关于农民工就业歧视的法律思考

随着我国社会结构的变迁而产生了农民工这个特殊的群体.由于制度性及一些非制度性因素,国家对农民工的保护机制不健全,引致他们在就业、工资待遇及社会保障等方面缺乏法律保护并成为备受歧视的弱势群体.本文基于对甘肃省天水、陇南两市农民工就业状况的调查数据,从国家制度、法律及农民工自身原因等方面分析了产生农民工就业歧视的原因,并在从法律视角提出消除农民工就业歧视的建议.     

户籍、户口、户政概念之辨析

户籍、户口、户政三个概念,是涉及户政学的基础概念。长期以来,实务界乃至理论界对这三个概念分辨不清,混同、混用现象极为普遍。本文从词义角度、逻辑学的角度、历史观的角度对户籍、户口、户政三个概念进行了辨析。     

基于年龄相关DNA甲基化位点推断河南汉族个体年龄

目的探查中国河南汉族个体与年龄相关的DNA甲基化位点,构建年龄推断模型,进行甲基化和年龄相关性分析。方法采用焦磷酸测序法对ELOVL2、ClOrf132、KLF14、TRIM59和FHL2基因的34个CG位点进行甲基化分析,利用SPSS 23软件的多元回归方法建立模型,对甲基化和年龄相关性做分析。结果除ClOrf132基因3个CG位点的甲基化水平与年龄呈负相关外,其余4个基因的31个CG位点甲基化水平均与年龄呈正相关。多元回归分析表明,年龄与CG位点的甲基化水平存在明显的线性关系,实际年龄与推断年龄偏差在5岁以内的准确度达80%以上。结论本研究构建的河南汉族个体年龄推断模型,有助于通过检测血液等组织的DNA甲基化水平推断个体的年龄范围,具有法医学应用前景。     

中国后农业税时代的“非同质性”农民

减免农业税后,处于社会转型期的中国农民越来越是一个“非同质性”的群体。另一方面,农业税的取消,并不意味着中国经历“农民的终结”,中国农民在未来二三代人的时间内是无法终结的。从这个认识出发,有必要认真研究如何面对农民的“非同质性”,研究中国新农村建设的问题。它意味着“一种联合的生活方式”开始。     

The Enjoyment of Rights and Freedoms: A New Conception of the 'Ambit' under Article 14 ECHR

Article 14 of the European Convention on Human Rights, as applied by the UK judiciary under the Human Rights Act 1998, is in danger of becoming as 'parasitic' as it is often described. Judges have inappropriately narrowed the scope of the 'ambit' of other Convention articles, and thus limited the number of claims to which Article 14 can apply, by defining it according to considerations more properly weighed in a justification analysis incorporating proportionality. The emerging approach departs from Strasbourg jurisprudence, and fails to give full effect to the language and intent of Article 14. This trend need not continue. This article begins the process of fashioning a new conception of the ambit of Convention articles: one that could change the fortunes of Article 14 cases in the UK, but that flows naturally from the precedents of the European Court of Human Rights, and gives effect to the spirit of the HRA.     

应用回归分析方法推算女性胸骨年龄

研究89例中国汉族女性胸骨（11～61岁）上的8个部位的形态随年龄增长而变化的规律，并分别划分形态等级，然后采用多元线性回归和逐步回归分析方法，求出了由女性脑骨形态推算年龄的多元回归方程；对手柄—一体和／或体——剑突骨性融合的胸骨也建立了相应的方程。上述各方程经检验P＜0.01，r=0．99，SD在1．33～1．71岁之间。与国内外同类研究相比，本方法较为简便、准确，更具实用价值。     

中国“乙肝歧视第一案”一审判决书之我见

"松月案"被誉为是"2003年中国十大案件之一",对它所作出的判决备受国人的瞩目.该案的一审判决书一方面体现了人民法院对被诉具体行政行为的法律特征的准确认定,但另一方面又暴露了其对法律法规的错误适用、判决结果的措辞不准确等一些不足之处.对这些问题的思考与分析,将有利于我们更好地改进今后的行政审判工作.     

Access to Justice and Social Inclusion: The Policy Challenges in Wales

Enhancing access to legal and advice services is a central pillar of the Access to Justice Act 1999. Within the new welfare framework, employment rights come increasingly into focus as the UK government seeks to forge a link between welfare and work. Access to the labour market, and being sustained within it, are seen as major mechanisms for combating social exclusion. Discrimination at work can only thwart these ambitions. The Access to Justice reforms imply an assessment of need and a review of the ways in which individuals are negotiating the available system of redress. This article reports on a study of advice provision in employment discrimination cases in Wales, funded by the Legal Services Commission and the Equality Commissions in Wales. Drawing on the accounts of key providers, individual experiences of advice seeking and available statistical evidence, it explores the opportunities and constraints of the Welsh context and profiles many of the policy challenges posed for the devolved administration. It demonstrates that, despite advances in equalities legislation and policy directives aimed at strengthening people's employment rights, a number of critical obstacles remain for the most disadvantaged groups.     

The Impact of Socio-Cultural Integration on Return Intentions: Evidence from a Survey on Romanian Migrants

Abstract

This article analyzes the impact of socio-cultural integration on migrants’ intention to return to their country of origin. It distinguishes between the potential effects of inter-ethnic relations, language proficiency and perception of discrimination as components of integration. It uses individual-level data collected through an original survey among Romanian migrants in January 2018. It aims to test the effects of socio-cultural integration against those of alternative explanations provided in the literature. The findings indicate that the perception of discrimination, assessment of public institutions’ performance and belonging feelings are important predictors for return intentions.

法医牙科学是法医学与口腔医学的交叉学科,通过科学地收集、检测、评价牙科证据而为司法实践提供有法律效力的证明资料。本文从年龄推断,性别推断,种族、职业及生活习惯推断,个体识别,家庭暴力或虐待行为判定等方面对法医牙科学的应用现状进行综述,并对其未来应用进行展望,希望对法医牙科学体系进行不断的补充和完善,使其在法医学甚至司法实践中更好地发挥作用。
