made by females since Pakistan’s creation in 1947; and explores how certain draconian measures enacted by Zia’s regime served to mobilize some Pakistani women to political activism. 相似文献

The Programmatic Action Framework (PAF) is a relatively new theoretical perspective that adds a complementary lens to the explanation of policy processes and policy change. Yet, a key requirement of a valid policy process framework is its capacity to be proven wrong. Besides the empirical cases that provide evidence for the occurrence of programmatic action, it is necessary to present examples in which programmatic action did not occur, and to explain why this is the case. Proceeding from the observation that programmatic groups and policy programs existed in French and German health policy throughout the 1990s, this contribution answers the question why in 2020, programmatic action is still present in France but not in Germany and why the German policy program did not survive the financial crisis of 2008. It argues that misfit to pre‐existing institutional logics and changing institutional logics in the course of programmatic action hinder program success. 相似文献

This article contributes to the development of the Programmatic Action Framework (PAF) based on the case study of the procurement of the French Rafale fighter jet rather than the American F‐18 by the French government in the 1980s. This decision making dilemma is explained by revealing the competition between two “programmatic cliques.” The “sovereignist” programmatic clique that defends the French option embodies the Custodians of the nation state. The “liberal” programmatic clique that supports the American alternative represents the Austerians of the nation state. The defeat of the Austerians of the French nation warfare state is explained by the ties weakness available to the liberal programmatic clique at the political level of decision making. ‘Supportive Parenting’, Responsibility and Regulation: The Welfare Assessment under the Reformed Human Fertilisation and Embryology Act (1990)

Section 13(5) of the Human Fertilisation and Embryology Act 1990 requires fertility clinics, before offering regulated treatment services, to take account of the welfare of any child who may be born as a result of the treatment and any other child affected by that birth. This paper presents the findings of an empirical study examining the impact on practice of the controversial reform of this section in 2008. While the broad values underpinning section 13(5) appear well embedded in clinic staff's engagement with ethical issues, there is little evidence that practice has been influenced by the 2008 amendments. A complex picture emerged regarding the implementation of section 13(5), particularly in its interaction with other factors, such as funding criteria and professional norms around counselling, implying a higher level of ongoing attention to likely parenting ability – particularly that of single women – than might be expected from a reading of the statute and guidance alone. 相似文献
