东盟国家拯救纺织服装业的新策略与成效分析

自20世纪70年代以来,东盟国家相继发展纺织业,使东盟成为世界纺织服装重要生产出口基地。进入“后配额时代”以来,东盟各国政府和行业协会纷纷采取新的策略,拯救国内纺织服装业,使各国纺织品贸易基本都保持了良好的增长态势,顺利渡过无配额“元年”,并出现重新定位的趋势。

Bei Vorliegen der Grundvoraussetzungen einer vorl?ufigen Erh?hung des Hauptmietzinses muss über die Auswirkung des Einsatzes von F?rderungsmitteln auf die H?he des Deckungsfehlbetrages nicht zwingend entschieden werden, vor allem dann nicht, wenn die Grundlagen dafür erst aufwendig ermittelt werden müssten.     

Keine Adoption durch Lebensgefährtin der Mutter

§ 182 Abs 2 ABGB hindert generell, also nicht nur im Falle gleichgeschlechtlicher Lebenspartner, die Adoption durch einen Mann, solange die verwandtschaftlichen Beziehungen zum leiblichen Vater, bzw durch eine Frau, solange die verwandtschaftlichen Beziehungen zur leiblichen Mutter bestehen. Gem § 182 Abs 2 ABGB ersetzt also der Einzeladoptierende nicht den Elternteil seiner Wahl, sondern jenen, der seinem Geschlecht entspricht. Die Adoption des Kindes durch die Lebenspartnerin der leiblichen Mutter ist daher rechtlich unm?glich. Art 8 und 14 MRK werden dadurch nicht verletzt.     

锌与维生素A对隐孢子虫感染小鼠免疫功能的影响

为探讨锌和维生素A对隐孢子虫感染小鼠免疫功能的影响,将75只清洁级昆明小鼠随机分成5组,各组均饲喂基础日粮。其中Ⅰ组和Ⅴ组不添加锌和维生素A,Ⅱ组以饮水方式添加锌(38.5μmol/mL),Ⅲ组以灌喂的方法添加维生素 A(400 IU/只),Ⅳ组添加锌和维生素 A,Ⅰ、Ⅱ、Ⅲ、Ⅳ组均在试验开始时灌喂小型隐孢子虫卵囊( 2.56×106/mL),Ⅴ组作为不接种对照。试验结果,Ⅱ、Ⅲ、Ⅳ组小鼠的粪便排卵量和排卵持续时间分别显著低于Ⅰ组(P<0.05);在试验的第 2 周和试验结束时,Ⅱ、Ⅲ、Ⅳ组小鼠血液中CD4、CD8细胞百分率以及CD4/CD8比值均极显著高于Ⅰ组(P<0.01)。表明,锌和维生素A均能够增强小鼠的细胞免疫功能,提高机体抗隐孢子虫感染的能力。

The 2016 Austrian Presidential Election: A Tale of Three Divides

The 2016 Austrian presidential election was remarkably different than the previous ones in the history of the country characterized by its stable political system. Not only did it open the role of president in Austria to debate, but it also sidelined the two political parties that had dominated Austrian politics since World War II. Alexander Van der Bellen won the election with one of the closest margins in recent history. This article argues that the election divided the country in more than one way. Besides the near 50–50 divide between the candidates, the results show that it generated important dynamics in territorial politics as well, notably in the states and cities of Austria. These results point towards a party system transformation in Austrian politics.     

民法典视野下我国商事习惯的司法适用

商事习惯作为制定法之后的补充法源,既是商人的行为准则,也是重要的司法裁判依据。分析既有裁判文书可以发现,在民商合一路径引导下,我国司法实践并未将民商事习惯的适用约束机制同质化,商事习惯表现出独立于我国《民法典》第10条的适用路径。然而,商事习惯识别标准的模糊、填补商法漏洞的不足以及与民法规范适用顺位的分歧,影响了商事习惯司法功能的发挥。从我国审判实践出发,应将“习惯”理解为事实上的习惯;在此基础上,商事习惯的识别标准应坚持外观性标准和合理性标准。在适用顺位上,商事习惯应优先于民法任意性规范和旨在保护法律关系中弱者的民法强制性规范,以满足商法体系法源的自足性。与此同时,应借助商事习惯填补因商业创新和矫正我国《民法典》对商事活动特殊性关照缺失而产生的商法漏洞,以此助推良好营商环境的塑造。     

Analysis of some commonly found inhalants using gas chromatography-mass spectrometry (GC MS) – Effect of substrates on the identification of inhalants

Inhalant abuse is a serious and ever-evolving problem for our society. Inhalants are abused more commonly by teenagers and adolescents. Inhalants such as glue, paint thinners, correction fluid, and nail paint remover are easily available in the market which makes them readily abused. Out of various methods of abuse, huffing (placing a piece of cloth soaked with inhalant is placed in the mouth), bagging (placing head in a polythene bag containing inhalant), and ballooning (balloons filled with inhalant are used for inhaling vapors through the mouth) are most common. Inhalant abuse results in multiple target organ dysfunction with neuritis and brain damage due to the dissolution of the myelin sheath. In acute poisoning cases, it might cause death due to asphyxia and sudden sniffing syndrome. In such cases, various articles containing traces of inhalants could be retrieved from the scene of incidence and to detect these traces become an important facet of the investigation. However, it might be difficult due to the rapid evaporation of inhalants and the formation of reaction product species. In the present study, an attempt has been made to study the effect of three substrates (balloon, cloth, polythene) on component profiles of four paint thinners and four nail paint removers. The study suggests that although some components are retained, there is the formation of a large number of reaction product species and these must be taken into consideration before furnishing the opinion. These reaction product species might also be inhalant specific which must be further explored.
