强制性戒毒措施的实施现状及其改革

《中华人民共和国禁毒法》废除了传统的强制戒毒和劳教戒毒，重新确立了由强制隔离戒毒、社区戒毒和社区康复等三种新的戒毒措施构成的强制性戒毒体系。该法近五年的运作实践表明，这三种戒毒措施的实施效果违背了立法者的初衷，“宜粗不宜细”的立法模式所造成的弊端也逐渐开始显现。我国应该明确“社区为主、隔离为辅”的强制性戒毒措施体系，同时对强制隔离戒毒和社区戒毒进行制度性完善。     

《毒品识别与检验》实验教学体系创新性探索

目前公安教育普遍面临着实验教学体系薄弱的现状,在教学中为培养具有综合能力和创新能力的禁毒警察,改变现阶段禁毒民警业务知识薄弱的现状,我院禁毒学专业对“毒品识别与检验”实验教学体系进行改革,进行创新性教育的探索。     

Cloud point extraction coupled with back extraction: a green methodology in analytical chemistry

Recently, cloud point extraction (CPE) coupled with back extraction (BE) has been suggested as a promising alternative to liquid-liquid extraction. In CPE, non-ionic surfactants in aqueous solutions form micelles and the solution becomes turbid when heated to the cloud point temperature. Microwave- or ultrasonic-assisted BE can be performed after CPE and before injection of the sample for instrumental analysis by ultraviolet-visible spectroscopy, high-performance liquid chromatography, gas chromatography, gas chromatography-mass spectrometry, or liquid chromatography-mass spectrometry. This article reviews selected published scientific research on the application of CPE-BE to the determination of alkaloids, drugs and organophosphorus compounds from several complex matrices. This method could be scaled-up for use in forensic science.     

Simplified Direct PCR Method for Reference Buccal Samples Using a Non-FTA Card by Omitting the Pretreatment Step

When using non-FTA cards in commercial multiplex STR kits for direct PCR, pretreatment steps with specific buffers are recommended. Here, we designed a rapid direct PCR method utilizing a non-FTA card, Oral Cell Sampling Kit, by omitting the pretreatment step involving Prep-n-Go™ Buffer, and it showed compatibility with the GlobalFiler™ Express PCR Amplification Kit, GlobalFiler™ PCR Amplification Kit, and PowerPlex^® Fusion system. To optimize the PCR conditions, we tested the method with different final PCR volumes and cycles. Finally, we conducted a performance test using 50 Korean buccal samples and confirmed the high performance of the method, detecting more than 90% of the samples with full profiles when using GlobalFiler™ PCR Amplification Kit and PowerPlex^® Fusion system at 29 cycles in a 10 μL final PCR volume. Thus, we report a simple direct PCR set-up to analyze reference samples collected using a non-FTA card manufactured in Korea.     

商标财产化的负面效应及其化解

商标本为一种用于区别来源的工具。然而,现代商标法将之财产化,并采用民法财产权体系中的绝对权保护模式。绝对权的认知结构预设着强有力的私权保护,这为商标权的强化和扩张埋下了种子。商标财产化的理论基础脆弱,经典的自然权利理论、现代的法经济学理论以及商誉论和广告功能保护论都无法为商标财产权提供坚实的理论支撑。商标财产化在实践中产生了一些负面效应,在我国还呈加剧之势,有必要予以纠正。在认知上,需要打破绝对权理念之拘束。在实践中,停止侵害的禁令救济的绝对化适用需加以纠正;混淆之扩张需谨慎对待,以反击"财产论"对"混淆论"的挤压。此外,还需提升商标性使用的地位,使其扮演商标法"守门人"角色,以期对商标财产权的不断扩张进行约束和限制。     

性犯罪药物防治入刑的正当性及本土形塑

近年来,我国性犯罪出现的一些新情况令人堪忧,需要探索新的治理政策。有的国家采取性犯罪药物防治作为性犯罪的治理手段,值得借鉴。性犯罪药物防治是利用口服或者注射药物方式减少罪犯的雄激素、降低其性欲,达到控制性犯罪目的。有人认为这是残虐、不人道的,侵犯身体健康与性权利。而性犯罪药物防治相比起物理阉割更具人道主义精神,有利于保障基本人权,其尊重受者自由意志,具备一定的社会容忍度,执行方式高效经济。但此种手段需要加以本土化改造,需要规范法律术语,明确刑法性质与适用对象,细化执行程序。     

Why do South-east Asian states choose to suppress opium? A cross-case comparison

Abstract

This paper compares the reasons given by three South-east Asian states (Laos, Thailand and Vietnam) for choosing to suppress opium production. While external pressure, often from the US or United Nations (UN)/League of Nations, is the most commonly identified reason in the literature, and was experienced in each case, it was not by itself sufficient to motivate states into action. All three cases were motivated by religious or ideological opposition to drug consumption or trade, rural development, state extension and concern for increasing domestic drug consumption. Apprehension about rising drug consumption often possessed racial or chauvinistic elements. The development of export commodities, environmental protection and national security were also identified in one or two cases. The paper concludes by hypothesising that economic and/or security considerations underlie all choices to suppress illicit drug crops.     

甘肃省禁毒方略探讨

作为西部地区之一的甘肃省,禁毒工作在取得了显著成效的同时面临的形势依然严峻,禁毒斗争依然任重道远。为了使甘肃省禁毒斗争取得新的突破,本文探讨了甘肃省禁毒工作面临的新形势,并提出了进一步开展禁毒工作的建议。     

我国禁毒工作存在的问题及对策

目前,我国禁毒工作存在对种植毒品原植物违法犯罪打击不力、对吸毒行为处罚过轻、贩毒分子利用未成年人贩毒逃避法律制裁等问题。因此,有必要采取强化禁毒意识、进一步完善禁毒法律法规、严格查禁过境贩毒等对策。     

冬凌草甲素诱导多药耐药细胞系K562／A02凋亡,逆转耐药性？…

目的:探讨冬凌草甲素诱导多药耐药细胞系K562/A02凋亡、逆转耐药性的作用.方法:以不同浓度的冬凌草甲素处理K562/A02及敏感株K562/S细胞,流式细胞仪检测细胞凋亡率,四甲基偶氮唑盐(MTT)比色法检测半数抑制率(IC50),分析冬凌草甲素对两种细胞柔红霉素(DNR)、高三尖杉酯碱(HHT)敏感性的影响,流式细胞仪检测冬凌草甲素对两种细胞内DNR浓度的影响.结果:冬凌草甲素可诱导两种细胞凋亡,两者在各浓度、各时点无显著差异;可显著逆转K562/A02细胞对DNR、HHT的耐药性,提高该细胞内DNR的浓度.结论:冬凌草甲素对K562/A02细胞有诱导凋亡、逆转耐药性的作用,是一种很有希望的抗白血病中药.
